river with its railroad line. Said bridges shall be constructed to provide for the p sage of railway trains, and, at the option of said company, may be used for the p sage of wagons and vehicles of all kinds, for the transit of animals, and for foot-pa gers, for such reasonable rates of toll as may be approved from time to time by Secretary of War. That if the said bridges, or either of them, over the said rives shall be made with unbroken and continuous spans, there shall be at least one of a height of not less than eighty feet above low water or fifty feet above bigin water, as understood at the point of location, measured to the lowest part of the spe structure of said bridge; and said span shall have a clear opening of at least in hundred feet between the piers, measured at right angles to the current, and shal over the main channel of the river, and the bridge or bridges shall be at right angs to, and the piers parallel with, the current of the river. And if the bridges, or eithe of them, over the said rivers, shall be constructed as draw or pivot bridges, the da or pivot pier shall be over the main channel of the river at an accessible navigale point, and the openings on each side of the pivot-pier shall not be less than one lo dred and thirty feet in the clear, unless otherwise expressly directed by the Secret” of War, and if so directed shall be according to such direction, and, as nearly a practicable, the said openings shall be accessible at all stages of water, and the sa shall be not less than ten feet above extreme high water, as understood at the per of location, to the lowest part of the superstructure of the bridge, and the piers L draw rests shall be parallel with, and the bridge or bridges at right angles te current of the river or rivers; and no riprap or other outside protection for imper foundations shall be permitted to approach nearer than four feet to the surface of 2 water at its extreme low stage, or otherwise to encroach upon the channel-way vided for in this act; and all and each of said draws shall be opened promptly reasonable signal for the passing of boats; and said company shall maintain, a own expense, from sunset to sunrise, such lights or other signals on said bridge the Light-House Board may prescribe.

SEC. 2. That any bridge built under this act, and subject to its limitations, sha? a lawful structure, and shall be recognized and known as a post-route, upon also no higher charge shall be made for the transmission over the same of the a the troops, and the munitions of war of the United States than the rate per mile. for the transportation over the railroad or public highways leading to the said bri and it shall enjoy the rights and privileges of other post-roads in the United State SEC. 3. That no bridge shall be erected or maintained under the authority of act which shall at any time substantially or materially obstruct the free navig of said rivers; and if any bridge erected under such authority shall, in the op of the Secretary of War, obstruct such navigation, he is hereby authorized to such change or alteration of said bridge or bridges to be made as will effectually viate such obstruction; and all such alterations shall be made and all such obstr tions be removed at the expense of the owner or owners of said bridge. And in of any litigation arising from any obstruction or alleged obstruction to the free 23 gation of said river, caused or alleged to be caused by said bridge, the case ma Drought in the district court of the United States for the State of Arkansas in w jurisdiction any portion of said obstruction or bridge may be located: Provided, T. nothing in this act shall be so construed as to repeal or modify any of the provis of law now existing in reference to the protection of the navigation of rivers @ exempt said bridges from the operation of the same.

SEC. 4. That all railway companies desiring the use of said bridges, or either of th shall have and be entitled to equal rights and privileges relative to the passage of " way trains over the same, and over the approaches thereto, upon payment of a sonable compensation for such use.

SEC. 5. That the bridges authorized to be constructed under this act shall be h and located under and subject to such regulations for the security of navigati said rivers as the Secretary of War shall prescribe; and to secure that object the company or corporation shall submit to the Secretary of War, for his examination approval, a design and drawings of said bridges, and each of them, and a map of! location, giving, for the space of one mile above and one mile below the propose cation, the topography of the banks of the river, the shore-lines at high and low wi the direction and strength of the currents at all stages, and the soundings, accura showing the bed of the stream, the location of any other bridge or bridges, and furnish such other information as may be required for a full and satisfactory standing of the subject; and until the said plan and location of the bridge or brid are approved by the Secretary of War the bridge or bridges shall not be built : F should any change be made in the plan of said bridges, or either of them, during progress of construction, such change shall be subject to approval of the Secretar War; and the said structures shall be changed at the cost and expense of the ow thereof, from time to time, as the Secretary of War may direct, so as to preserve free and convenient navigation of said rivers; and the authority to erect and cout any and all of said bridges shall be subject to revocation by the Secretary of War whe ever the public good, in his judgment, so requires.

EC. 6. That the right to alter, amend, or repeal this act is hereby expressly reved.

EC. 7. That this act shall be null and void if actual construction of the bridge or lges herein authorized be not commenced within one year and completed within ee years from the approval of this act.

I ACT to authorize the city of Chicago to erect a crib in Lake Michigan for water-works purposes.

