ANALYSIS OF LOAN TERMS FOR SCHOOL LIBRARY RESOURCES, TEXTBOOKS, AND OTHER INSTRUCTIONAL MATERIALS 1

A. LOAN AGENCIES

1. In 34 States (Alabama, Alaska, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Idaho, Illinois, Indiana, Kansas, Kentucky, Michigan,* Minnesota, Missouri, Nevada, New Hampshire, New York, North Carolina,* North Dakota, Ohio, Oregon, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wyoming), local educational agencies, usually the public school district, will purchase resources for use by public and private school children and teachers and retain title. Most plans provide that title to resources purchased for use in State operated elementary and secondary schools will be held by the State.

2. In eight States, (Arizona, Georgia, Maine, Maryland, Massachusetts, Mississippi, New Jersey, Wisconsin), local educational agencies, usually the public school district, will purchase resources for use by public school children and teachers and retain title. In seven of these States, the State education agency will purchase resources for use by private school children and teachers and retain title to the materials. In Maryland, a subagency, under contract with the State agency, will purchase resources for use by private school children and teachers, and hold title to the resources for the State.

3. In four States (Hawaii, Montana, New Mexico, Pennsylvania) the District of Columbia, Guam, Puerto Rico, the Trust Territory of the Pacific Islands and the Virgin Islands, the State education agency will purchase resources for use by public and private school children and teachers, and retain title. In Louisiana, local educational agencies will purchase resources; however, the State education agency will retain title.

4. In Iowa, subagencies will purchase resources for use by children and teachers in public and private schools and retain title.

5. In Nebraska and Oklahoma, public school districts will purchase resources for use by public school children and teachers and retain title. Arrangements to serve the private school children and teachers in these States are being made by the U.S. Commissioner of Education.

B. TERMS OF LOAN

1. In 19 States (Alabama,' Alaska, Arizona, Arkansas, California," Delaware, Florida, Indiana, Kansas, Kentucky, Louisiana," Maryland, "2 Mississippi,

In some instances, cooperative regional centers of the State education agency may purchase materials for use by private school children and teachers and retain title.

The State education agency will purchase and retain title to some materials for use by public and private school children and teachers.

State education agency may also hold title.

Both intermediate and local public school districts may purchase materials and retain title.

The State plan also permits local school districts to serve private school children and teachers.

Specifies that resources must be returned at close of designated use period or at close of school.

Loan periods to private school children and teachers are to be for not less than 1 calendar month.

Resources loaned to private school children and teachers must be returned at end of year, or for balance of inventory period for which loaned. Loans may vary depending upon type of materials. Loans are also renewable. 1 Loans to private school children and teachers will be on a long-term basis not to exceed 1 year.

Terms are to be developed cooperatively among State education agencies, local parish and city schools, and local schools, based also on need and use of materials, and time needed to complete the project.

12 Materials for public school children and teachers will be placed in public schools on a permanent loan basis. A subagency, under contract with the State agency, will loan materials to children and teachers in private schools, according to generally accepted school practice.

Nebraska, North Dakota, Tennessee, Washington, Wisconsin," Wyoming," and the District of Columbia, loan terms are established according to procedures now used in the State or local education agency for similar resources. In Puerto Rico, loan terms are the same as those which govern loan to public schools.

2. In 10 States (Colorado, Connecticut, Georgia, Idaho, Illinois,16 New Hampshire, New York," Oregon, Texas, Virginia) loan terms will be developed by the local educational agencies.

3. In seven States (Maine, Michigan, Minnesota," Missouri, North Carolina, Utah, Vermont," the Trust Territory of the Pacific Islands and the Virgin Islands, loans to private school children and teachers are for a period of time consistent with needs.

4. In two States (New Mexico and Rhode Island), loans are for a period not to exceed a year; however extension may be granted.

5. In Nevada and Guam, loans are for a temporary period with resources subject to recall. In Nevada, terms for recall will be established by school districts and in Guam terms for recall will be established by the State education agency. 6. In Ohio, loan terms will be arranged according to local policy and procedure or by periodic circulation of resources in "blocks or packages" which would rotate from school building to school building each 6 weeks. Another loan method is to provide a central repository for equal accessibility to all children and teachers.

7. In South Carolina, resources will be placed in schools on a loan basis in accordance with State criteria for considering relative needs.

8. In South Dakota, public schools will loan resources to children and teachers in public and private schools on the same basis. Teachers in private schools may also receive resources on extended loan.

9. In West Virginia, resources for use by public school children and teachers will be placed in local schools. Resources will be loaned for use by private school children and teachers, the terms depending on need for resources and types of resources loaned, practices varying from agency to agency.

10. In Iowa, each teacher will be eligible to borrow resources for a loan period not to exceed 3 months, with one renewal. Teachers will make resources available to children in accordance with school policies.

11. In Oklahoma, textbooks wil be loaned on the same basis as those acquired from State or local funds, usually for the entire year. Other resources will be loaned in the same manner as resources acquired through State and local effort. 12. In Montana, materials will be loaned for an indefinite period and are renewable upon request.

13. In Pennsylvania, loan terms are to be arranged by the director of school libraries and based on maximum utilization of materials for all children and teachers of the State.

14. Loan terms in Massachusetts and New Jersey are not specified except that in Massachusetts, resources will be made available in the same manner for public and private school children and teachers and that loans are renewable upon request.

15. In Hawaii, materials will be made available to children and teachers in public and private schools on a free loan basis. Length of loan will depend on a realistic need in terms of the instructional program. Loan terms will vary from year to year, the variations to depend on the need for the resources, nature of the materials, and size of the collections.

Loan terms to private schools will vary depending upon the need for resources and nature of material to be loaned. Each public agency will determine loan procedures and length of loan periods.

Loan terms will vary and emphasize maximum use. Terms may be established on an individual basis because of geographic conditions and transportation problems.

23 Need is in terms of the instructional program. Loans must be established in compliance with current laws governing custody and use of State property.
