he said I had been reported in violation of EPA standards. I was never told who my accuser was but, anyway, we went to the location in question. At this location my tanks happened to be in the same place they had been for fifty-four years, Mr. President, and he did not like the location. He said they had to be moved and if I would agree with this and get an engineer to prepare a manual, at least a foot thick, of the procedure on a day to day basis, moving the tanks and comply with all the rules and regulations, there would be nothing more to come of this. I later was notified, although my son tried to keep it from me, that I had been fined eight hundred dollars but no prison term if I would agree to comply to the previous order. The irony of it is that we did comply, we did pay, but we sent the fine to the United States Coast Guard Contingency Fund--who and whatever that may be. I have the check here with me today to show you that it was paid and was cashed, but I do not know who in the hell they are yet. What kind of authority and power are we giving these agencies? We mailed this check to the United states Coast Guard in Delaware, but it was deposited in a bank in St. Louis. I do not know what we are running but I am certainly sick of it. Now we are paying our friends and neighbors to report on each other and you cannot even find out who they are.

"Mr. President, we were giving the FBI hell, the CIA hell, but I want you to know that they are a credit to these two agencies. Mr. President, we would have had our roads open in our district if we could have sold our coal. The trucks would have kept them open. We would not be needing to replace the gold on the dome with a snow blower in Preston County as we are today, and by the way, Mr. President, just in jest, I do not think it is legal for the governor to transfer that money or buy the equipment without bids. You might have to take it to the Supreme Court.

"We are at a standstill until we do away with or replace these agencies. I know that last Monday "Lord Beard" let Monongahela Power have a thirty-day extension. By the way they have never been below the federal standards to speak

"Lord Beard" also says if you are good little boys and girls we might give you ten more days. That means we might sell coal in the northern part of West Virginia for forty days. Mr. President, we do not need his thirty days or ten days. We need to be rid of him and this ungodly agency which is ruining our economy, industry and production of coal and other natural resources in this

state.

"Mr. President, most all power plants have been built at the source of the supply of fuel. The cost of fuel at Haywood in Harrison County, when started,

was $6.50 a ton.

It is now $18.00 a ton from the mine at the plant. But that

With agencies such as this, and continued government interference, we are very lucky to have any energy at all. "I have asked the President of the United States and our congressional delegation to review and replace our Environmental Protection Agency, at least with more reasonable and more understanding guidelines, and require a review and approval of all rules and regulations that they propose. I hope, Mr. President, you will do the same. I hope every senator will do the same; I hope every person in this room will do the same. I also hope you will support my efforts in abolishing the APCC in this state and form a new energy and environment commission headed by the director of the department of mines, which department controls the energy of this state through its gas and oil division and coal mines, such commission to comprise eight additional members, two from each congressional district, and all to be appointed by the governor with the consent of the Senate and, above all, all rules and regulations to be approved by the legislative review committee of the House and Senate.

"Mr. President, these agencies no longer have respect for the citizens of this country or this state. The federal agency laughed at our review committee and our laws when we reduced the standards back in December and I am sure "Lord

Beard" got a big laugh also. Mr. President, the EPA does not respect, adhere to or even think of complying with the laws of our state. The Environmental Protection Agency has a grip on the federal government second to none. The people of this state and country are at their mercy and something has to be done about it. The Air Pollution Control Commission of this state was designed and the all-intent purpose was to formulate the rules and regulations as liberal

as possible to protect the health of the people of West Virginia and the economy. Mr. President, whatever good they did, and they did some, has now made fools of us all. We are freezing; we are out of jobs; we need help. They have failed and we must abolish that agency and start over. Thank you."

The Industrial Gas Cleaning Institute is pleased to submit an updated supplement to our earlier testimony of April 29, 1975. As before, this statement deals mainly with progress in flue gas desulfurization.