Be it enacted by the Senate and House of Representatives of the United States of America Congress assembled, That the consent of Congress is hereby given to the city of icago, county of Cook, State of Illinois, to extend a tunnel, or inlet pipes, into Lake chigan, so far as may be deemed necessary, to insure a supply of pure water and erect a pier or piers and crib in the navigable waters of said lake, for the making, eserving and working of said aqueducts or pipes or tunnel, the plan and location ereof to be subject to the approval of the Secretary of War: Provided, That said ty shall furnish and maintain at its own expense, such beacon-lights or other signals such piers or crib, as the Light-House Board shall prescribe. Approved, May 9, 1888.

IN ACT to amend an act to authorize the construction of a bridge across the Eastern Branch of the Potomac River at the foot of Pennsylvania avenue east.

Be it enacted by the Senate and House of Representatives of the United States of America n Congress assembled, That the Secretary of War be, and he is hereby, authorized in is discretion to make such alterations in the plan of the bridge across the Eastern Branch of the Potomac River at the foot of Pennsylvania avenue east as will best accommodate the traffic over and under said bridge, and for said purpose the sum of Sixty thousand dollars, or so much thereof as may be necessary, to be immediately available, be, and the same is hereby, appropriated, out of any money in the Treasury not otherwise appropriated: Provided, That the Baltimore and Potomac Railroad Company pay their fair and just proportion of the cost of said alteration at the west end of said bridge, to be determined by the Secretary of War: Provided further, That one half of the sum hereby appropriated shall be paid out of the revenues of the District of Columbia.

AN ACT to authorize the Batesville and Brinkley Railroad to build a bridge across the Black River in Arkansas.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Batesville and Brinkley Railroad Company, a corporation created and existing under the laws of Arkansas, be, and is hereby, authorized to erect and maintain a bridge across the Black River, in township twelve north, range three west, or at such point near said township as shall be selected by said railroad company for crossing said river with their railroad line, the said bridge to have a draw-span, so as not to interfere with the navigation of said river: Provided, That any bridge, constructed under this act and according to its limitations, shall be a lawful structure, and shall be known and recognized as a post-route, and the same is hereby declared to be a post-route, upon which also no higher charge shall be made for the transmission over the same of the mails, the troops, and muuitions of war of the United States, or for through passengers or freight passing over said bridge, than the rate per mile paid for their transportation over the railroads leading to the said bridge, and equal privileges in the use of said bridge shall be granted to all telegraph companies; and the United States shall have the right of way across said bridge and its approaches for postal-telegraph purposes.

SEC. 2. That the plan and location of said bridge, with a detailed map of the river at the proposed site of the bridge and near thereto, exhibiting the depths and currents, shall be submitted to the Secretary of War for his approval, and until he approves the plans and location of said bridge it shall not be built; but upon the approval of said plan by the Secretary of War the said company or corporation may proceed to the erection of said bridge in conformity with said approved plan, and should any change be made in the plan of said bridge during the progress of the work thereon, such change shall be subject likewise to the approval of the Secretary of War. And there shall be displayed on said bridge from sunset to sunrise such lights or other signals as may be prescribed by the Light-House Board.

SEC. 3. That Congress reserves the right to alter, amend, or repeal this act at any

time; and that if at any time navigation of said river shall in any manner be ob structed or impaired by the said bridge, the Secretary of War shall have authoring, and it shall be his duty, to require the said railroad company to alter and change the said bridge, at its own expense, in such manner as may be proper to secure free and complete navigation without impediment; and if upon reasonable notice to saul railroad company to make such changes or improvements the said company fails to do so, the Secretary of War shall have authority to make the same at the expenses said company, and all the rights conferred by this act shall be forfeited; and Ce gress shall have power to do any and all things necessary to secure the free navigat of the said river.

SEC. 4. That this act shall be null and void if actual construction of the bries herein authorized be not commenced within one year, and completed within the years from the date thereof.

AN ACT to authorize the construction of the Ohio Connecting Railway Company Bridge. Be it enacted by the Senate and House of Representatives of the United States of Amera in Congress assembled, That the Ohio Connecting Railway Company be, and the same is hereby, authorized to construct, maintain, and operate a bridge over the Ol River from the south shore to the north shore thereof, at a point about one-half m south of the mouth of Cork's Run in Allegheny County, Pennsylvania. Said bring is hereby declared to be a lawful structure, and the same may be used for railroad an highway purposes. Said bridge to be constructed as follows: The main-channel sp of said bridge shall be a continuous through span of five hundred and seven feet char of masonry. The back-channel span shall be one through span of four hundred t clear of masonry; said space in each case to be measured on the low-water line. T remaining spans of said bridge shall be deck-spans. Said main-channel span and said back-channel shall be at a height of not less than eighty feet above low-wat mark at Market street in Pittsburgh and not less than eighty-two and one-half f above local low-water mark at the bridge site, measured to the bottom chord of the bridge.

