This purchase order is subject to all of the regulations issued by Commodity Credit Corporation Governing the 1956 Emergency Feed Program. This purchase order is invalid unless (1) transferred by the farmer named below to a dealer within 60 calendar days after the date of issuance shown below, and (2) presented by the dealer to the ASC County Committee shown below within 30 calendar days after the date of such transfer. The date of transfer by the farmer to a dealer shall be that date on which the farmer signs Section IV below which must be on or after the actual sale by the dealer, actual purchase by the former, and delivery, either physical or constructive, to the farmer of all of the designated surplus feed grains or approved mixed feed specified in Section III below. This purchase order may be presented to the ASC County Committee only by a dealer who has entered into a "Feed Dealer's Agreement 1956 Emergency Feed Program" signed on behalf of CCC by an authorized representative of the ASC County Committee shown below and who is entitled under the terms and conditions of such agreement to present this purchase order. A dealer who accepts the transfer of this purchase order from the former prior to the time that he enters into such agreement does so at his own risk and CCC shall not be liable to such dealer in any way for refusal to enter into the agreement with the dealer.

SECTION I TERMS OF ISSUANCE. This Purchase Order may be used only by the farmer to purchase. hundredweight of barley, corn, grain sorghums or oats, (such commodities are referred to herein as "designated surplus feed gains") from a dealer for use as livestock feed. Such designated surplus feed grains may be purchased as straight gain or may be contained in Approved Mixed Feed containing not less than the required percentages by weight of designated surplus feed grains, as shown in Column (A) of the table set forth in Section III hereof. The value of this Purchase Order shall be the "Total Value" properly entered by the dealer in line 5 of Column (D) of the table set forth in Section III hereof on the basis of the designated surplus feed grains actually sold by the dealer and purchased by the farmer, such table, whichever, is less. and delivered, either physically or constructively, to the farmer, or the amount entered by the ASC County Committee in line 6 of Column (D) of

SECTION II-ISSUANCE AND USE OF DEALER'S CERTIFICATE. The dealer to whom this Purchase Order is transferred may present this
Purchase Order to the ASC County Committee shown above and request the issuance of a Dealer's Certificate, provided Sections III and IV here-
of have been duly executed, and provided the dealer is entitled under the terms and conditions of his "Feed Dealer's Agreement - 1956 Emer-
gency Feed Program" to present the Purchase Order to the ASC county committee. Upon presenation and request by such dealer, the ASC county
committee will issue the eligible dealer a Dealer's Certificate having a face value equal to the value of this Purchase Order. If the dealer pre-
sents more that one Purchase Order at any one time, the ASC county committee inay, at its option, issue one Dealer's Certificate having a face
value equal to the total value of such Purchase Order. The Dealer's Certificate, if presented to CCC by the holder within 120 claendar days
after the date of issuance, will be accepted at face value for the purchase of designated CCC-owned surplus feed gains at the prevailing
market price as determined by CCC at time of purchase, in store or f.o.b. conveyance at point determined by CCC.

SECTION III-CERTIFICATION BY DEALER RECORD OF PURCHASE.

(a) I certify that I have actually sold and delivered, either physically or constructively, to the above-named farmer the designated surplus feed percentage by weight of designated surplus feed grains. grains and approved mixed feed as shown in the table below and that any approved mixed feed shown therein contained at least the required

(b) I certify that I have accepted the transfer of this Purchase Order in part payment for the quantity of designated surplus feed grains or approved mixed feed as shown in the table below to the full extent of the value, as specified in Column (C) of such table, for each hundredweight so shown.

(c) I certify that in the event I have sold designated surplus feed grains for delivery trackside to the above-named farmer, I have charged him no more than the cost of such feed grain to me plus a handling margin no larger than that which has been determined by the ASC State Committee

to be reasonable.

