AUDITOR OF THE CANAL DEPARTMENT.

The office of Chief Clerk of the Canal Department was abolished April 3, 1848, and that of Auditor of the Canal Department was created by the same act. In this officer were vested all the powers and duties of the Chief Clerk and of the Comptroller, except as a Commissioner of the Canal Fund. He is also Secretary of the Commissioners of the Canal Fund, and of the Canal Board, was a member of the Contracting Board during its existence. He is the chief financial officer of the canals, instructs disbursing and collecting agents, issues warrants for payments out of the Canal Fund, and reports annually to the Legislature the receipts and payments on account of the canals and canal debts. His term of office is three years, and he receives his appointment from the Governor and Senate. Salary, $5,000. By chapter 177. Laws of 1861, the Auditor is allowed a deputy.

[The Superintendent of Public Works has the general charge of the construction of new canals, and of the repairs of the completed canals, viz.: Erie, Champlain, Oswego, Cayuga and Seneca, Chemung, Chenango, Genesee Valley, Black River, Oneida Lake, Oneida River improvement, Seneca River towingpath and Cayuga inlet.]

[Prescribes duties of, and assigns divisions of canals to Engineers, and appoints the same; visits and inspects canals; prescribes surveys, maps, plans, estimates, etc., in the construction or improvement of a canal.]

[Invested with the powers and duties formerly belonging to the Comptroller in relation to the canals; draws warrants on the Treasurer for all canal payments: audits all canal accounts; instructs canal collecting and distributing officers; keeps accounts of canal receipts and expenditures, etc.; ex officio Secretary of the Commissioners of the Canal Fund and of the Canal Board.]

By chap. 321 of the Laws of 1870, jurisdiction was granted to the Canal Appraisers "to hear and determine all claims against the State of any and all persons and corporations for damages alleged to have been sustained by them from the canals of the State, or from their use and management, or resulting or arising from the negligence or conduct of any officer of the State having charge thereof, or resulting or arising from any accident or other matter or thing connected with the canals," subject to the provisions and restrictions specified in the act.

CANAL BOARD.

[The Canal Board is composed of the Commissioners of the Canal Fund, the Superintendent of Public Works, and the State Engineer and Surveyor.

Meets at the Canal Department from time to time during the year; fixes the rates of tolls; appoints the collectors of tolls; hears appeals from Canal Appraisers and remits penalties.]

SUPERINTENDENT OF PUBLIC WORKS.

The Superintendent of Public Works is appointed by the Governor, by and with the advice and consent of the Senate, and holds his office until the end of the term of the Governor by
