be paid out of the State Treasury, and the Auditor of Public Accounts is hereby directed to draw his warrant upon the Treasurer in favor of said Chief Clerks and Assistant Clerks of both House and Senate. Neither approved nor disapproved. HOUSE RESOLUTION NO. 36. JOINT RESOLUTION providing for the payment of the expenses of a committee appointed to investigate the matter of the removal of the State Board of Health. Whereas, the House of Representatives has, heretofore, appointed a committee of its members to serve as an Investigating Committee, in the matter of the proposed removal of the State Board of Health from Bowling Green, Kentucky; and, Whereas, said Committee has completed its labors and made its report to this body; and, Whereas, it was necessary for said Committee to incur, and said Committee did incur, certain expenses such as railroad fare and hotel bills, in the progress of such investigation; therefore, Be it Resolved by the House of Representatives of the General Assembly, the Senate concurring: That said committee be reimbursed for the amount of such expenses so incurred by them, viz.: Thirty-nine dollars and seventy-eight cents, and the Auditor of Public Accounts be, and he is hereby authorized and directed to draw his warrant upon the Treasurer of this Commonwealth in favor of Ben S. Street, chairman of said committee, to be paid out of the funds now in the Treasury of this Commonwealth. Neither approved nor disapproved. HOUSE RESOLUTION NO. 37. Whereas, S. F. Day instituted a contest against Edward L. Allen before the House of Representatives, contesting the seat of said Allen as Representative from the Ninety-seventh Legislative District of Kentucky, said district being composed of the counties of Knott, Floyd and Letcher; and, Whereas, A. F. Hanberry has likewise instituted a contest against G. Frank Walthall before the House of Representatives, contesting the seat of said Walthall as Representative from Trigg County, it being the Eighth Legislative District of Kentucky; and, Whereas, the contests having been determined by the House of Representatives in favor of said Walthall and said Allen, and it has been heretofore adjudged that said Walthall and Allen were the duly elected Representatives from the Eighth and Ninety-seventh Legislative Districts, respectively; and, Whereas, in defending the said contests, the contestee, G. Frank Walthall has expended sums in the following amounts, to wit: Depositions ten dollars; traveling expenses and livery hire five dollars; and, Whereas, it appears in defending said contest, the contestee, Edward L. Allen has expended sums in the following amounts, to-wit: Railroad fare and hotel bill of W. W. Williams, Attorney for contestee Edward L. Allen and contestee, from Prestonburg to Frankfort and return, forty dollars; hotel bill, railroad fare, livery hire and expenses of A. J. May, W. P. Mayo, W. W. Williams, S. J. Kilgore and Edward L. Allen, in attending the taking of depositions and the examination of witnesses and preparation of testimony in the counties of Knott, Letcher and Floyd, fifty-five dollars; and, Whereas, it became necessary for contestants and contestees to employ attorneys to represent each of them in the preparation and hearing of said contests, the said attorneys preparing the notice of contest and all other legal papers required and attending the taking of depositions, the preparation of evidence and the hearing of the contest before the Contest Committee; and, Whereas, it appears that the contestee, Edward L. Allen, has incurred an attorney's fee of three hundred dollars and the contestant, S. F. Day has incurred an attorney's fee of one hundred dollars, and the contestee, G. Frank Walthall, has incurred an attorney's fee of two hundred and fifty dollars, and the contestant, A. J. Hanberry, has incurred an attorney's fee of one hundred dollars; and, Whereas, it appears that the attorney's fee of each of the parties to these contests are reasonable and proper for the services of the attorneys for said contestants and contestees. Now, therefore, Be it Resolved by the General Assembly of the Commonwealth of Kentucky: That the sum of three hundred and ninety-five dollars, being the cost, expense and attorney's fee allowed to Edward L. Allen; and that the sum of two hundred and sixty-five dollars, being the attorney's fee, cost and expense of G. Frank Walthall, as above mentioned, be and it is hereby allowed to G. Frank Walthall; and that the sum of one hundred dollars, being the attorney's fee of the contestant, A. F. Hanberry, be and it is hereby allowed to A. F. Hanberry; and that the sum of one hundred dollars, being the attorney's fee of S. F. Day, be and it is hereby allowed to S. F. Day; all of said sums above mentioned being allowed on account of said contests; and, Be it further Resolved, That the Auditor of Public Accounts of the Commonwealth of Kentucky be and he is hereby directed to draw his warrant on the State Treasurer for the sum of three hundred and ninety-five dollars in favor of Edward L. Allen; and for the sum of two hundred and sixty-five dollars, being the sum in favor of G. Frank Walthall; and for the sum of one hundred dollars in favor of A. F. Hanberry; and for the sum of one hundred dollars in favor of S. F. Day. Neither approved nor disapproved.