SEC. 2. The location of the piers of said bridge with reference to the current of the river shall be according to such plans and specifications as may be approved by the War Department: Provided, That no advertisement as required by the general law » again made, unless thought advisable and necessary by the Secretary of War, adver tisement having already been made.

SEC. 3. That equal privileges in the use of said bridge shall be granted to all ter graph and telephone companies.

SEC. 4. That all railroad companies desiring the use of said bridge shall have an be entitled to equal rights and privileges relative to the passage of railway trains cars over the same, and over the approaches thereto, upon payment of a reasona compensation for such use, and in case the owner or owners of said bridge and th several railroad companies, or any one of them, desiring such use shall fail to agre upon the sum or sums to be paid and upon rules and upon conditions to which est. shall conform in using said bridge, all matters at issue between them shall be decide by the Secretary of War, upon a hearing of the allegations and proofs of the parts SEC. 5. That said bridge shall be constructed to provide for the passage of railwa trains and, at the option of the corporation by which it may be built, may be used f the passage of wagons and vehicles of all kinds, for the transit of animals, and for for passengers, for such reasonable rates of toll as may be approved, from time to tim by the Secretary of War.

SEC. 6. That the said bridge shall be built under the provisions of the act of sever teenth December, eighteen hundred and seventy-two, and authorizing the construc tion of bridges across the Ohio River and the amendatory act of fourteenth February eighteen hundred and seventy-three, except in so far as the provisions of said aci may be modified or changed by the provisions of this act: Provided, That if the cu struction of said bridge shall not be commenced within one year, and complete within four years after the passage of this act, all privileges conferred hereby, ab this act, shall become null and void.

SEC. 7. That Congress shall have power at any time to alter, amend or repeal this art Approved, May 14, 1888.

AN ACT to authorize the Tennessee Midland Railway Company to construct a bridge across the Te nessee River at any point on the line between the counties of Decatur and Perry, in the State Tennessee, it may deem acceptable.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Tennessee Midland Railway Company, a corporation

ated and organized under the laws of the State of Tennessee, be, and is hereby, horized to construct and maintain, for the purpose of running railway trains, a dge and approaches thereto, over the Tennessee River, at any point on the line beeen the counties of Decatur and Perry, in the State of Tennessee, which said comay may deem most acceptable.

SEC. 2. That any bridge built under this act and subject to its limitations shall be awful structure, and shall be recognized and known as a post-route, upon which no gher charge shall be made for the transmissions over the same of the mails, troops, d the munitions of war of the United States passing over said bridge than the rate r mile paid for the transportation over the railroad leading to said bridge; and it all enjoy the rights and privileges of other post roads in the United States. And ual privileges in the use of said bridge shall be granted to all telegraph companies; d the United States shall have the right of way across said bridge and its approaches r postal telegraph purposes.

SEC. 3. That the bridge built under this act shall be constructed as a pivot drawidge, with a draw over the main channel of the river at an accessible and the best vigable point and with spans of not less than one hundred and sixty feet in length the clear on each side of the central or pivot pier of the draw, and said span shall > not less than ten feet above extreme high-water mark, measuring to the lowest art of the superstructure of the bridge, and the piers of said bridge shall be parallel and the bridge itself at right angles to the current of the river at the average stage water where said bridge may be erected: Provided, also, That in said bridge there hall be one span of not less than three hundred feet in length in the clear. SEC. 4. That said draw shall be opened promptly by said company upon reasonable gnal for the passage of boats or vessels; and said corporation shall maintain, at its wn expense, from sunset to sunrise, such lights or other signals as the Light-House oard shall prescribe, and no bridge shall be erected or maintained under the authory of this act which shall at any time substantially or materially obstruct the free avigation of the river, and if any bridge erected under such authority shall, in the pinion of the Secretary of War, obstruct such navigation, he is hereby authorized to ause such change or alteration of said bridge to be made as will effectually obviate uch obstruction; and all such alterations shall be made and all such obstructions be emoved at the expense of the owner or owners of said bridge. And in case of any itigation arising from any obstruction or alleged obstruction to the free navigation of said river, caused or alleged to be caused by said bridge, the case shall be brought n the district court of the United States of the State of Tennessee in whose jurisdicion any portion of said obstruction or bridge may be located.

