2 SEC. 12. (a) Section 422 of the General Education

3 Provisions Act is amended by inserting "the National Part4 nership in Education Act;" after "the International Educa5 tion Act of 1966;".

6 (b) The prohibition contained in section 302 (d) of 7 Public Law 81-874 shall not apply to programs and proj8 ects conducted under this Act.

STUDY OF DATA

SEC. 13. The Secretary of Health, Education, and Wel11 fare shall conduct a study of the needs for accurate income 12 and population data for every local educational agency 13 and alternative methods for obtaining such data. This study 14 and his recommendations shall be included in the study 15 of allocation of funds required under section 102 of the Ele

mentary and Secondary Education Amendments of 1969 17 (Public Law 91-230).

A BILL

To encourage States to increase the proportion of the expenditures in the State for public education which are derived from State rather than local revenue sources.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That the Elementary and Secondary Education Act of 1965 4 is amended by inserting after title V the following new 5 title VI:

"TITLE VI-STATE ASSISTANCE

"PART A-DIRECT ASSISTANCE

"ELIGIBILITY FOR DIRECT ASSISTANCE

"SEC. 601. A State shall be eligible for direct assist

ance under this part for a fiscal year if the State educational

1 agency applies therefore and the Commissioner (on the basis 2 of information provided by such agency) determines that 3 under applicable statutory or constitutional provisions, or in 4 practice, at least 50 per centum of the financial support for 5 elementary and secondary education in such State is pro6 vided from State revenues. In making his determinations 7 required by this section, the Commissioner shall disregard 8 payments from Federal sources.

"AMOUNT OF DIRECT ASSISTANCE

"SEC. 602. (a) The amount of direct financial assist11 ance to be paid to a State which is eligible therefor under 12 section 601 shall be equal to the amount the Commissioner 13 determines a State and its political subdivisions (including 14 local educational agencies) would receive under the provi15 sions of law listed in subsection (c) for that year but for 16 the decision of the State educational agency to obtain direct 17 financial assistance under this part.

"(b) No payments shall be made under any of the 19 provisions of law listed in subsection (c) to a State or its 20 political subdivisions (including local educational agencies) 21 for any year for which such State receives direct assistance

22 under this part.

(c) The provisions of law referred to in subsections

24 (a) and (b) are the following:

"(1) Title I of the Elementary and Secondary Educa

26 tion Act of 1965.

“(2) Titles II, III, V, and VII of the Elementary and 2 Secondary Education Act of 1965.

4 Education Act of 1958.

"(3) Titles III, V, and VI of the National Defense

"USES OF DIRECT ASSISTANCE

"SEC. 603. (a) Funds granted a State under this part

shall be used for support of elementary and secondary edu

cation in that State without regard to the purposes for which

funds could be used under the provisions of law listed in 14 section 602 (c) .

"(b) As a condition to the receipt of funds under this 16 part, the Commissioner may require the adoption of such 17 fiscal control and fund accounting procedures as may be 18 necessary to assure proper disbursement of, and accounting 19 for, Federal funds paid to the State (including any such funds paid by the State to any other public agency under 21 this part)."

"PART B-GRANTS FOR INCREASING STATE SUPPORT

FOR ELEMENTARY AND SECONDARY EDUCATION

"ELIGIBILITY FOR GRANTS

"SEC. 611. A State shall be eligible for a grant under

1 this part for any fiscal year if the State education agency 2 applies therefor and the Commissioner (on the basis of in3 formation provided by such agency) determines (1) that 4 the State has increased the percentage of its expenditures 5 for elementary and secondary education which are derived 6 from State rather than local revenue sources during the 7 preceding fiscal year over such percentage for the second 8 preceding fiscal year, and (2) the average per pupil ex9 penditure in the State (as defined in section 103 (e) of 10 title I of this Act) for such year is not less than such 11 expenditure for the preceding fiscal year.

"AMOUNT OF GRANT

"SEC. 612. (a) Subject to the provisions of subsection 14 (b) and section 614, grants under this part shall be de15 termined as follows: Where the State school expenditures 16 of a State in the preceding fiscal year exceed such expendi17 tures for the second preceding fiscal year, the grant to 18 the State under this part shall be equal to 50 per centum 19 of such excess, except that such excess shall be (1) reduced 20 by the amount by which local school expenditures of the 21 State in the preceding fiscal year exceed such expenditures 22 for the second preceding fiscal year, or (2) increased by 23 the amount by which such expenditures for the preceding 24 fiscal year are less than such expenditures for the second 25 preceding fiscal year, as the case may be.
