1 substances in man and the environment as is necessary to 2 carry out the purposes of this title. In addition, limited re3 search may be undertaken to confirm the results of tests 4 required by this title. To the extent possible, such research 5 and monitoring shall not duplicate the efforts of other Fed6 eral agencies or the research required of manufacturers under 7 this title. In order to carry out the provisions of this section, 8 the Administrator is authorized to establish research labora9 tories, including the acquisition of necessary land, buildings, 10 or facilities, and to make contracts for such research and

11 monitoring.

“ADMINISTRATIVE INSPECTIONS AND WARRANTS

"SEC. 212. (a) (1) For the purpose of inspection, copy14 ing, and verifying the correctness of records, reports, or other 15 documents required to be kept or made under this title and 16 otherwise facilitating the carrying out of his function under 17 this title, the Administrator is authorized, in accordance with 18 this section, to enter any factory, warehouse, or premises 19 in which chemical substances are manufactured, processed, or held and to conduct administrative inspections thereof, "(2) Such entries and inspections shall be carried out 22 through officers or employees (hereinafter referred to as 23 'inspectors') designated by the Administrator. Any such 21 inspector, upon stating his purpose and presenting to the owner, operator, or agent in charge of such premises (A)

1 appropriate credentials and (B) his administrative inspection 2 warrant or a written notice of his other inspection authority, 3 shall have the right to enter such premises and conduct such 4 inspection at reasonable times.

5 "(3) Except when the owner, operator, or agent in 6 charge of such premises so consents in writing, no inspection 7 authorized by this section shall extend to

"(A) financial data;

"(B) sales data other than shipment data;

"(C) pricing data;

"(D) personnel data; or

"(E) research data (other than data relating to the

tests described in subsection 207 (b) or data otherwise required by this Act).

(b) A warrant under this section shall not be required 16 for entries and administrative inspections (including seizures

17 of property) –

"(1) with the consent of the owner, operator, or

agent in charge of such premises;

"(2) in situations presenting imminent danger to

health or safety;

"(3) in any other exceptional or emergency circumstances where time or opportunity to apply for a warrant is lacking; or

"(4) in any other situations where a warrant is

not constitutionally required.

"(c) Issuance and execution of administrative inspec

4 tion warrants shall be as follows:

5 "(1) Any judge of the United States or of a State 6 court of record, or any United States magistrate, may, 7 within his territorial jurisdiction, and upon proper oath or affirmation showing probable cause, issue warrants for the purpose of conducting administrative inspections authorized by this title or regulations thereunder, and seizures of property appropriate to such inspections. For the purposes of this

subsection the term 'probable cause' means a valid public

interest in the effective enforcement of this title or regula14 tions thereunder sufficient to justify administrative inspec15 tions of the area, premises, building, or contents thereof, in 16 the circumstances specified in the application for the warrant. "(2) A warrant shall issue only upon an affidavit of an officer or employee having knowledge of the facts alleged, sworn to before the judge or magistrate and establishing the 20 grounds for issuing the warrant. If the judge or magistrate 21 is satisfied that grounds for the application exist or that there 22 is probable cause to believe they exist, he shall issue a war23 rant identifying the area, premises, or building, to be in24 spected, the purpose of such inspection, and, where appropri25 ate, the type of property to be inspected, if any. The warrant

1 shall identify the items or types of property to be seized, 2 if any. The warrant shall be directed to a person authorized 3 under subsection (a) (2) to execute it. The warrant shall 4 state the grounds for its issuance and the name of the person

5

or persons whose affidavit has been taken in support thereof.

6 It shall command the person to whom it is directed to in

7

spect the area, premises, or building, identified for the pur8 pose specified, and, where appropriate, shall direct the 9 seizure of the property specified. The warrant shall direct 10 that it be served during normal business hours. It shall designate the judge or magistrate to whom it shall be returned. "(3) A warrant issued pursuant to this section must 13 be executed and returned within ten days of its date unless,

upon a showing by the United States of a need therefor, 15 the judge or magistrate allows additional time in the warrant. 16 If property is seized pursuant to a warrant, the person exe17 cuting the warrant shall give to the person from whom or 18 from whose premises the property was taken a copy of the 19 warrant and a receipt for the property taken or shall leave 20 the copy and receipt at the place from which the property

was taken. The return of the warrant shall be made promptly 22 and shall be accompanied by a written inventory of any

property taken. The inventory shall be made in the presence 24 of the person executing the warrant and of the person from 25 whose possession or premises the property was taken, if they

1 are present, or in the presence of at least one credible person 2 other than the person making such inventory, and shall be 3 verified by the person executing the warrant. The judge or 4 magistrate, upon request, shall deliver a copy of the inven5 tory to the person from whom or from whose premises the property was taken and to the applicant for the warrant.

“(4) The judge or magistrate who has issued a warrant 8 under this section shall attach to the warrant a copy of the 9 return and all papers filed in connection therewith and shall 10 file them with the clerk of the district court of the United 11 States for the judicial district in which the inspection was 12 made.

"EXPORTS AND IMPORTS

"SEC. 213. (a) Notwithstanding any other provision of 15 this title, no chemical substance shall be deemed in violation 16 of this title when intended solely for export to any foreign 17 country except if the Administrator finds, by regulation, that as exported and used the chemical substance, or particular

uses of the substance, will produce a significant direct or 20 indirect hazard to human health or the environment in the

21 United States.

"(b) The Secretary of the Treasury shall refuse entry

23 into the United States of any chemical substance or article 24 containing such substance offered for entry if it violates any
