ARRANGEMENT OF CLAUSES.

Preamble.

4 & 5 Vict. c. 57., 5 & 6 Vict. c. 102., 11 & 12 Vict. c. 98., and

15 & 16 Vict. c. 57., repealed; Sect. 1.

What shall be deemed Election Petitions; 2.

Examiner of Election Petitions.

Speaker to appoint Examiner of Election Petitions; 3.

In case of Illness, &c. of Examiner of Election Petitions, Speaker to appoint a fit Person to perform the Duties; 4.

Affidavit to be made before presenting Petition; 5.

Recognizances.

Before Petition presented Recognizances to be entered into; 6. Persons entering into Recognizances to make Affidavits of Sufficiency; 7.

Form of Recognizance, as set forth in Schedule; 8.

Persons signing Election Petition may pay Money into the Bank, instead of finding Security; 9.

No Petition to be received unless endorsed by the Examiner of Recognizances; 10.

How Recognizances are to be entered into, and Affidavits sworn; 11. Names of Sureties, &c. to be kept in Office of the Examiner, and to be open to Inspection; 12.

Recognizance may be objected to for Invalidity, or for Insufficiency of Sureties; 13.

Notice of Objections to be published in the Office of the Examiner, and Copies may be taken; 14.

Examiner to decide on the Objections: 15.

If Recognizance held invalid for Matter of Form, a new one may be given, or the Money paid into the Bank; 16.

If amended Recognizance held to be invalid, Money must be paid into the Bank; 17.

Examiner to report whether or not Recognizances are objectionable, and to make List of Petitions in which Recognizances are objectionable; 18.

Admission of Parties to defend.

Proceedings when the Seat becomes vacant, or the sitting Member declines to defend his Return; 19.

Voters may become a Party to oppose the Petition; 20.

Members having given Notice of their Intention not to defend, not to appear as Parties; 21.

Double Return.

Provision for Cases of double Return, where the Member complained of declines to defend his Return; 22.

Assessors.

Assessors to Election Committees to be appointed before Meeting of Parliament; 23.

Assessor to hold the Appointment till End of Session; 24.

Remuneration of Assessors; 25.

Assessor to take Oath; 26.

General Committee.

At the Beginning of every Session the Speaker to appoint a General Committee; 27.

If the House disapprove the first Appointment, a new Appointment to be made; 28.

Disapproval may be general or special; 29.

Members not disapproved by the House may be again named in the Warrant; 30.

For what Time the Appointment shall be; 31.

Vacancies in General Committee to be made known to the House, and Proceedings suspended; 32.

General Committee may be dissolved in certain Cases; 33.

How Vacancies shall be supplied, and Re-appointments made; 34. Speaker to fix the Time and Place of First Meeting of Committee; General Committee to be sworn; 35.

Members necessary to enable the Committee to act; 36.

Committee to regulate their own Proceedings; 37.

Clerk to keep Minutes of Proceedings, to be laid before the House; 38. During Suspension of Proceedings the Speaker may adjourn any Business before the General Committee; 39.

Members

Members excused.

Members temporarily disqualified from serving; 40.
Exemption from serving on Election Committees; 41.

Claims to be excused may be made to General Committee; 42. A List to be made, distinguishing the excused and disqualified Members; 43.

Appointment of Preliminary Committee.

General Committee to select Fifteen Members, to form the Preliminary Committee; 44.

General Committee to report to the House; and to appoint a Time for Members of Preliminary Committee to be sworn; 45, 46. Members, if not present within One Hour after appointed Time, to be taken into Custody; 47.

If Member not brought to the House Three Hours after appointed Time, further swearing of Committee to be adjourned; 48.

Members not attending at Time to which swearing adjourned, to be discharged; 49.

General Committee to supply Vacancies in Preliminary Committee; 50.

Panels, &c.

List of Members to be divided into Panels; 51.

General Committee to correct the Panels from Time to Time; 52.
Power to transfer Names of Members to another Panel; 53.
Election Petitions to be referred to the General Committee; who
shall divide Lists of Petitions into Two Parts, viz., those alleging
Bribery, &c. to be in First Part, and all other in Second; 54.

Duties of Preliminary Committee.

General Committee to refer Petitions in First Part of List to Preliminary Committee; 55.

How Preliminary Committee shall proceed in trying Petitions; 56. Petitions to be taken in Order in which they stand; 57.

Preliminary Committee to mark "allowed," "disallowed," or "no Evidence" on Petitions, and to return them to General Committee;

58.

Preliminary Committee may inquire and ascertain whether Petitioner has withheld Evidence, &c.; and shall report their Determination to the House; 59, 60.
