Therefore, we are requesting a supplemental appropriation of $28,800 to meet the July 1 pay increase for the balance of the year. We believe we can absorb the difference between the $31,000 needed and the $28,800 we are hereby requesting.

AUTHORIZING ADDITIONAL EXPENDITURES BY THE COMMITTEE ON THE JUDICIARY FOR A STUDY OF MATTERS PERTAINING TO CONSTITUTIONAL RIGHTS

Mr. JORDAN of North Carolina, from the Committee on Rules and Administration, submitted the following

REPORT

[To accompany S. Res. 232]

The Committee on Rules and Administration, to which was referred the resolution (S. Res. 232) authorizing additional expenditures by the Committee on the Judiciary for a study of matters pertaining to constitutional rights, having considered the same, reports favorably thereon with amendments and recommends that the resolution as amended be agreed to.

Senate Resolution 232 as referred would increase by $15,000, from $200,000 to $215,000, the limitation on expenditures by the Committee on the Judiciary for the study of matters pertaining to constitutional rights it is currently engaged in pursuant to Senate Resolution 43 of the present Congress.

Senate Resolution 43 as agreed to by the Senate on February 17, 1969, authorized the Committee on the Judiciary, or any duly authorized subcommittee thereof, to expend not to exceed $200,000 from February 1, 1969, through January 31, 1970, to examine, investigate and make a complete study of any and all matters pertaining to constitutional rights.

The additional funds which would be authorized by Senate Resolution 232 are requested by the Committee on the Judiciary to enable it to extend to its subcommittee employees the benefits of the salary increase effective July 1, 1969.

The Committee on Rules and Administration is reporting Senate Resolution 232 with an amendment in the nature of a substitute. This action is taken by the committee upon the advice of the Parliamentarian of the Senate, who has recommended that this new format be

employed for a resolution to increase the limitation of expenditures by a Senate committee for an inquiry or investigation authorized by a prior Senate resolution.

The committee has also amended the title of Senate Resolution 232 to conform to the amended text.

The purposes of Senate Resolution 232 are more fully detailed in a letter from Senator Sam J. Ervin, Jr., chairman of the Subcommittee on Constitutional Rights, to Senator James O. Eastland, chairman of the Committee on the Judiciary, which letter (with accompanying supplemental budget) and letter of transmittal from Senator Eastland to Senator B. Everett Jordan, chairman of the Committee on Rules and Administration, are as follows:

The committee authorized a resolution to provide a supplemental amount of $15,000 for the work of the subcommittee during the period July 1, 1969, to January 31, 1970.

DEAR MR. CHAIRMAN: In view of the newly effective pay raise for legislative employees, I am enclosing a resolution amending Senate Resolution 43, 91st Congress, first session, authorizing the expenditure of funds for the Subcommittee on Constitutional Rights. Based on the present payroll of 14 staff members, it will be necessary to augment the original appropriation of $200,000 by $15,000. This increase in funds would be used for actual salary increases and increased contributions to employees' health benefit programs, civil service retirement fund, and the employees' group life insurance.

Since the pay raise is substantial, the additional money is necessary so that the investigations currently being conducted by the subcommittee will not be seriously hampered.

The subcommittee will appreciate your favorable consideration of the enclosed resolution.
