3.32 Standards and Requirements

Programs shall meet appropriate standards and requirements set
forth in various vocational education acts and regulations and
this State Plan except as provided in 3.33. Approved programs
must: have significant value to vocational education; be
adequate in design and procedure; reasonable in terms of finances;
and provide for adequate qualified personnel.

Waiver of Standards and Requirements

Standards and Requirements in State Plan

In special cases as a part of program development, the
State Board may with respect to a research, demonstration,
or experimental program waive any demonstration, or
experimental program, waive any standards and requirements
in its State Plan if such standards and requirements are
not specifically prescribed by the acts and the Federal
regulations. In such cases, the State Board will submit
to the Commissioner information regarding the purpose and
duration of the program and the provision in the State Plan
to be waived. No Federal funds to support such a program
shall be used until receipt of its proposal is acknowledged
by the Commissioner.

Standards and Requirements in Federal Regulations

In special cases as a part of program development, the State
Board may submit to the Commissioner a request for approval
of a research, demonstration, or experimental program
which requires a waiver of standards and requirements
prescribed by the Federal regulations. Such request will
include information regarding the purpose and duration
of the program and the provision in the Federal regulations
and corresponding provision in the State Plan, if any, to
be waived. No Federal funds to support such a program shall
be used until notice of approval by the Commissioner is
received and then only to the extent of such approval.

The State Board will maintain a staff, (see 1.22), adequate
for the administration, supervision and evaluation of all
vocational education programs under the State Board and
State Plan and will adopt such procedures as are necessary
to meet the standards and regulations in this State Plan and
various vocational education acts and to maintain adequacy
and high quality in vocational education programs.

3.41-2 Evaluation

Evaluation of the program of instruction will be made periodically on the State level and continuously on the local level with results of evaluations and changes and improvements on the local level being reported to the State staff. Results of evaluations including change and improvement will be described in the State's Annual Descriptive Report or other reports to the Commissioner.

Local Programs

The State Board will, through supervisory visits, records, reports, evaluations and consultive service, be assured that local educational agencies and institutions are supervising and evaluating local programs of vocational education and are making such changes and improvements as are indicated and are giving direction and leadership to the development and maintenance of vocational education in the community or area served by the local agency.

Other Ancillary Services and Activities

The State Board will plan and publish or cooperate with other educational agencies and institutions in the planning and publishing of bulletins, guides, instructional outlines and other materials pertinent to vocational education.

Construction of Area Vocational Education Schools (Legal Appendix 4.16). 4.1 Procedures for Taking Action on Area Vocational Education School Projects The State Board will take into consideration the following when taking action on area vocational education school projects.

4.12 Projects Undertaken by a Local Educational Agency

4.12-1 Application by Local Educational Agency

The State Board will give consideration to application for
projects from local educational agencies and institutions
which meet one of the requirements detailed in Section 8
(2) of the 1963 Act provided that such applications are in
written form and include evidence that:

A sufficient number of eligible students who want and need vocational education are available in the area to be served by the school.

Financial resources, including funds made available
through the State Board, are adequate to develop and
maintain a vocational education program which is
of high quality and realistic.

Action by the State Board

Applications for projects will be evaluated and approved
by the State Board. (See 4.13).

Clearance with Other State Agencies

Project requests from State institutions shall be approved
by the State Board and referred to the State Department
of Public Works and the State Legislature for final approval
and partial funding. (Legal Appendix 4.16).

Projects at Other Than State Institutions

Approval by the State Department of Public Works and State
Legislature of projects, at other than State institutions,
shall not be necessary unless the project involves the use
of State funds and/or overall budget approval by the
State Legislature. (Legal Appendix 4.16).

Actual Construction of Facilities

Actual construction of all area vocational education school facilities shall be under the general supervision of the State Department of Public Works.

4.2 Criteria to be used in Determining the Relative Priorities of Projects

The State Board, when assigning priorities to projects, will take into consideration all of the following:

The availability of vocational instruction to all persons in all

The number and classification of persons to be served.

4.23 Geographic Area

The geographic area to be served.

4.24 Type and Cost of Facility

The type and cost of facility including classroom, shops, laboratories and libraries.

4.25 Employment Opportunities

The need and opportunity for persons trained in the occupation or
occupational fields to be offered in the facility in relation
to the total training needs and employment opportunities in the
area, the State and elsewhere.

4.26 Non-public Vocational Education Facilities

The number and type of other than public vocational education programs and facilities in the area in relation to the employment opportunities in the area, State and elsewhere.

Terms and Conditions of Approved Projects

The State Board in prescribing terms and conditions for approval of projects for reimbursement from any source of vocational education funds will be assured:

Needs of Persons Served

That the facility shall be functional and shall meet the needs of those persons and communities to be served.

Cost of Projects

That the projects shall be undertaken in an economic manner and shall not be elaborate or extravagant in design or materials.

Availability of Funds for Construction

That sufficient funds will be available to meet the State and Local share of the cost of constructing the facility.

4.34 Availability of Funds for Continuing Program of Instruction

That when construction is completed, sufficient State, local and other funds will be available for effective use of the facility for

Undisturbed Use and Possession

That the interest of the State Board or the local educational
agency in the facility and in the land on which the facility
is located will be sufficient to assure undisturbed use and
possession for the purpose of construction and operation of the
school facility covered in the project during the expected usable
life of such facility.

Access To and Inspection of Project

That representatives of the Commissioner and State Board will have access at all reasonable times to the project wherever it is

in preparation or progress, and the contractor shall provide proper facilities for such access and inspection.

4.37 Compliance with State and Federal Statutes

That all laborers and mechanics employed by contractors and sub-
contractors on all construction projects shall be paid wages at
rates not less than those prevailing as determined by the Secretary
of Labor in accordance with the Davis-Bacon Act (Act of March 3,
1931, P.L. 798 71st Congress, 46 Stat. 1494 as amended, 40 U.S.C.
276-276a-5, and 29 CFR Part 1 (See 29, F.R. 95); and shall receive
overtime compensation in accordance with and subject to the pro-
visions of the Contract Work Hours Standards Act (P.L. 87-581,
76 Stat. 357, 40 U.S.C. 327-332), that such contractors and sub-
contractors shall comply with the provisions of 29 CFR Part 3
(See 29 FR 97), and that all construction contracts and sub-
contracts shall incorporate the contract clauses required by 29
CFR 5.5(a) and (c) (See 29 F.R. 100, 101).

Local Educational Agency

The work-study program shall be administered by the
local educational agency and made reasonably available,
to the extent of available funds to all qualified youths
(See 5.12) in the area served by such agency.

State Board

The State Board will be assured, through supervisory visits,
records and reports, that local educational agencies are
complying with all applicable State and Federal statutes
and regulations.

5.12 Eligible Students

Employment under the work-study program shall be furnished only to a student:
