CHAPTER 104.

AN ACT to repeal an Act entitled "An Act to incorporate the town of Dunnville in Casey county," being Chapter 694 of Session Acts of 1877-1877, approved March 30, 1878.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That An Act entitled "An Act to incorporate the town of Dunnville, in Casey county," being Chapter 694 of Sessions Acts of 1877-1878, approved March 30, 1878, be and the same is hereby repealed.

Neither approved nor disapproved.

CHAPTER 105.

AN ACT to amend Section 1072 of the Kentucky Statutes, 1915 Edition prepared by the Honorable John D. Carroll, providing for the salary of county judges and county attorneys and the installments in which the same shall be paid.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That Section 1072 of the Kentucky Statutes, 1915 Edition prepared by the Honorable John D. Carroll, be, and the same is, amended by striking from the third line thereof, the word "quarterly" and substituting in lieu thereof the word "monthly"; so that said section as amended will read as follows:

"Section 1072. Salary to be Fixed by Fiscal Court. The county judge and county attorney shall receive an annual salary, to be fixed at a reasonable

amount by the fiscal court, and paid in monthly installments by the county."

CHAPTER 106.

AN ACT to Amend and Re-enact Sections 3374 and 3379 of Kentucky Statutes, Carroll's Edition, 1915.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That Section 3374 of Kentucky Statutes, Carroll's Edition, 1915, be and the same is hereby amended and re-enacted to read as follows:

"All real and personal estate within the city on the date fixed by the City Council or Commissioners in the year in which the assessment shall be made, and of all corporations having their chief office or place of business in the city on said date, and the franchises of same, shall be subject to assessment and taxation for all local and municipal purposes, unless exempt from taxation by the Constitution, and the same shall be assessed at its fair cash value, estimated at the price it would bring at a fair voluntary sale. Any franchise granted, in whole or in part, by a city and exercised within said city, may be taxed by said city, nothwithstanding the corporation owning or exercising same may have its chief office or place of business elsewhere. The City Council or Commissioners shall provide by ordinance or proper order the date as of which property shall be assessed for city purposes.

§ 2. That Section 3379 of Kentucky Statutes, Carroll's Edition, 1915, be and the same is hereby enacted and re-enacted to read as follows:

Acts-16

"All property shall be assessed and valued as of the date fixed by the City Council or Commissioners of each year, and the assessor shall begin his work on that day, or as soon thereafter as practicable, and have the same completed by the first day of January following, and return the same to the common council."

3. All laws and parts of laws in conflict with this act are hereby repealed.

CHAPTER 107.

AN ACT authorizing the Fiscal Court of counties containing a population of over two hundred thousand (200,000) wherein there is located a city of the first class to contract with the Board of Trustees of the Free Public Library of any such city for the purpose of granting to the residents and schools of such county the same privileges afforded by such library to residents and schools of said city and for the purpose of enabling the said Fiscal Court to appropriate a sum of money annually for the maintenance and support of such library pay. able out of the county levy funds in its hands.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That the Fiscal Court of counties containing a population of over two hundred thousand (200,000) and wherein there is located a city of the first class, may in its discretion, contract with the Board of Trustees of the Free Public Library of any such city for the purpose of granting to the residents and schools of such county the same privileges afforded by such library to residents and schools in the said city and the said Fiscal Court is hereby authorized to make such contracts.

The said Fiscal Court may appropriate annually a certain sum of money to the maintenance and support of such library to be payable out of the county levy funds in its hands.

§ 2. The sums mentioned in Section 1 of this Act when appropriated by the said Fiscal Court shall be expended by the Board of Trustees of the Free Public Library, if the latter deems it expedient in the establishment of branch stations in various parts of the county outside of the corporate limits of the said cities of the first class, according to such rules and regulations as the said Board may deem best.

The laws or statutes in conflict with this act are hereby repealed.

$ 4. Whereas it is important to the residents of such counties that they have the library facilities mentioned herein at an early a date as possible, therefore an emergency is declared to exist and this act shall take effect from and after it is approved by the Governor.

CHAPTER 108.

AN ACT providing for the salaries of the deputy commissioners of circuit courts in counties having a population of two hundred thousand inhabitants or more, and repealing all laws, or parts of laws, in conflict herewith.

"Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That the salaries of the deputy commissioners of circuit courts in counties having a population of two hundred thousand inhabitants, or more, comprising a separate judicial district and having six circuit judges, or more, are hereby fixed as follows:

The salary of the chief deputy commissioner shall not exceed the sum of $2,500.00 and the salary of each other deputy commissioner shall not exceed the sum of $2,000.00 per annum, said salaries to be fixed by the said circuit court in General Term. Said salaries to be paid out of the fees of the said office as now provided by law.

All laws or parts of laws in conflict herewith are hereby repealed.

CHAPTER 109.

AN ACT to amend and re-enact "Section 3813 (19) Kentucky Statutes, Carroll's Edition 1915 relating to salaries of officers and guards of the penitentiaries of the Commonwealth."

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

(2.) That Section 3813 (19) of the Kentucky Statutes, Carroll's Edition 1915 be amended and re-enacted so that when amended and re-enacted shall read as follows:

"The salaries of the wardens, deputy wardens, physicians, chaplains and the wages of the guards shall be paid monthly out of the State Treasury, and the Auditor of Public Accounts shall draw his warrant upon the treasury therefor, in favor of each of said officials, upon the written order of the chairman of the commissioners, and they shall respectively receive the following salaries, to-wit: The warden, two thousand dollars per annum; the deputy warden, one thousand two hundred dollars per annum; the physician, one thousand two hundred dollars per annum; the clerk, one thousand two hun
