Neither JTPA nor FESA prohibit an SDA Plan from targeting its employment and training opportunities for an identified segment of the eligible population, so long as youth, recipients of Aid to Families With Dependent Children and school drop-outs are properly served.

It is concluded that this Plan contains provisions to satisfy the employment and training services to the groups identified in JTPA. Dated: November 29, 1983

GENERAL PROVISIONS

BASIC PROVISIONS The following provisions apply to all Subgrantees: !. The Subgrantee has been selected to receive funds under this progran and shall provide services in and for the Service Delivery Area designated in this agreement in accordance with the provisions of this Subgrant Agreement and all exhibits attached hereto.

In its performance under this agreement the subgrantee shall fully
comply with the requirements of:

4. The Job Training Partnership Act (JTPA) Public Law 97-300, all
federal regulations and Governor's policies and procedures
issued pursuant to JTPA, and any new legislation, regulation,
policy and procedures which may replace JTPA;

The Family Economic Security Art (FESA), California Unemployment Insurance Code, Section 15000 et seq., to the extent permitted by federal law; all State regulations and Governor's policies and procedures issued pursuant to FESA; and any new legislation, regulation, policy and procedures which may replace FESA and;

The terms and conditions of this agreement and all applicable federal, federal, State and local laws, regulations and policies.

If the regulations promulgated pursuant to JTPA or FESA are amended
or revised, the Subgrantee will comply with such revisions or will
notify the Employmeat Development Department (EDD) within 30 days
after promulgation of the amendments or revision that it cannot so
conform so that EDD may take appropriate action including termination
of the subgrant, if necessary.

Funding of this subgrant is contingent on the availability of federal
or State funds and continued federal or State authorization for
program acivities, and is subject to amendment or termination due to
Lack of funds or authorization.

This subgrant is subject to modification and termination as necessary in accordance with requirements contained in any future federal or State legislation, regulations or policy.

In the event of any termination, all property, finished or unfin-
ished documents, photographs, data, studies and reports or unused
supplies prepared or purchased by the Subgrantee under this subgrant
shall be disposed of in accordance with direction from EDD.

EDD and/or purchased by the subgrantee with funds pursuant to this
agreement shall be limited to use pursuant to this agreement and
shall remain the property of the United States Government and/or
State of California, EDD. Upon termination of this agreement,
subgrantee shall immediately return such tools and/or equipment to
EDC or dispose of them in accordance with the directions of EDD,
