R. 11359 IN THE HOUSE OF REPRESENTATIVES OCTOBER 20, 1971 Mr. BENNETT introduced the following bill; which was referred to the Committee on Interstate and Foreign Commerce A BILL To provide for a National Institute of Drug Addiction and Alcoholism, and to require community mental health facilities to provide treatment and rehabilitation programs for drug addicts and other persons with drug related problems. 1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That a National Institute of Drug Addiction and Alcoholism 4 shall be established. Such Institute shall engage in research 5 toward finding ways to reduce addictive drug and alcoholic 6 dependence. Such Institute shall be under the jurisdiction of 7 the National Institutes of Health. 2 SEC. 2. (a) Section 221 of the Community Mental 2 Health Centers Act (42 U.S.C. 2688a) is amended by 3 adding at the end thereof the following new section: 4 "(c) No grant may be made under this part with re spect to any community mental health center for any fiscal 6 year beginning after June 30, 1972, unless the application 7 for a grant for such center contains assurances satisfactory 8 to the Secretary that— 9 10 10 "(1) the center will provide in such fiscal year a treatment and rehabilitation program for drug addicts 11 and other persons with drug abuse and other drug 121 13 14 15 16 1791 18 19 20 21 220 23 2496. dependence problems who are in the area served by the center or the need for such a program in the area served by the center is not of such magnitude to warrant the provision of such a program by the center; and "(2) the center will enter into agreements with departments and agencies of the Government under which agreements the center may be used (to the maxi'mum extent practicable) in treatment and rehabilitation programs (if any) provided by such departments and agencies for drug addicts and other persons with drug abuse and other drug dependence problems who are in the area served by the center." (b) Section 224 (a) of such Act (42 U.S.C. 2688d (a)) 3 1 2 3 4 5 6 8 is amended by striking out "$60,000,000" and inserting in lieu thereof "$220,000,000". SEC. 3. (a) Section 341 (a) of the Public Health Serv ice Act (42 U.S.C. 257 (a)) (relating to care and treat ment of narcotic addicts and other drug abusers) is amended by adding at the end thereof the following new sentence: "In 7 carrying out this subsection, the Secretary shall establish in each hospital and other appropriate medical facility of the Service a treatment and rehabilitation program for drug 10 addicts and other persons with drug abuse and drug dependence problems who are in the area served by such hospital or other facility; except that the requirement of this sentence 9 11 12 13 14 15 16 17 18 19 20 shall not apply in the case of any such hospital or other fa cility with respect to which the Secretary determines that there is not sufficient need for such a program in such hospital or other facility." (b) Section 341 of such Act is amended by adding at the end thereof the following new subsection: "(c) The Secretary may enter into agreements with the Administrator of Veterans' Affairs, the Secretary of Defense, and the head of any other department or agency of the Government under which agreements hospitals and other appropriate medical facilities of the Service may be used in treatment and rehabilitation programs provided by such de25 partment or agency for drug addicts and other persons with 22 4 1 drug abuse and other drug dependence problems who are in 2 areas served by such hospitals or other facilities." 3 SEC. 4. There are hereby authorized to be appropriated 4 such sums as may be necessary to carry out the purposes of 5 this Act. 92D CONGRESS 1ST SESSION H. CON.
