§ 400.2 Purpose.

(a) The purpose of Part A of the Act, as stated in section 101 of the Act, the "Declaration of Purpose," is to assist States in improving planning in the use of all resources available to the States for vocational education and manpower training by involving a wide range of agencies and individuals concerned with education and training within the State in the development of the vocational education plans.

It is also the purpose of this part to authorize Federal grants to States to assist them—

(1) To extend, improve, and, where necessary, maintain existing programs of vocational education,

(2) To develop new programs of vocational education,

(3) To develop and carry out such programs of vocational education within each State so as to overcome sex discrimination and sex stereotyping in vocational education programs (including programs of homemaking), and thereby furnish equal educational opportunities in vocational education to persons of both sexes, and

(4) To provide part-time employment for youths who need the earnings from such employment to continue their vocational training on a fulltime basis, so that persons of all ages in all communities of the State, those in high school, those who have completed or discontinued their formal education and are preparing to enter the labor market, those who have already entered the labor market, but need to upgrade their skills or learn new ones, those with special educational handicaps, and those in postsecondary schools, will have ready access to vocational training or retraining which is of high quality, which is realistic in the light of actual or anticipated opportunities for gainful employment, and which is suited to their needs, interests, and ability to benefit from such training.

(b) The purpose of these regulations is to assist the States, local educational agencies, postsecondary institutions, and other institutions capable of carrying out vocational education programs, to administer the federally as

sisted State programs of vocational education under the Act.

§ 400.3 Regulations that apply to State Vocational Education Programs.

(a) Regulations. The following regulations apply to State Vocational Education Programs:

(1) The Education Department General Administrative Regulations (EDGAR) in 34 CFR Part 76 (StateAdministered Programs) and Part 77 (Definitions).

(2) The regulations in this Part 400. (b) How to use regulations; how to apply for funds. The "Introduction to Regulations of the Department" at the beginning of EDGAR includes general information to assist in

(1) Using regulations that apply to Department programs; and

(2) Applying for assistance under a Department program.

§ 400.4 Cross reference to definitions.

Definitions necessary for the understanding of 34 CFR Parts 400 and 408 are set forth in Part C of Title I of the Act (section 195 of the Act) and as Appendix A at the end of Part 408 of these regulations. Some additional definitions necessary for the understanding of Part 408 appear in Part 408.

§ 400.5 Requirements under Part B of the Education of the Handicapped Act.

(a) Regulations under Part B of the Education of the Handicapped Act are located in 34 CFR Part 300.

(b) Section 612(6) of the Education of the Handicapped Act requires that the State educational agency be responsibile for ensuring that all educational programs for handicapped children within the State, including all of those programs administered by any other State or local agency, are under the general supervision of persons responsible for educational programs for
