Dear Dr. Millburn:

Thank you for testifying last Thursday at the Subcommittee's hearing on the Federal
Technology Transfer Act. We appreciated learning from you the progress that the Defense
Department has made in implementing the Act in the two and one-half years since its
passage.

In your testimony you mention that the Department of Defense is developing a data base on
areas of expertise within the DOD laboratories. When do you expect this data base to be
fully operational? Who will have access to it?

We understand that final domestic technology transfer regulations have not yet been issued.
The Subcommittee is concerned that all final regulations implementing the Act be in place
as soon as possible. We would appreciate your reporting back to us in 60 days on the status
of these regulations.

The Subcommittee is looking forward to receiving a copy of the Inspector General's report
on DOD implementation of the Federal Technology Transfer Act as soon as it is available.

Question: In your testimony you mention that the Department of Defense is developing a data base on areas of expertise within the DoD laboratories. When do you expect this data base to be fully operational? Who will have access to it?

Answer: The data base will be operational on August 1, 1989. The data base, known as the DoD Domestic Technology Transfer Referral Data Base, will be operated by the DoD's Defense Technical Information Center (DTIC). Anyone who has a specific technical area of interest concerning research conducted by DoD laboratories can contact DTIC. Anyone making an inquiry will be referred to the appropriate personnel in our laboratories compatible with the needs of the requestor. Inquiries can be made to:

Question: We understand that final domestic technology transfer regulations have not yet been issued. Answer: The DoD Regulation implementing the provisions of the Federal Technology Transfer Act of 1986 and Executive Order 12591, "Facilitating Access to Science and Technology" was issued in December 1988. A copy is provided for your information. We will request the Army, Navy, and Air Force to provide status or copies of their implementing regulations in 60 days as requested.

This Regulation cancels DoD 3200.12-R-4 dated Apr 85 (NTIS PB87 100269).

16. Abstract (Limit: 200 words)

This Regulation authorizes the DoD Domestic Technology Transfer Program and responds to the requirements of Public Law 96-480, the Federal Technology Transfer Act of 1986, and Executive Order 12591. Its purpose is to ensure the full use of the nation's federal investment in research and development (R&D), stimulating improved use by state and local governments and the private sector.
