DEAR MR. BAUSER: My letter of January 13, 1971, informed the Joint Committee of plans to hold a meeting with representatives of state agencies on February 11, 1971, to discuss the Commission's implementation of the National Environmental Policy Act and the amendments to 10 CFR 20 and 10 CFR 50 for assuring that licensees keep exposures to radiation and releases of radioactivity in effluents as low as practicable.

We have since identified some additional agencies which we believe appropriately should be invited. It has also become apparent that some states will have several additional agencies which may request to be represented. In the circumstances, we have decided to hold two meetings in lieu of one, in order to keep the size of each meeting to a practicable level. We are scheduling the second meeting for February 18,

1971.

DEAR MR. BAUSER: As you are aware, in December the Commission adopted a revised statement of general policy in implementation of the National Environmental Policy Act (NEPA) in its regulatory program, which provided for much fuller consideration than in the past of the whole range of nonnuclear environmental issues in the licensing of nuclear power plants and fuel reprocessing facilities.

During the past year the responsibilities of implementing NEPA have been assigned to the Divisions of Reactor Licensing and Materials Licensing, with the overall coordination being provided by my office. With the issuance of our December statement, and as the program has developed, it has become apparent that a more permanent organizational arrangement will be necessary if we are to effectively implement the Act in an expeditious manner; accordingly, we are consolidating the principal responsibilities for the implementation of NEPA within one division. This division, which will be called the Division of Radiological and Environmental Protection, will assume the functions of the present Division of Radiation Protection Standards.

The new division, under the direction of Mr. Lester R. Rogers, will have the primary responsibility for (1) administering the regulations implementing NEPA requirements for AEC-licensed activities, and (2) developing rules and regulations implementing radiation protection standards and guides issued by the Environmental Protection Agency for the protection of employees and the public from exposures to radioactive material and radiation resulting from AEC-licensed activities.

The division's responsibilities with respect to implementation of NEPA will be under the direction of Mr. Gene A. Blanc, who will join the regulatory staff on February 1 as Assistant Director for Envinronmental Protection. Mr. Blanc established and served as first Director of AEC's Region II, Division of Compliance Office, Atlanta; was Coordinator of Atomic Energy Development and Radiation Protection, State of California; and more recently employed as Supervisor Environmental Quality with Pacific Gas & Electric Company.

The division's responsibilities for developing rules and regulations implementing radiation protection standards and guides issued by the Environmental Protection Agency will be under the direction of Dr. Carl C. Gamertsfelder as Assistant Director for Radiological Protection. Dr. Gamertsfelder has been serving as Assistant Director of the Division of Radiation Protection Standards.

A broad functional statement and the tentative organization chart of the new division are attached.

STATEMENTS ON PROPOSED FEDERAL ACTIONS AFFECTING THE
ENVIRONMENT

1. Purpose. This memorandum provides guidelines to Federal departments, agencies, and establishments for preparing detailed environmental statements on proposals for legislation and other major Federal actions significantly affecting the quality of the human environment, as required by section 102 (2) (C) of the National Environmental Policy Act (Public Law 91-190) (hereafter "the Act"). Underlying the preparation of such environmental statements is the mandate of both the Act and Executive Order 11514 (35 F.R. 4247) of March 5, 1970, that all Federal agencies, to the fullest extent possible, direct their policies, plans, and programs so as to meet national environmental goals. The objective of section 102(2)(c) of the Act and of these guidelines is to build into the agency decision making process an appropriate and careful consideration of the environmental aspects of proposed action and to assist agencies in implementing not only the letter, but the spirit, of the Act.
