1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 10 struction of, and to maintain and operate when such construction is completed, any facility, the construction of which is assisted by funds made available pursuant to section 132; "(19) provide reasonable assurance that all laborers and mechanics employed by contractors or subcontractors in the performance of work on any construction project assisted with funds made available pursuant to section 132 will be paid wages at rates not less than those prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with the Davis-Bacon Act, as amended (40 U.S.C. 276a-276a-5); and the Secretary of Labor shall have with respect to the labor standards specified in this paragraph the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (15 F.R. 3176; 5 U.S.C. 133z-15) and section 2 of the Act of June 13, 1934, as amended (40 U.S.C. 276c); and". 19 (4) The heading of the section redesignated as section 20 135 by paragraph (1) of this subsection is amended by 21 inserting "CONSTRUCTION," after "PLANNING,". (5) The heading of the section redesignated as section 23 136 by paragraph (1) of this subsection is amended by 24 inserting "CONSTRUCTION," after "PLANNING,", 11 1 (6) The section redesignated as section 135 (a) (1) 2 by paragraph (1) of this subsection is amended by striking 3 out", other than expenditures for construction,". 4 (7) Section 140 is amended by striking out so much 5 thereof as precedes subsection (b) (other than the section 6 heading), by striking out “(b)” and inserting in lieu thereof 7 "SEC. 138.", and by inserting "construction," after 8 "planning,". 9 (8) Section 142 (a) (2) (A) is amended by inserting 10 "which was used by the State in which the facility is located" 11 before "to assist in financing the construction of the facility". 12 (b) (1) Section 401 (h) (1) of the Mental Retardation. 13 Facilities and Community Mental Health Centers Construc14 tion Act of 1963 is amended by striking out "part C of title 15 I or". 16 (2) Section 401 (h) (2) of such Act is amended by 17 striking out "(A) for any project under part C of title I 18 may not exceed 66 per centum of the costs of construction 19 of such project; and (B)". 20 (3) Section 401 (h) (3) of such Act is amended by 21 striking out "under part C of title I or". 22 (4) Section 403 (a) of such Act is amended by striking 23 out "section 134 in the case of a facility for the mentally 24 retarded or persons with other developmental disabilities, 12 1 or" and by striking out "section 136 or" and "as the case 2 may be," from clause (2) thereof. 3 (5) Section 403 (b) of such Act is amended by striking 4 out "135 or". 5 (6) Section 404 of such Act is amended by striking 6 out "135 or" and "136 or" from the first sentence thereof. 7 (7) Section 405 of such Act is amended by inserting 8 "or section 135" after "section 403". 9 (8) Section 405 (1) of such Act is amended by strik 10 ing out "135 or" from clause (A) thereof and by inserting 66 11 '(in the case of a community mental health center)" after 12 "205" in such clause. 13 14 AMENDMENTS TO FEDERAL SHARE PROVISION SEC. 305. The section redesignated as section 135 (b) 15 by section 304 (a) (1) of this Act is amended to read as 16 follows: 17 "(b) The Federal share' with respect to any State for 18 purposes of this section shall be 70 per centum for the fiscal 19 year ending June 30, 1975; 60 per centum for the fiscal 20 year ending June 30, 1976; and 50 per centum for the 21 fiscal year ending June 30, 1977." 22 23 23 INCLUSION OF LAND ACQUISITION COSTS SEC. 306. Section 401 (e) of the Mental Retardation 24 Facilities and Community Mental Health Centers Construc tion Act of 1963 is amended by inserting ", for purposes of 13 1 title II of this Act only," before "the cost of the acquisition 2 of land.". 3 4 INCLUSION OF AUTISM SEC. 307. Section 401 (1) of the Mental Retardation 5 Facilities and Community Mental Health Centers Construc6 tion Act of 1963 is amended by inserting "(including 7 autism)" after "condition of an individual”. 8 9 10 11 INCREASING EMPHASIS ON DEINSTITUTIONALIZATION AS A PROGRAM OBJECTIVE SEC. 308. (a) Section 130 is amended (1) by striking out "and" in clause (e), (2) by striking out the period at 12 the end of clause (f) and inserting "; and" in lieu thereof, 13 and (3) by inserting a new clause (g) as follows: 14 15 16 17 "(g) grants to assist in the elimination of inappropriate placement of persons with developmental disabilities in institutions." (b) Section 134 (b) (1) (4) is amended by redesignat18 ing clauses (C) and (D) as clauses (D) and (E), respec19 tively, and by inserting the following new clause (C): "(C) part of such funds will be made available for 20 21 22 23 2 2 2 2 2 2 6 24 the elimination of the inappropriate placement of per sons with developmental disabilities in institutions;". TITLE IV-EFFECTIVE DATE SEC. 401. This Act is effective with respect to appro 25 priations for fiscal years beginning after June 30, 1974, 26 except that section 104 is effective upon its enactment.
