Scholarships

SEC. 5. Section 10 of the National Science Foundation Act of 1950, as amended, is amended to read as follows:

"The Foundation is authorized to award, within the limits of funds and fellowships. made available specifically for such purpose pursuant to section 17, scholarships and graduate fellowships for scientific study or scientific work in the mathematical, physical, medical, biological, engineering, and other sciences at appropriate nonprofit American or nonprofit foreign institutions selected by the recipient of such aid, for stated periods of time. Persons shall be selected for such scholarships and fellowships from among citizens of the United States, and such selections shall be made solely on the basis of ability; but in any case in which two or more applicants for scholarships or fellowships, as the case may be, are deemed by the Foundation to be possessed of substantially equal ability, and there are not sufficient scholarships or fellowships, as the case may be, available to grant one to each of such applicants, the available scholarship or scholarships or fellowship or fellowships shall be awarded to the applicants in such manner as will tend to result in a wide distribution of scholarships and fellowships among the States, Territories, possessions, and the District of Columbia." SEC. 6. Section 11(e) of the National Science Foundation Act of 1950, as amended, is amended to read as follows:

"(e) to acquire by purchase, lease, loan, gift, or condemnation, and to hold and dispose of by grant, sale, lease, or loan, real and personal property of all kinds necessary for, or resulting from, the exercise of authority granted by this Act."

SEC. 7. Section 13 of the National Science Foundation Act of 1950, as amended, is amended to read as follows:

"(a) The Foundation is hereby authorized to cooperate in any international scientific activities consistent with the purposes of this Act and to expend for such international scientific activities such sums within the limit of appropriated funds as the Foundation may deem desirable. The Director, with the approval of the Board, may defray the expenses of representatives of Government agencies and other organizations and of individual scientists to accredited international scientific congresses and meetings whenever he deem it necessary in the promotion of the objectives of this Act. In this connection, with the approval of the Secretary of State, the Foundation may undertake programs granting fellowships to, or making other similar arrangements with, foreign nationals for scientific study or scientific work in the United States without regard to section 10 or the affidavit of allegiance to the United States required by section 16 (d) (2) of this Act.

"(b) (1) The authority to enter into contracts or other arrangements with organizations or individuals in foreign countries and with agencies of foreign countries, as provided in section 11 (c), and the authority to cooperate in international scientific activities as provided in subsection (a) of this section, shall be exercised only with the approval of the Secretary of State, to the end that such authority shall be exercised in such manner as is consistent with the foreign policy objectives of the United States.

"(2) If, in the exercise of the authority referred to in paragraph Negotiation (1) of this subsection, negotiation with foreign countries or agencies with foreign thereof becomes necessary, such negotiation shall be carried on by the countries. Secretary of State in consultation with the Director."

SEC. 8. Section 15(d) of the National Science Foundation Act of 73 STAT. 469. 1950, as amended, is amended to read as follows:

"(d) The members of the Board, and the members of each divisional Compensation. committee, or special commission, shall receive compensation at the rate of $50 for each day engaged in the business of the Foundation pursuant to authorization of the Foundation and shall be allowed travel expenses as authorized by section 5 of the Act of August 2, 1946 (5 U.S.C. 73b-2)."

To amend section 22 (relating to the endowment and support of colleges of agriculture and the mechanic arts) of the Act of June 29, 1935, to increase the authorized appropriation for resident teaching grants to land-grant institutions.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 22 of Agriculture and the Act of June 29, 1935, as amended (7 U.S.C. 329), is amended to mechanic arts read as follows: colleges.

"SEC. 22. In order to provide for the more complete endowment 49 Stat. 439. and support of the colleges in the several States and Puerto Rico entitled to the benefits of the Act entitled 'An Act donating public lands to the several States and Territories which may provide colleges for the benefit of agriculture and the mechanic arts,' approved July 2,

1862, as amended and supplemented (7 U.S.C. 301-328), there are 12 Stat. 503. hereby authorized to be appropriated annually, out of any money in the Treasury not otherwise appropriated, the following amounts: "(a) For the first fiscal year beginning after the date of enactment of this Act, and for each fiscal year thereafter, $7,650,000; and "(b) For the first fiscal year beginning after the date of enactment of this Act, and for each fiscal year thereafter, $4,300,000.

"The sums appropriated in pursuance of paragraph (a) shall be paid annually to the several States and Puerto Rico in equal shares. The sums appropriated in pursuance of paragraph (b) shall be in addition to sums appropriated in pursuance of paragraph (a) and shall be allotted and paid annually to each of the several States and Puerto Rico in the proportion to which the total population of each State and Puerto Rico bears to the total population of all the States and Puerto Rico as determined by the last preceding decennial census. Sums appropriated in pursuance of this section shall be in addition to sums appropriated or authorized under such Act of July 2, 1862, as amended and supplemented, and shall be applied only for the purposes of the colleges defined in such Act, as amended and supplemented. The provisions of law applicable to the use and payment of sums under the Act entitled 'An Act to apply a portion of the proceeds of the public lands to the more complete endowment and support of the colleges for the benefit of agriculture and the mechanic arts established under the provisions of an Act of Congress approved July 2, 1862,' approved August 30, 1890, as amended and supple- 26 Stat. 417. mented, shall apply to the use and payment of sums appropriated in 7 USC 321-326, pursuance of this section."

AN ACT

To amend the Library Services Act in order to extend for five years the authorization for appropriations, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 3 of Library Servthe Library Services Act (20 U.S.C. 352) is amended by striking out ices Act, "four succeeding fiscal years" and inserting in lieu thereof nine amendment. succeeding fiscal years".

SEC. 2. Section 4 of the Library Services Act (20 U.S.C. 353) is amended by striking out subsection (b) and by striking "(a)" after "SEC. 4.".

SEC. 3. Section 6(c) of the Library Services Act (20 U.S.C. 355 (c)) is amended to read as follows:

"(c) For the purposes of this section the 'Federal share' for any "Federal share". State shall be 100 per centum less the State percentage and the State percentage shall be that percentage which bears the same ratio to 50 per centum as the per capita income of such State bears to the per capita income of all the States (excluding Puerto Rico, Guam, and the Virgin Islands), except that (1) the Federal share shall in no case be more than 66 per centum or less than 33 per centum, and (2) the Federal share for Puerto Rico, Guam, and the Virgin Islands shall be 66 per centum."

SEC. 4. Section 6(d) of the Library Services Act (20 U.S.C. 355 (d)) is amended by inserting "(1)" after "(d)", by striking out "the States and of the continental United States (excluding Alaska)" and inserting in lieu thereof "each of the States and of all of the States (excluding Puerto Rico, Guam, and the Virgin Islands)," and by adding at the end thereof the following new paragraph:

"(2) Promulgations made before satisfactory data are available Promulgations. from the Department of Commerce for a full year on the per capita income of Alaska shall prescribe a Federal share for Alaska of 66 per centum and, for purposes of such promulgations, Alaska shall not be included in determining the per capita income of all of the States. SEC. 5. Section 9(a) of the Library Services Act (20 U.S.C. 358

(a)) is amended by striking out "Alaska, Hawaii,".

SEC. 6. The amendments made by section 2 of this Act shall be Effective dates. effective in the case of allotments from sums appropriated under section 3 of the Library Services Act for any fiscal year beginning after June 30, 1961, except that no payment shall be made to any State from its allotment under section 4 of such Act for the fiscal year ending June 30, 1962, until its allotment for any preceding year has been exhausted or ceased to be available. The amendments made by sections 3 and 4 of this Act shall be effective in the case of promulgations of Federal shares under the Library Services Act made after the enactment of this Act.
