CHAPTER 5.

AN ACT PROVIDING FOR THE CLEANLINESS OF TOWNS AND VILLAGES NOT INCORPORATED WITHIN THE STATE OF NEW MEXICO.

Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. That it shall be illegal for any person or persons in any town or village not incorporated, within the State of New Mexico, which shall have over three hundred inhabitants, within a circumference of two miles, to empty any garbage, or filth or dead animals within the limits of the said town or village, not incorporated, on its streets, alleys or public roads, within said towns or villages. Any person found breaking the provisions of this act shall be fined by a justice of the peace in the sum of Five ($5.00) Dollars, and five days in the county jail, subject to hard work, for each and every time the offense is committed, and he shall also be subject to remove the garbage, filth, or dead animals within the term of six hours, from the date of notice to remove the same.

SEC. 2. That on a petition of at least fifty per cent of the legal voters, within the said towns or villages not incorporated within the State of New Mexico, the justice of the peace shall have the power to name a day in which every male, able bodied, over the age of eighteen years, shall work one day to clean and fix the streets, alleys and public roads within the limits of said town or village not incorporated within the State of New Mexico.

SEC. 3. That every able bodied male over the age of eighteen years shall be subject to give one day's work, or one dollar in cash, to keep the cleanliness of said towns or villages not incorporated, within the State of New Mexico, having over three hundred inhabitants, in conformity with Section 2 of this Act.

SEC. 4. That the justice of the peace at said town or village, shall be allowed the sum of Five Dollars to notify and attend and direct the day assigned for such work, which shall be only one day each year, which said sum shall come out of the fines, and moneys collected by him, and the balance shall go to the credit of the school district where such offenses have been com mitted.

SEC. 5. If any justice of the peace, to whom shall be presented a petition, signed by not less than twenty-five per cent of the legal voters within the limits of such town or village, petitioning him that the same be cleaned, should refuse to pay attention to such petition, he shall be guilty of a misdemeanor, and upon conviction thereof, he shall be fined in a sum of not

less than Ten ($10.00) Dollars, nor more than Twenty-five ($25.00) Dollars, or twenty days in the county jail, subject to hard work.

CHAPTER 6.

AN ACT TO AMEND SECTION 336, CODE 1915, BY INCREASING THE AMOUNT OF THE FEE FOR ADMISSION TO THE BAR OF NEW MEXICO.

H. B. No. 15 (as amended); Approved February 25, 1919. Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. That section 336, Code 1915, be and the same is hereby amended so as to read as follows:

"SEC. 336. The said board shall receive from each person applying for examination or admission on certificate the sum of twenty-five dollars. All fees received by said Board shall be deposited with the treasurer thereof and applied towards the expenses of said Board and the compensation of its members.

SEC. 2. All acts and parts of acts in conflict herewith are hereby repealed.

CHAPTER 7.

AN ACT CONFERRING ADDITIONAL POWERS ON VILLAGES HAVING A POPULATION OF FIVE HUNDRED OR MORE.

S. C. S. for S. B. No. 24; Approved Feb. 25, 1919. Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. Wherever the Board of Trustees of any incorporated village shall by resolution, elect so to do it, may cause a census to be taken of the inhabitants of such village actually residing therein, and if such census shall disclose that the actual residents of such village are 500 or more in number, such village shall thereafter have and possess all the powers and privileges by law granted to incorporated towns.

SEC. 2. Any return or record of census taken under the provisions of this act shall be verified by the oath of the person or persons taking the same, and shall be taken in duplicate and approved by a resolution of the Board of Trustees, and one copy thereof shall be filed and preserved in the office of the County

Clerk of the County in which such village is situate, and the other copy thereof shall be preserved in the records of the village.

SEC. 3. That it is necessary for the preservation of the public peace and safety of the inhabitants of the State of New Mexico, that the provisions of this act shall become effective at the earliest possible time, therefore an emergency is hereby declared to exist and this act shall take effect and be in full force and effect from and after its passage and approval.

CHAPTER 8.

AN ACT TO AMEND PARAGRAPH 3252 OF THE CODIFICATION OF 1915, RELATING TO THE JURISDICTION OF JUSTICES OF THE PEACE IN REPLEVIN SUITS.

Be It Enacted by the Legislature of the State of New Mexico: SECTION 1. That Paragraph 3252 of the Codification of 1915 be amended to read as follows:

"Section 3252." Right of action.

