the detoxification period, until they get into the frame of mind to take further treatment and rehabilitation, because many addicts just don't want to. They have no desire.

Mr. CHAYET. The question is: How do you keep this from getting out of hand and becoming an indefinite involuntary

Mr. ROGERS. If you have an approved court system, I am not so sure that can't be done. You do it in mental health problems. What about when you have communicable diseases? You try to isolate the disease from spreading.

Mr. CHAYET. The problem is that you know when TB is conquered, but when you try to measure predictibility of human behavior, of what the person is going to do in the future as to what risk he creates for society, and whether he is going to go back on society, the index of successful prediction is just so low

Mr. ROGERS. But with followup it is pretty easy to find out with tests every so often. Then your people in the therapeutic community pretty well know. I think there are ways to do it. I think we have to be careful in doing it.

Mr. Roy. Will the Chairman yield?

Mr. ROGERS. Yes.

Mr. Roy. I hate to speak in analogies, but with TB we follow these people essentially forever, because once in a while a cavity breaks down and there is a positive sputum, and they do endanger their co-workers. I believe this is a great problem. We will have a greater recidivism with this, but we will have to have some way of doing this. Mr. ROGERS. Thank you very much for your testimony.

The committee stands adjourned until 10 o'clock tomorrow morning when the Secretary of HEW will appear and we will meet on the first floor.