(d) I certify with respect to this Purchase Order that I have fully complied with all of the provisions of Section 2 of the "Feed Dealer's Agreement 1956 Emergency Feed Program," and that I am entitled under the terms and conditions of such Agreement to present this Purchase Order as the basis for issuance of a Dealer's Certificate.1/

The conversion factor used in the locality or established by the ASC State Committee to convert ear corn to shell corn shall be entered in line 4, Column (C) of the table in Section III by the ASC county committee when the purchase order is issued.

**Line 6 of the table in Section III is to be filled in by the ASC county committee when the pruchase order is issued.

1/ Sextion 15 (a) of the Commodity Credit Corporation Charter Act (62 Stat. 1070) provides a fine of not more than $10,000 or not more than five year's imprisonment, or both, for making any statement knowing it to be false for the purpose of influencing the action of the Corporation or of obtaining money, property or anything of value under any act applicable to the Corporation.

A. The dealer shall fill in the table in Section III on the reverse side of this form in the following manner;

1. Enter in line 1 Col. (B) the exact number of cwt. of straight designated surplus feed grains sold and delivered in accordance with the provisions of the program.

2. Enter in line 2 Col. (B) the number of gross cwt. of any "Mixed Feed A" sold and delivered in accordance with the provisions of the program.

3. Enter in line 3 Col. (B) the number of gross cwt. of any "Mixed Feed B" sold and delivered in accordance with the provisions of
the program.

4. Enter in line 4 Col. (B) the number of gross cwt. of ear corn sold and delivered in accordance with the provisions of the program.
5. Multiply the entry in line 1 Col. (B) by $1.00 and enter the result after the $ sign in line 1 Col. (D).
6. Multiply the entry in line 2 Col. (B) by .75 and enter the result after the $ sign in line 2 Col. (D).

7. Multiply the entry in line 3 Col. (B) by .60 and enter the result after the $ sign in line 3 Col. (D).

8. Multiply the entry in line 4 Col. (B) by the conversion factor in the same line Col. (C) and enter the result after the $ sign in line 4 Col. (D).

9. Add the entries in lines 1, 2, 3 and 4 Col. (D) and enter the total in line 5 Col. (D).

10. The dealer shall sign and enter his address and the date of signature in the spaces provided.

B. After the sale and delivery, and the entries provided for in 1-9 above are made, the dealer will secure the farmer's signature in Section IV and enter the date the farmer's signature was affixed in the spaces provided.

STATEMENT OF RALPH W. FARR, REPRESENTING THE COLORADO GRAIN, MILLING & FEED DEALERS ASSOCIATION, GREELEY, COLO., ACCOMPANIED BY ALVIN E. OLIVER, EXECUTIVE VICE PRESIDENT, GRAIN & FEED DEALERS ASSOCIATION

Mr. FARR. Gentlemen of the subcommittee, my name is Ralph W. Farr and my home is in Greeley, Colo., where I am vice president of the Farr Co.

I appear here today as reprsentative of the Colorado Grain, Milling & Feed Dealers Association, a trade organization including 286 firmmembers.

We appear in support of H. R. 2486 and other bills of a similar or identical wording.

The Department of Agriculture, under its enabling legislation, aided drought-stricken farmers in 1954 by diverting surplus CCC grain to feeders for $1 per hundredweight below normal retail prices. Departmental regulations required FHA personnel to certify eligible farmers to the county ASC committees, who in turn issued purchase orders good for 120 days.

Both the dealer and farmer accepted these orders as a firm contract for a specific amount of grain, most of which was delivered within the 4 months period.

But the exigencies of the drought required local officials and dealers not to be too exacting. The auditors differed with local interpretations and established the so-called early and late delivery claims against the dealers.

Some farmers drove miles to reach their FHA office, only to learn that it took several days or weeks to get their papers processed; consequently, many asked if they could get feed in advance on their purchase orders.

Since this was an emergency, the local and State officials and dealers could see nothing wrong with letting the farmer have some feed in advance for they knew he would have his papers shortly.
