Santa Fe on a strip of land which is a part of the main line right-of-way the railroad obtained under the act of 1875.

I am opposed to this bill and I hope your committee will not favorably report it. My relations with the Santa Fe have always been very satisfactory. I have helped their business and they have helped mine. I would certainly prefer to continue to lease from the railroad than to have to deal with the Government under terms of a lease or a possible purchase of the piece of land my company occupies, with the prospect of possibly losing it altogether, or having to pay a price set on it by somebody in Washington in order to keep it.

From the Government's standpoint, why would it want to have the responsibility for thousands of isolated little pieces of land, having nothing to do with any Government program scattered along most of the railroads in the West? The accumulation of redtape involved in the endless process of notices, hearings, forfeitures, advertising bids, leasings, and sales which would result from H.R. 3229 would be more of a headache than a help to the businesses which lease from the railroads and which, like mine, must have these tracts for their operations. This would certainly be another blow to the hardpressed railroads, and would probably cost the public treasury more than could ever be realized from the program.

The bill proposed last year by the Department of the Interior simply authorizing railroads to convey to adjacent land owners purchases of their Government granted right-of-way not needed for the actual transportation process, makes much more sense to me and is all that is needed to clear up whatever problems exist in connection with these leases.

Respectfully,

HON. WAYNE N. ASPINALL,

EARL J. BRUBAKER, President.

WESTERN SALES OFFICE,
Lamar, Colo., May 2, 1961.

Chairman, the House Committee on Interior and Insular Affairs
Washington, D.C.

DEAR SIR: I have recently read your proposal bill H.R. 3229. We are very unhappy with the thought of such a bill being enacted. For a good many years we have had a good many railroad leases and have built elevators on same. We have never as yet had any trouble with any of the railroad companies concerning any of the leases. We would certainly hate to be forced to deal with the Government redtape instead of the railroads.

We would see no objection to a bill such as was proposed by the Department of Interior at your last session.

Sincerely,

HON. WAYNE ASPINALL,

HAROLD D. WEBSTER.

Chairman of the House Committee,
Interior and Insular Affairs, Washington, D.C.

DEAR SIR: I understand that House bills H.R. 3229 and H.R. 3346 among other things provide that Government grant railroad right-of-way shall revert back to the U.S. Government where lessee has occupied ground in excess of 6 years. Respectfully ask that you please oppose these bills, as it is felt that this property rightfully belongs to the railroads now, after all the improvements made by them to the property, in addition to the large investments made to provide service to those areas.