SEC. 5. That any bridge authorized to be constructed under this act shall be built and located under and subject to such regulations for the security of navigation of said river as the Secretary of War may prescribe; and to secure that object the said company or corporation shall submit to the Secretary of War, for his examination and pproval, a design and drawing of the bridge, and a map of the location, giving, for he space of one mile above and one mile below the proposed location, the topography of the banks of the river, the shore-lines at high and low water, the direction and strength of the currents at all stages, and the soundings, accurately showing the bed of the stream, and shall furnish such other information as may be required for a full and satisfactory understanding of the subject; and until said plan and location of the bridge are approved by the Secretary of War the bridge shall not be built; and should any change be made in the plan of said bridge during the progress of construction, such change shall be subject to the approval of the Secretary of War.

SEC. 6. SEC. 7. That the right to alter, amend, or repeal this act is hereby expressly reserved without any liability of the United States on account of the alteration, amendment, or repeal of this act.

SEC. 8. That this act shall be null and void if actual construction of the bridge herein authorized be not commenced within one year and completed within three years from the date of approval of this act.

AN ACT to authorize the building of a railroad bridge at Little Rock, Arkansas.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That it shall be lawful for the Little Rock Bridge and Terminal

Railroad Company, a corporation organized under the laws of the State of Arkansas to construct and maintain a bridge, and approaches thereto, over the Arkansas River. at a point on said river at or near the city of Little Rock, in the State of Arkansas, and to lay on and over said bridge a railroad track or tracks for the more perfect em nection of any railroad or railroads that are or shall hereafter be constructed to the said river, on either or both sides thereof, at or opposite said point, under the limitetions and conditions hereinafter provided; said bridge shall be constructed to provis for the passage of railway trains, and at the option of the builders and ownes thereof, may be used for the passage of wagons and vehicles of all kinds, for the transit of animals of all kinds, and for foot-passengers for such reasonable rates of t as may be approved, from time to time, by the Secretary of War as to railway trains and as to wagons, vehicles, animals, and foot-passengers, such rates as may be pr vided by the laws of Arkansas.

SEC. 2. That any bridge built under this act is subject to its limitations, shall bea lawful structure, and shall be recognized and known as a post-route, upon which als no higher charge shall be made for the transmission over the same of the mails, troop and the munitions of war, or other property of the United States, than the rate per mile paid for the transportation of the same over the railroads or public highway leading to the said bridge, and it shall enjoy the rights and privileges of other postroads in the United States. Equal privileges in the use of said bridge shall be granted to all telegraph companies; and the United States shall have the right of way acr said bridge and its approaches for postal telegraph purposes.

SEC. 3. That the said bridge shall be constructed with a draw or pivot span whe shall be over the main channel of the river at an accessible navigable point, and th openings on each side of the pivot pier shall not be less than one hundred and say feet in the clear, and, as nearly as practicable, both of said openings shall be actres ble at all stages of water; that the spans be not less than ten feet above extres high-water mark, as understood at the point of location, to the lowest point of th superstructure of said bridge; that the piers and draw rests of said bridge shall! built parallel with the current at that stage of the river which is most important fa navigation, and the bridge of itself at right angles thereto; and that no riprap a other outside protection for imperfect foundations be permitted to approach nea than four feet to the surface of the water at its extreme low stage, or otherwise encroach upon the channel-ways provided for in this act: Provided, That said draw shall be opened by the company or persons owning said bridge upon reasonable sig for the passage of boats; and there shall be maintained, at the expense of the owner thereof, from sunset to sunrise, such lights or other signals on said bridge as the Light-House Board shall prescribe.

SEC. 4. That all railroad companies desiring the use of said bridge shall have, be entitled to, equal rights and privileges relative to the passage of railway train over the same, and over the approaches to the same, upon payment of a reasona compensation for such use; and in case the owner or owners of said bridge, and several railroad companies, or any of them, desiring such use, shall fail to agree t the sum or sums to be paid, and upon rules and condition which each shall perfer in using said bridge, all matters at issue between them shall be decided by the S retary of War upon hearing of the allegations and proofs of the parties.

SEC. 5. SEC. 6. That the right to alter, amend, or repeal this act is hereby expressly served, and the right to require any changes in said structure, or its entire remova at the expense of the owners thereof, whenever the Congress shall decide that the public interest requires it, is also expressly reserved.

SEC. 7. That this act shall be null and void if actual construction of the bridg herein authorized be not commenced within one year and completed within thre years from the date thereof.
