ARRANGEMENT OF CLAUSES.

Preamble.

Interpretation :

"Commissioners " "Ecclesiastical Corporation; "Church Property;" "Estates and Revenues;" Lands and Hereditaments;" "Hereditaments;" "Tithes;" "Mines;" "Bishop" and "See;" Sect. 1.

Church Estates Commissioners to be Commissioners for executing this Act, and to have a Seal; 2.

Commissioners may summon and examine Witnesses; 3.

Profits and Revenues of Episcopal and Capitular Estates to be received by Commissioners, and Management of the same vested in said. Commissioners. Proviso: That Commissioners not to have any Estate in such Premises other than for the Purposes of this Act; 4. Bishop to be allowed to take to farm Land not exceeding in the whole Five hundred Acres; 5.

Existing Bishops enabled to come into Arrangements affecting future Bishops; 6.

Certain Sources of Income excepted from the Management of Commissioners; 7.

Commissioners to keep a separate Account of Monies received in respect of each Corporation; 8.

Every Ecclesiastical Corporation to make a Return of the Monies received and collected by it. Deficiency to be made up by Commissioners, and to be a Charge upon the Estates belonging to such Corporation; 9.

Chapters or Members of Chapters may apply for and receive fixed instead of fluctuating Incomes; 10.

Act not to interfere with the general Distribution of Cathedral Revenues, except in certain Cases; 11.

Payments to be made by Commissioners charged upon the Estates of the Corporations; 12.

Power of Entry when Rentcharge is not paid; 13.

Expenses to be defrayed out of the Revenues in respect of which they are incurred; 14.

Surplus Estates of one Ecclesiastical Corporation to be transferred for Benefit of another; 15.

Sale or Exchange of such surplus Estates authorized in certain Instances; 16.

Episcopal Estates to be applicable in the first instance only for the Benefit of Episcopal Interests, and Capitular for Capitular Interests; 17.

Manner in which Estates when transferred are to be managed and subject; 18.

Mode of Sale or Exchange; 19.

Power to revoke old and to declare new Uses; to effectuate Sales and Exchanges; 20.

Trusts of Purchase Money received from Sales and Exchanges. Directions to convey Lands purchased and taken in Exchange; 21. Until Purchases are made, Money to be invested in the Funds. Interest of the Funds to go as the Rents of Lands would go if purchased; 22.

Commissioners Receipts to be good Discharges; 23.

Deeds, Instruments, and Conveyances how to be made; 24.

Act not to interfere with certain Parliamentary Powers of Sale and Exchange, 42 G. 3. c. 116., &c.; 25.

No previous Act or Order in Council to interfere with the Provisions of this Act; 26.

Provisions to be made for Places where Tithes arise; 27.

No new Leases of Tithes to be granted; 28.

Powers of Sale or Enfranchisement granted to Ecclesiastical Corporations by 14 & 15 Vict. c. 104. transferred to the Commissioners; 29.

Rights and Obligations of Commissioners in respect of Estates under their Management; 30.

No Palace of a Bishop or House of Residence of any Member of an Ecclesiastical Corporation to be let on Lease; 31.

Rights of Commissioners over Estates to be transferred; 32.

Forms of Conveyances, &c. to be prepared by Commissioners; 33. Commissioners to retain or employ Officers; 34.

Compensations to Persons affected by the Provisions of this Act; 35. Restrictions as to Compensation; 36.

Make better Provision for the Management of
Episcopal and Capitular Estates.

HEREAS the Ecclesiastical Commissioners for England, Preamble.

by virtue of various Acts of Parliament and Orders of Her Majesty in Council, are already invested with a considerable Control over and possessed of an Interest in the Estates and Revenues belonging to various Ecclesiastical Bodies: And whereas it is expedient that such Control, by being extended, should in every respect be calculated to render such Estates and Revenues most productive and beneficial to the Established Church, and most conducive to the spiritual Welfare of the People, and that such Arrangement should be made as to secure to Archbishops, Bishops, and the several Members of Chapter, Dignitaries, and Officers of Cathedral and Collegiate Churches respectively, fixed instead of fluctuating Incomes, in a Manner most befitting their Spiritual Character: Be it therefore enacted by the Queen's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, as follows: That

I. The following Words and Expressions in this Act shall have the Meanings hereby assigned to them respectively, so far as such Meanings are not excluded by the Context or by the Nature of the Subject Matter; (that is to say,)

The Word "Commissioners shall mean the Church Estates 5
Commissioners:

The Expression "Ecclesiastical Corporation" shall include every
Archbishop, Bishop, Dean and Chapter, Dean, Archdeacon,
Canon, Prebendary, and other Dignitary or Officer of any
Cathedral or Collegiate Church in England or Wales, and every 10
minor Ecclesiastical Corporation or College of Vicars in any such
Cathedral or Collegiate Church, but shall not include any other
College or Hospital, or any Parson, Vicar, or Perpetual Curate,
or other Incumbent of any Benefice:

The Expression " Church Property" shall mean any Lands, Estates, 15
or other Hereditaments, of whatsoever Nature, of or to which any
Ecclesiastical Corporation shall be seised or entitled in right of
his or their See, Church, Dignity, Stall, Preferment, Office, or of
or to which the Ecclesiastical Commissioners for England may
be entitled in right of such Ecclesiastical Corporation, or which 20
shall legally or by Custom be annexed thereto respectively; also
any Profits, Emoluments, or Revenues, from whatsoever Source
and in whatsoever Manner arising, of or to which any Ecclesias-
tical Corporation shall be entitled in such Right as aforesaid, or
which shall be payable to the Ecclesiastical Commissioners for 25
England, either on behalf of such Ecclesiastical Corporation or in
their own Behalf as part Owners thereof with any such Ecclesias-
tical Corporation:

The Expression "Estates and Revenues" shall mean the whole
Amount of the Possessions, Profits, and Emoluments of 30
any
Ecclesiastical Corporation for the Time being, and which shall be
Church Property within the Meaning of this Act:

The Expression "Lands and Hereditaments" shall mean such and
so much of Church Property within the Meaning of this Act as
shall under this Act be subject to the Management and Control 35
of the Commissioners:
The Word "Hereditaments shall include all Manors, reputed
Manors, Rectories, Messuages, Tenements, Tithes, Rents, Mines,
Minerals, and Hereditaments of any Nature and Tenure, whether
corporeal or incorporeal (except Advowsons), as well in reversion 40
as possession, and any Leasehold Interest therein, and every indi-
vidual Share thereof:

The Word "Tithes" shall mean all Rectories Impropriate, Great
and Small Tithes, or Portions of Tithes, Moduses, Compositions,
and Rentcharges in lieu of Tithes, or Common or other Lands 45
