"(2) In making its recommendations to the Adminis4 trator, the Board shall consider: (A) cost, convenience, 5 and safety of consumer products; (B) environmental im6 pacts of production, use, and disposal of various products 7 and packaging; and (C) the availability of alternatives to 8 current products and packaging.

"(3) The Board's report shall include recommenda10 tions relating to, but not limited to, the following topics: “(A) a labeling system for plastic containers of household goods, and other plastic containers or

packaging, which will identify the plastic resin used to produce the container and facilitate the separation of various plastic containers on the basis of

plastic type by recycling groups, businesses, or individuals; and

"(B) national packaging standards which address the design, composition, volume, reuse, recyclability and degradability and disposal of packages and packaging materials that will further the purposes of this subtitle, when implemented on a

voluntary basis by entities in the packaging industry

and by other commerce.

"(c) EPA ACTION.-Not later than eighteen months

2 after the date of enactment of the Resource Conservation

3 and Recovery Act Amendments of 1991, the Administra4 tor shall publish the report and recommendations of the 5 Product and Packaging Advisory Board.

"(2) The Administrator may, after considering the

7 report and recommendations of the Product and Packag8 ing Advisory Board publish guidelines to: (A) minimize the 9 quantity of packaging material in the waste stream; (B) 10 minimize the consumption of scarce natural resources 11 used in packaging; (C) maximize the recycling and reuse 12 of packaging through the use of labeling and other meth13 ods; (D) reduce litter; and (E) assure that human health 14 and the environment will not be affected adversely as a 15 result of the use and disposal of packaging.".

HAZARDOUS CONSTITUENTS IN PRODUCTS

SEC. 204. Subtitle E of the Solid Waste Disposal Act

18 is amended by adding the following new section:
"HAZARDOUS CONSTITUENTS IN PRODUCTS

"SEC. 5010. (a) INFORMATION COLLECTION.-The 21 Administrator shall determine the extent to which hazard22 ous substances as defined in section 1004(41) are con23 tained in products distributed in commerce. Not later than 24 one year after enactment of the Resource Conservation 25 and Recovery Act Amendments of 1991, the Administra26 tor shall publish and submit to Congress a list which iden

1 tifies products containing hazardous substances which, be2 cause of their toxicity, volume, and exposure pathways 3 may present a risk to human health or the environment 4 when disposed or incinerated. The Administrator shall up5 date this list as necessary and publish and submit to Con6 gress a revised list on an annual basis.

"(b) STANDARDS FOR DISPOSAL OF HAZARDOUS

8 CONSTITUENTS IN PRODUCTS.—(1) The Administrator is 9 authorized to promulgate regulations for the disposal or 10 incineration of products containing hazardous substances 11 listed under subsection (a) of this section as may be neces12 sary to protect human health and the environment from 13 the significant adverse effects resulting from disposal or 14 incineration of such products.

"(2) Not later than six months after the date a prod16 uct is listed pursuant to subsection (a) the Administrator 17 shall determine whether to promulgate regulations under 18 paragraph (1) of this section. If the Administrator deter19 mines that regulation under paragraph (1) will not ade20 quately protect human health and the environment, the 21 Administrator shall establish a schedule, not to exceed 22 twenty-four months for review pursuant to section 6 of 23 the Toxic Substances Control Act to regulate the manufac24 ture and distribution in commerce of products listed pur25 suant to subsection (a).”.

RESEARCH

SEC. 205. Subtitle E of the Solid Waste Disposal Act

3 is amended by adding the following new section:

"RESEARCH

"SEC. 5012. The Administrator is authorized to es

6 tablish at the Hazardous Substance Research Centers op7 erated pursuant to section 311(d) of the Comprehensive 8 Environmental Response, Compensation, and Liability 9 Act, a research program to assist the Agency's Office of 10 Pollution Prevention in performing its functions. The pro11 gram shall include

"(a) basic research into technological barriers limiting toxics use and source reduction and the development of strategies for overcoming these bar

riers;

"(b) basic research into social, economic and institutional barriers to reducing the reliance of society on hazardous substances and the development of strategies for overcoming these barriers;

"(c) developing, evaluating, and demonstrating

toxics use and source reduction methods; and

"(d) research or pilot projects to develop and demonstrate innovative technologies for toxics use

and source reduction methods.".

REGULATORY INCENTIVES

SEC. 206. Subtitle E of the Solid Waste Disposal Act

3 is amended by adding the following new section:

“REGULATORY INCENTIVES

"SEC. 5013. (a) REPORT TO CONGRESS ON REGULA

6 TORY INCENTIVES.-Within twelve months after the date 7 of the enactment of the Resource Conservation and Recov8 ery Act Amendments of 1991, the Administrator shall re9 port to the Congress on the criteria that would be used 10 in establishing a legislative or administrative program of 11 regulatory incentives to promote toxics use and source re12 duction shall evaluate the benefits to human health and 13 the environment that can be achieved from such a pro

14 gram.

"(2) The Administrator shall include in the report an 16 evaluation of options for providing regulatory incentives 17 for toxics use and source reduction including the use of 18 existing authority, if any, to modify permits issued under 19 this Act. In evaluating the benefits of a regulatory incen20 tives program that authorizes permit modifications, the 21 Administrator shall include an identification and assess22 ment of

pected to be achieved under such modified permits,
