SEC. 2. The Energy Supply and Environmental Co

2 ordination Act of 1974 is amended by inserting “TITLE I— 3 ENERGY SUPPLY AND ENVIRONMENTAL CO4 ORDINATION ACT" before "SECTION 1. SHORT TITLE:

5 PURPOSE." and by adding at the end of title I the following new titles:

"SHORT TITLE

"SEC. 201. This title may be cited as the 'Natural Gas

11 and Petroleum Conservation Act.

"FINDINGS AND PURPOSES

"SEC. 202. FINDINGS.-(a) (1) The Congress finds

14 that the protection of public welfare and the preservation of

15 national security require

16

"(A) the furtherance of national energy self-sufficiency consistent with applicable environmental require

ments;

(B) the capability to use indigenous energy resources of the United States in lieu of imported energy

21 supplies by the substitution of coal and other fuels for

natural gas and petroleum products as the primary en

ergy source for new electric powerplants and new major fuel-burning installations and, to the extent practicable,

for existing powerplants and existing major fuel-burning installations; and

"(C) the conservation of natural gas and petroleum

for uses other than the generation of electricity or boiler

fuel, for which uses there are no feasible alternative. fuels or raw material substitutes.

"(2) The Congress finds that any electric powerplant 8 or any major fuel-burning installation shall be deemed in 9 compliance with the purposes of this title if such power10 plant or installation has the capability to use coal and utilizes 11 coal as its primary energy source in conformance with ap12 plicable environmental requirements.

"(b) PURPOSES.-The purposes of this Act are

"(1) to foster the greater use of coal resources in lieu of natural gas and petroleum as the primary energy source utilized by electric powerplants and major fuel-burning installations;

"(2) to require that any new electric powerplant and any new major fuel-burning installation which purposes to utilize fossil energy resources as its primary energy source shall be constructed with the capability to use coal or other fuel than natural gas or petroleum except in those circumstances provided for herein;

"(3) to require that by January 1, 1979, any exist

ing electric powerplant and any existing major fuel-burn

ing installation with the capability to use coal or other fuel than natural gas or petroleum as its primary energy source shall utilize such fuel except in those circumstances provided for herein;

"(4) to require that by January 1, 1979, any exist6 ing electric powerplant and any existing major fuelburning installation which utilizes natural gas as its pri8 mary energy source shall acquire the capability to utilize and shall utilize other than natural gas except in circum

stances provided for herein; and

"(5) to require the improvement or modernization of any existing electric powerplant and any existing major fuel-burning installation, which utilizes natural gas or petroleum as its primary energy source and cannot be converted to coal utilization in order to conserve

natural gas and petroleum.

"DEFINITIONS

"SEC. 203. For the purposes of this title:

"(a) The term 'Administrator' means the Administrator of the Federal Energy Administration established by the 21 Federal Energy Administration Act of 1974; except that 22 if such Administration ceases to exist such term means any 23 officer of the United States designated as Federal Energy 24 Administrator by the President for the purposes of this title. "(b) The term 'person' includes any person or indi

1 vidual; (2) any corporation, company, partnership, asso2 ciation, firm, society, trust, joint venture, or joint stock com3 pany; (3) the Federal Government, including corporations, 4 departments, Federal agencies, and other instrumentalities; 5 and (4) any State or political subdivision thereof, including 6 the District of Columbia, or other government entity, which 7 owns, leases, operates, or controls any electric powerplant or major fuel-burning installation subject to the provisions 9 of this title.

"(c) The term 'natural gas' includes (1) dry natural 11 gas and casing-head gas; (2) synthetic gas derived from 12 natural gas liquids; and (3) synthetic gas derived from 13 coal, but does not include synthetic gas derived from coal 14 where such synthetic gas is produced by a person for use by 15 an electric powerplant or a major fuel-burning installation. 16 regulated pursuant to sections 204 and 205 of this title. 17 "(d) The term 'petroleum' includes crude oil, residual 18 fuel oil, refined petroleum products, liquid petroleum gas, 19 and synthetic gas derived from petroleum, but does not in20 clude process waste gases, carbon monoxide, and waste gases 21 and other liquid and solid byproducts of refinery operations 22 within the United States, which have no commercial 23 significance.

"(c) The term 'coal or other fuel' means coal and any

25 fuel other than natural gas or petroleum, including, without

1 limitation, (1) coal derivatives, including (A) synthetic 2 liquid or solid fuels which are derived from coal, (B) low 3 British thermal units synthetic gas derived from coal, and 4 (C) synthetic gas derived from coal where such gas is pro5 duced by a person for use by an electric powerplant or a 6 major fuel-burning installation regulated by sections 204 and 7 205 of this title; (2) petroleum coke; (3) combustible muS nicipal, industrial, or agricultural solid wastes; and (4) 9 wood or other bio-mass, but does not include coal derivatives 10 where such derivatives are produced by a person for the 11 primary purpose of use as other than a fuel.

"(f) The term 'electric powerplant' means a fossil fuel 13 fired electric generating unit, including a gas turbine unit

or a combined cycle unit, that is by design capable of being 15 operated at a fuel heat input of one hundred million British 16 thermal units per hour or greater, or a combination of more 17 than one such units at the same site which in the aggre18 gate is by design capable of being operated at a fuel heat 19 input of two hundred and fifty million British thermal units 20 per hour or greater, that produce electric power for the pur21 poses of sale or exchange: Provided, however, That the 22 Administrator may include in the definition of electric power23 plant any such electric powerplant or a combination of more 24 than one such unit, which is by design capable of being oper25 ated at lower fuel heat inputs where the Administrator finds
