AUTHORIZING AN EXCHANGE OF LANDS AT ACADIA NATIONAL PARK, MAINE

REPORT

The Committee on Interior and Insular Affairs, to whom was referred the bill (H.R. 5558) to authorize an exchange of lands at Acadia National Park, Maine, having considered the same, report favorably thereon without amendment and recommend that the bill do pass.

PURPOSE

The purpose of H. R. 5558, by Congressman Hathaway, is to provide for the exchange of two parcels of land in connection with Acadia National Park in the State of Maine. A 4.8-acre parcel will be conveyed to the United States by the Jackson Laboratory, a nonprofit corporation, and the Secretary of the Interior will convey to the Jackson Laboratory in exchange thereof a 4.6-acre tract.

NEED

The land proposed to be conveyed by the Secretary to the laboratory is not needed for park purposes. The land to be received by him, on the other hand, will be useful inasmuch as it lies adjacent to picnic grounds within the park which will someday have to be expanded. (At present the picnic area is used by about 20,000 visitors a year.) In the meantime it will serve as a buffer zone between the picnic area and nonpark land. In addition the conveyance to the Jackson Laboratory will relieve the National Park Service of any need to maintain a road which, though presently within the park, serves only the laboratory. It will also help to straighten a portion of the park boundaries. Both parcels have been appraised at $475. There will, therefore, be no need for any cash settlement between the parties.

Enactment of H.R. 5558 is necessary to authorize the proposed exchange for two reasons: (1) There is no authority under the act establishing Acadia National Park (act of Feb. 26, 1919, 40 Stat. 1178) to acquire land for this park except by donation; (2) there is no general authority under which land within any unit of the national park system may be disposed of.

COST

H.R. 5558 involves no cost to the Government beyond such amounts as will be necessary to defray the administrative expenses of effectuating the exchange.

DEAR MR. ASPINALL: Your committee has requested a report on H.R. 5558, a bill to authorize en exchange of lands at Acadia National Park, Maine.

We recommend the enactment of the bill.

The bill authorizes the Secretary to accept title to approximately 4.8 acres of land which is within the town of Bar Harbor, Maine, and adjacent to the Bear Valley picnic area at Acadia National Park. The land is owned by the Jackson Laboratory, a local nonprofit corporation, and it has delivered to the Department a preliminary deed to the property. Upon acceptance of title, the property will become a part of Acadia National Park.

In exchange for the above property, the bill authorizes the Secretary to convey to the Jackson Laboratory approximately 4.6 acres of Federal land within Acadia National Park. This land comprises a 16-foot road right-of-way leading from State Highway No. 3 that bisects the property held by the Jackson Laboratory, and approximately 1,500 feet of an old road which formerly served a park campground, but which now serves only the Jackson Laboratory.

An independent appraiser has found that the properties to be exchanged under H.R. 5558 are of equal value ($475). We anticipate no additional costs to the Federal Government if the proposed exchange is consummated.

The proposed land exchange will enable the Federal Government (1) to receive lands adjacent to the Bear Valley picnic area needed for expansion of facilities at this area, (2) to dispose of roads which it has maintained for many years but which serve only the Jackson Laboratory, and (3) to straighten a portion of the irregular boundary of Acadia National Park. We believe, therefore, the enactment of H.R. 5558 is in the interest of the Federal Government.
