"(d) Nothing in this Act shall be deemed to prevent

"(1) an optometric clinic approved by the Commissioners from being conducted on a nonprofit basis by a school or college of optometry or by an association

of optometrists:

"(2) an optometrist from being employed by or associated with any hospital, eli sie, group health practice, nonprofit health service, health expense indemnity corporation or group, or any department, agency, or instrumentality of the Government of the United States or of the government of the District of Columbia, or as an employee of any person to render optometric service and care solely to employees of such person;

"(3) the widow or widower of a deceased optometrist from continuing for a period not to exceed one year

after the death of such deceased optometrist, the prac

tice of such deceased optometrist through the services

of another optometrist;

"(4) the wife or husband of an optometrist who,

in the opinion of the Commissioners, is temporarily

mentally incapacitated, from continuing the practice of such optometrist through the services of another op tometrist;

"(5) the wife or husband of an optometrist who, in the opinion of the Commissioners, is permanently mentally incapacitated, from continuing for a period not to exceed one year from the date the Commissioners de

"SEC. 10. (a) The Commissioners from time to time 17 shall prescribe and adopt such rules and regulations as may 18 be necessary to carry out this Act and govern the practice

19 of optometry and the sale of optic materials, which shall 20 include but not be limited to rules and regulations governing 21 the number, size, location, and illumination of signs offering 22 the services of (1) an individual as an optometrist and (2)

23 phthalmic materials for sale. With respect to the offering 24 of services of an individual as an optome:rist, such regula25 tions shall limit the offering thereof to the carrying or pub

1 lishing of a modest professional card and the display of a 2 modest window or street sign at the location of the individual's S practice, which professional card or window or street sign 4 shall display only the name, address, profession, office hours, 5 telephone connections, and if the practice is so limited the 6 specialty practiced by the individual, and in the case of 7 change of address or the starting of practice, to modest anSnouncements thereof. With respect to the offering for sale of optometric by optometrists

9 aphthalmic materials, such regulations shall limit the offer10 ing for sale thereof to a modest window or street sign at the 11 location of the person's place of business and other modest ad12 vertisements. Nothing in this section shall be deemed to

13 authorize any optometric service or withinhuic materials to 14 be advertised in any manner which includes or contains any 15 price, cost, or reference thereof.

16 (b) (1) The Commissioners are authorized and cm17 powered, after public hearing, to establish, abolish, increase, 18 or decrease, from time to time, such fees and charges as are 19 necessary to defray the approximate cost of administering 20 the provisions of this Act.

"(2) All funds derived from fees and charges collected 22 in connection with the administration of this Act shall be paid into the Treasury of the United States to the credit of

2 the District of Columbia."

25 "(c) The Commissioners shall design and adopt a scal

1 to be used for authenticating records and papers pertaining 2 to the licensing and regulation of optome rists in the Dis3 trict of Columbia. Copies of all records and papers duly

certified and authenticated by such seal shall be received in 5 evidence in all courts of the District of Columbia equally 6 and with like effect as the original. Records kept by the 7 Commissioners pertaining to the licensing and regulation of S optometrists in the District of Columbia shall be open to 9 public inspection under reasonable rules and regulations pre10 scribed by the Commissioners.

11 "SEC. 11. The Commissioners may make such inspec12 tions, studies, and investigations, and obtain or require the 13 furnishing of such information under oath or affirmation or 14 otherwise, as they deem necessary or proper, to assist them 15 in prescribing any regulation or order under this Act, or in 16 the administration or enforcement of this Act and any regu17 lations or rules or orders theremder. For such purposes, the Commissioners may administer oaths and affirmations,

may require by subpena or otherwise the attendance and testimony of witnesses, and the production of documents at any 21 designated place within the District of Columbia. In the

event of contumacy or refusal to obey any such subpena or requirement under this section, the Commissioners may make application to the District of Columbia Court of General Ses

sions for an order requiring obedience thereto. Thereupon,

1 the Court, with or withou notice and hearing, as it, in its 2 discretion, may decide, shall make such order as is proper 3 and may punish as a contempt, any failure to comply with 4 such order in accordance with section 11-982 of the District 5 of Columbia Code.

6 "SEC. 12. Whenever, in the judgment of the Commis7 sioners, any person has engaged in or is about to engage Sin any act or practice which constitutes or will constitute 9a violation of any provision of this et, the Commissioners 10 may make application to the District of Columbia Court 11 of General Sessions for an order either temporarily or per12 manently enjoining such act or practice, and upon showing 13 by the Commissioners that such person has engaged in or 14 is about to engage in any such act or practice, an injunction, 15 restraining order, or such other order as may be appropriate 16 shall be granted by the court, without bond.

"SEC. 13. (a) Prosecutions for violations of any of the 18 provisions of this Act shall be conducted in the name of the 19 District of Columbia in the District of Columbia Court of 20 General Sessions by the Corporation Counsel or any of his 21 assistants.

22 "(b) It shall be necessary to prove in any prosecution 23 or hearing authorized by this Act, only a single act pro24hibited by law, without proving a general course of conduct 25 in order to constitute a violation.
