"SEC. 310. (a) (1) For purposes of this section, the

term 'migrant health center' means an entity which (A) 5 provides, in the manner prescribed by paragraph (2), the 6 services described in such paragraph to (i) domestic agri7 cultural migratory workers and their families, and (ii) to 8 persons who perform seasonal agricultural services similar to 9 the services performed by domestic agricultural migratory 10 workers and their families if the Secretary finds that the pro11 vision of such services to such persons will contribute to 12 the improvement of the health conditions of domestic agri13 cultural migratory workers and their families, and (B) is organized in the manner prescribed by paragraph (3).

"(2) A migrant health center shall provide each of 16 the following services: (A) primary health services, (B) 17 referral to providers of supplemental health services, (C) 18 environmental health services, including the detection and 19 alleviation of unhealthful conditions associated with water

supply, sewage treatment, solid waste disposal, pest infesta21 tion, field sanitation, housing conditions, and other environ22 mental factors related to health, (D) infectious and parasitic 23 diseases screening and control, (E) accident prevention, in

1 cluding prevention of excessive pesticide exposure, and (F) 2 information on the availability of and proper utilization of 3 health services. The services of a center shall be provided 4 directly through its staff and supporting resources or through 5 contracts or cooperative arrangements with public or private 6 entities. Primary health services shall be available and acces7 sible in the area served by the center promptly, as appro8 priate, and in a manner which assures continuity. 9 "(3) The governing body of a migrant health center 10 shall have at least a majority of its members selected in a 11 democratic manner by the persons receiving services from 12 the center, shall meet at least once a month, shall estab13 lish general policies for the center, shall approve the center's 14 annual budget, and shall approve the selection of a director 15 for the center. The center shall have orgnaizational arrange16 ments, established in accordance with regulations prescribed 17 by the Secretary, for an ongoing quality assurance program 18 (including utilization and peer review systems) respecting 19 the center's services.

"(b) For purposes of this section:

"(1) The term 'domestic agricultural migratory work22 ers' means an individual whose principal employment is 23 in agriculture on a seasonal basis, who has been so em24 ployed within the last twenty-four months, and who estab

1 lishes for the purpose of such employment a temporary

"(2) The term 'primary health services' means—

"(A) services of physicians and, where feasible, services of physicians' assistants and nurse clinicians provided under the supervision of physicians;

"(B) diagnostic laboratory and radiologic services;

"(C) preventive health services (including children's eye examinations to determine the need for vision correction);

"(D) emergency medical services; and

"(E) transportation services as required for adequate patient care.

"(3) The term 'supplemental health services' means

"(A) inpatient hospital services;

"(B) home health services;

"(C) rehabilitation services; and

"(D) dental services.

"(4) The term 'high impact area' means a county or 20 other political subdivision within a State which has not less 21 than six thousand domestic agricultural migratory workers 22 residing within its boundaries for more than six months in 23 any calendar year.

"(c) The Secretary may make grants to public and

1 nonprofit private entities to assist in (1) the establishment 2 and initial operation of migrant health centers which will 3 serve one or more high impact areas, and (2) meeting the 4 costs of the continued operation of such centers.

5 "(d) The Secretary may make grants to public and 6 nonprofit private entities, and may enter into contracts with 7 public and private entities, in areas in which no migrant 8 health centers exist and which are not high impact areas"(1) for the provision of emergency care to domestic agricultural migratory workers and their families; "(2) for the provision of followup care for chronically ill domestic agricultural migratory workers and

their families;

"(3) for the development of arrangements with existing facilities to provide primary health services to domestic agricultural migratory workers and their families; and

"(4) for other projects which would improve the health conditions of domestic agricultural migratory workers and their families.

"(e) The Secretary may enter into contracts with public 22 and private entities to

"(1) assist the States in the implementation and enforcement of acceptable environmental health standards, including enforcement of levels of sanitation in mi

grant labor camps and applicable Federal and State pesticide control standards; and

"(2) initiate special projects and studies which

would assist the several States in the assessment of the problems related to camp sanitation, field sanitation, pesticide hazards, and other environmental health problems faced by domestic agricultural migratory workers. "(f) (1) To enable the Secretary to make grants and 9 contracts under this section, there are authorized to be ap10 propriated $50,000,000 for the fiscal year ending June 30, 11 1975; and $55,000,000 for the fiscal year ending June 30, 12 1976.

13 "(2) Of the funds appropriated under this subsection 14 for any fiscal year, not more than 30 per centum of such 15 funds shall be used for grants and contracts under subsection 16 (d) for the fiscal year ending June 30, 1974, and not more 17 than 15 per centum of such funds shall be used for such 18 grants and contracts for any succeeding fiscal year. Of the 19 funds appropriated under this subsection for any fiscal year, 20 not more than 10 per centum of such funds shall be used for 21 contracts under subsection (e).

"(g) No grant may be made or contract entered into 23 under this section unless an application therefor has been 24 submitted to and approved by the Secretary. Such applica25 tion shall be submitted in such form and manner and shall