Sec. 98. Whenever any goods or chattels are wrongfully taken or detained, the value of which shall not exceed two hundred dollars, an action of replevin may be brought by the person having a right to the immediate possession, for the recovery thereof and the damages sustained by reason of the unjust capture or detention, as hereinafter specified in this article.

CHAPTER 9.

AN ACT FIXING THE TIME FOR HOLDING THE TERMS OF THE DISTRICT COURT OF THE SEVENTH JUDICIAL DISTRICT, IN AND FOR THE COUNTY OF SIERRA, STATE OF NEW MEXICO.

Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. That the regular terms of the District Court of the County of Sierra, Seventh Judicial District of the State of New Mexico, shall hereafter be held and commenced as follows: At the county seat of said County of Sierra on the first Monday of February and the first Monday of August of each

year.

SEC. 2. Every summons, subpoena, writ, venire, or other process whatever, which has been or may be issued by, or any bond or recognizance which has been or may be filed in the said District Court for said county, returnable to a regular term of said court, as now fixed by law, shall be returnable at the times and place designated in Section 1 of this act, and shall have the same force and effect as if made returnable at the times and place mentioned in said section 1 of this act.

SEC. 3. That it is necessary for the preservation of the public peace and safety of the inhabitants of the State of New Mexico that the provisions of this act shall become effective at the earliest possible time, and therefore an emergency is hereby declared to exist, and this act shall take effect and be in full force and effect from and after its passage and approval.

CHAPTER 10.

AN ACT TO PROVIDE FOR THE GIVING OF BOND BY COUNTY CLERKS, AND TO AMEND SECTION 1441, CODIFICATION OF 1915.

Be It Enacted by the Legislature of the State of New Mexico: SECTION 1. That section 1441 of the Codification of 1915 be and it is hereby amended so as to read as follows:

1441. COUNTY CLERK—BOND.

Sec. 87. The County Clerk of each county shall, before entering upon the duties of his office and within ten days after the first day of January following his election, execute a bond to the State of New Mexico, in the penal sum of ten thousand dollars, with sufficient sureties, to be approved by the judge of the district court of said county, conditioned that he will well and faithfully perform all of his duties as such county clerk during his term of office.

SEC. 2. This act shall not be construed so as to require the giving of a new bond by any county clerk now in office who has qualified, before the passage hereof, under the provisions of the section hereby amended.

CHAPTER 11.

AN ACT TO CREATE THE COUNTY OF HIDALGO AND PROVIDE FOR THE GOVERNMENT THEREOF.

H. Comm. Sub. for H. B. No. 73; Approved February 25, 1919. Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. That the County of Hidalgo is hereby created out of that portion of the State of New Mexico, lying and situate within the following boundaries:

Beginning at the Northeast (NE) corner of Section 24 in Township 28 South of Range 14 West of the New Mexico principal meridian, and running thence westwardly along the northerly boundary lines of sections 24, 23, 22, 21, 20 and 19 of said Township 28, South of Range 14 West, and along the northerly boundary lines of sections 24, 23, 22, 21, 20 and 19 of Township 28 South of Range 15 West, and along the northerly boundary lines of Sections 24, 23, 22, 21, 20 and 19 of Township 28 South of Range 16 West to the Southwest (SW) corner of Section 18 of Township 28 South of Range 16 West; thence northwardly upon the line between Ranges 16 West and 17 West to the fifth standard parallel south and thence along the said fifth standard parallel south to the point where the line between Ranges 16 and 17 West, north of said fifth standard parallel south intersects the same and thence northwardly along said line between Ranges 16 West and 17 West to the Northeast (NE) corner of Township 21 South of Range 17 West; thence westwardly along the line between Townships 20 South and 21 South to the Southwest (SW) corner of Township 20 South of Range 17 West, thence northwardly along the line between Ranges 17 West and 18 West to the Northeast (NE) corner of Township 20 South of Range 18 West; thence westwardly along the line between Townships 19 South and 20 South to the Southwest (SW) corner of Township 19 South of Range 19 West; thence northwardly along the line between Ranges 19 West and 20 West to the Northeast (NE) corner of Township 18 South of Range 20 West; thence westwardly along the line between Townships 17 South and 18 South to the point where the same intersects the boundary line between the States of New Mexico and Arizona; thence southwardly along said boundary line between the States of New Mexico and Arizona to the point where the same intersects the boundary line between the United States of America and the Republic of Mexico; thence eastwardly along said boundary line
