Subsections (e) and (f) of section 401 of the 5 Mental Retardation Facilities and Community Mental Health 6 Centers Construction Act of 1963 are amended to read as 7 follows: 8 "(e) The term 'construction' includes construction of 9 new buildings, acquisition of existing buildings, and expan10 sion, remodeling, alteration, and renovation of existing 11 buildings, and initial equipment of such new, newly acquired, 12 expanded, remodeled, altered, or renovated buildings. 13 "(f) The term 'cost of construction' includes the cost 14 of architects' fees and acquisition of land in connection with 15 construction, but does not include the cost of off-site im 16 provements." 17 SEC. 3. Section 314 (d) (7) of the Public Health 6 Services Act is amended to read as follows: 7 "(7) ALLOCATION OF FUNDS WITHIN THE STATES.— 8 At least 70 per centum of a State's allotment under this sub9 section shall be available only for the provision under the 10 State plan of services in communities of the State." 11 121 EXTENSION OF STATE FORMULA GRANTS SEC. 102. Section 314 (d) (1) of such Act is amended 13 by striking out "and" after "1973," and inserting immedi14 ately after "1974" the following: ", and such sums as may 15 be necessary for each of the next three fiscal years". 16 17 EXTENSION AND REVISION OF PROJECT GRANTS SEC. 103. Section 314 (e) of such Act is amended to 18 read as follows: 19 “(e) (1) There are authorized to be appropriated such 20 sums as may be necessary for the fiscal year ending June 21 30, 1975, and each of the next two fiscal years, for grants 22 to any public or nonprofit private entity to pay part of the 23 cost of 24 "(A) providing services (including related train 31-151 074 Pt. 1 26 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 3 ing) to meet health needs of limited geographic scope or of specialized regional or national significance; "(B) preventing or treating alcoholism; "(C) providing or operating centers to make avail able comprehensive health services (as defined by the Secretary); "(D) providing or operating health service clinics for domestic agricultural migratory workers or for projects in improving health care or conditions of these workers or their families, or to encourage and cooperate in programs to improve their health services or condi tions, including the support of services to seasonal agricultural workers when it contributes to improving the health conditions of migratory workers; or "(E) providing services (including related training) in the field of family planning. 17 "(2) With respect to a facility or center, or portion 18 thereof, used or to be used for a purpose enumerated in the 19 preceding paragraph, the Secretary may provide, upon such 20 terms as he deems necessary to protect the financial interest 21 of the United States, that a grant under this subsection shall 22 be available to pay the cost (in addition to any cost for 23 which it may otherwise be made available under that para24 graph) of 25 "(A) in the case of a facility or center in existence 4 1 2 3 4 5 6 7 8 9 10 11 12 prior to January 1, 1974, amortizing the principal of, or paying the interest on, a loan for the facility's or cen ter's acquisition, construction, expansion, alteration, or remodeling (including a facility or center acquired from, or constructed in connection with, any program or project transferred to the Secretary from the Office of Economic Opportunity), including architects' fees and the cost of acquiring land; or "(B) its minor remodeling or minor alteration, including architects' fees." CONSOLIDATION OF ADVISORY COUNCILS SEC. 104. (a) Section 316 of the Public Health Service 13 Act (establishing a National Advisory Council on Compre14 hensive Health Planning Programs) is repealed, and there 15 is enacted a new section 316 to read as follows: 16 "NATIONAL ADVISORY COUNCIL ON HEALTH SERVICES 17 "SEC. 316. (a) The Secretary shall appoint, without 18 regard to the provisions of title 5 of the United States Code, 19 governing appointments in the competitive service, and with20 out regard to the provisions of chapter 51 and subchapter 21 III of chapter 53 of that title relating to classification and 22 General Schedule pay rates, a permanent body to be known 23 as the National Advisory Council on Health Services. The 24 Council shall consist of the Secretary or his designee, who 25 shall be the Chairman, and not to exceed twenty members, not |
