Mr. TUNNEY introduced the following bill; which was read twice and referred to the Committees on Commerce, Public Works, and Government Operations jointly by unanimous consent

A BILL

To establish a demonstration program in energy conservation, using promising innovative technology to the maximum extent possible, through retrofitting existing buildings with energy conservation equipment and systems, and for other

purposes.

FINDINGS AND PURPOSE

SEC. 2. (a) The Congress finds and declares that—

(1) large amounts of fuel and energy are consumed unnecessarily each year in heating, cooling, ventilating,

providing hot water, lighting, and for other major energy uses in residential and commercial buildings because such buildings lack adequate energy-conservation features;

(2) substantial savings in fuel and energy could be accomplished by retrofitting such buildings with adequate energy-conservation features that would more than pay for themselves in reduced energy costs on a life-cycle basis; and

(3) the national interest will be best served by encouraging innovative technology and approaches so that a wide diversity of geographic and technological circumstances may be treated with a maximum of cost effectiveness.

(b) It is the intent of Congress to institute a demon15 stration program for retrofitting selected existing Federal, 16 State, and municipal buildings for energy conservation, using 17 promising innovative technology to the maximum extent 18 possible, and to disseminate the results of that experience in order to promote this type of conservation nationwide.

(a) “Administrator" means the Administrator of the

23 Federal Energy Administration.

(b) "Director" means the Director of the National

25 Bureau of Standards.

(c) "Panel" means the Awards Panel as defined in sec

2 tion 4.

3 (d) "Governor" means a Governor of one of the fifty

4 States.

(e) "Municipality" means a town, city, or other district 6 in the United States which is not a State, which has powers 7 of local self-government, and which owns at least ten 8 buildings.

9 (f) "Executive" means mayor of a city or town, execu10 tive officer of a county or other municipality who has author11 ity to contract for retrofitting of buildings which belong to 12 that municipality.

DUTIES OF ADMINISTRATOR

SEC. 4, (a) Within ninety days after the enactment of 15 this Act, the Administrator, in consultation with the Director 16 of the National Bureau of Standards shall establish procedures 17 for identifying existing buildings as candidates for retrofitting 18 with energy conservation equipment and systems for the pur19 pose of decreasing the cost of supplying such buildings with 20 energy for climate-conditioning, water-heating, lighting, and 21 other major uses of energy. In developing such procedures 22 the Administrator and the Director shall consult with other 23 Federal agencies and appropriate professional architectural 24 and engineering societies as required to insure a broad per

1 (b) The Administrator shall establish and convene on a 2 timely basis, as required, an Awards Panel for the purpose 3 of awarding grants to States and municipalities under section

6 of this Act. The Panel shall consist of the Administrator or 5 his designate, the Director or his designate, and one other 6 person to be chosen by the Administrator. The Administrator 7 shall designate one member of the Panel as Chairman. 8 (c) The Administrator shall publish in the Federal 9 Register procedures established under (a) of this section, 10 along with the provisions of this Act and necessary proce11 dures for applicants, and shall also transmit a copy of same 12 to the Administrator of the General Services Administration.

FEDERAL PROGRAM

SEC. 5. (a) On the basis of procedures established in

15 section 4 the Administrator of the General Services Adminis16 tration shall, within six months after the date of enactment of

17 this Act, select no fewer than forty federally owned buildings 18 as candidates for retrofitting with energy conservation equip19 ment and systems. The buildings shall be selected so as to 20 offer a wide range of geographic and technological circum21 stances and opportunities for implementation of energy con

22 servation measures which can be justified on a life-cycle cost 23 basis.

24 (b) The Administrator of the General Services Ad25 ministration shall, within six months after the date of enact

1 ment of this Act, solicit proposals for retrofitting each build2 ing identified in subsection (a) of this section with energy 3 conservation equipment and systems. On the basis of the 4 proposals received in response to his solicitations, the Ad5 ministrator of the General Services Administration, in con6 sultation with the Administrator and the Director, is author7 ized to award contracts for the design and installation of 8 energy conservation equipment and systems in any or all of 9 the federally owned buildings identified in subsection (a) of 10 this section. In addition to the cost and estimated effectiveness 11 of the proposal in achieving energy conservation, the potential for a novel and innovative approach to be of particular 13 value in wide application shall be a factor in awarding

contracts.

(e) Grants for Federal buildings shall be for the full cost of the contract, within the limit of funds available, but 17 not to exceed $1,000,000 for any one building.

STATE AND MUNICIPAL PROGRAM

SEC. 6. (a) Governors of the fifty States and executives 20 of municipalities may submit requests for grants for retrofit21 ting of buildings owned by their respective States or munici22 palities. Requests for grants shall be submitted to the Panel, 23 through the Administrator, and shall include, in accordance 24 with procedures published by the Administrator in the Fed
