(c) Any vessel, to the extent that it is subject to the Small Passenger Carrying Vessel Act, May 10, 1956 (70 Stat. 151), or to any other vessel inspection statute of the United States, is exempt from the provisions of this Act.

(d) Nothing contained in this Act shall be deemed to exempt from the antitrust laws of the United States any conduct that would be unlawful under such laws, or to prohibit under the antitrust laws of the United States any conduct that would be lawful under such laws.

(e) Regulations previously issued under statutory provisions repealed, modified, or amended by this Act continue in effect as though promulgated under the authority of this Act until expressly abrogated, modified, or amended by the Secretary under the regulatory authority or this Act.

(f) Any criminal or civil penalty proceeding under the Motorboat Act of 1940, as amended, or the Federal Boating Act of 1958, as amended, for a violation which occurred before the effective date of this Act may be initiated and continue to conclusion as though the former Acts had not been amended or repealed hereby. An Act

To establish the National Advisory Committee on the Oceans and Atmosphere.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, There is hereby National Advisory established a committee of twenty-five members to be known as the Committee on National Advisory Committee on Oceans and Atmosphere (hereafter Oceans and referred to in this Act as the "Advisory Committee”). SEC. 2. (a) The members of the Advisory Committee, who may not be full-time officers or employees of the United States, shall be appointed by the President and shall be drawn from State and local government, industry, science, and other appropriate areas.

(b) Except as provided in subsections (c) and (d), members shall be appointed for terms of three years.

(c) of the members first appointed, as designated by the President at the time of appointment

(1) nine shall be appointed for a term of one year,

(2) eight shall be appointed for a term of two years, and
(3) eight shall be appointed for a term of three years.

(d) Any member appointed to fill a vacancy occurring prior to the expiration of the term for which his predecessor was appointed shall be appointed only for the remainder of such term. A member may serve after the expiration of his term until his successor has taken office.

(e) The President shall designate one of the members of the Advis- Chairmar: and ory Committee as the Chairman and one of the members as the Vice Vice Chairman Chairman. The Vice Chairman shall act as Chairman in the absence

or incapacity of, or in the event of a vacancy in the office of, the

Chairman.

SEC. 3. Each department and agency of the Federal Government Senior policy concerned with marine and atmospheric matters shall designate a official, senior policy official to participate as observer in the work of the Advisory Committee and to offer necessary assistance.

SEC. 4. The Advisory Committee shall (1) undertake a continuing Duties. review of the progress of the marine and atmospheric science and service programs of the United States, and (2) advise the Secretary of Commerce with respect to the carrying out of the purposes of the National Oceanic and Atmospheric Administration. The Advisory Reports to Committee shall submit a comprehensive annual report to the Presi- President and dent and to the Congress setting forth an overall assessment of the Congress. status of the Nation's marine and atmospheric activities and shall submit such other reports as may from time to time be requested by the President. Each such report shall be submitted to the Secretary of Commerce who shall, within 90 days after receipt thereof, transmit copies to the President and to the Congress, with his comments and recommendations. The comprehensive annual report required herein shall be submitted on or before June 30 of each year, beginning June 30, 1972.

SEC. 5. Members of the Advisory Committee shall, while serving on Pay. business of the Committee, be entitled to receive compensation at rates not to exceed $100 per diem, including traveltime, and while so serving away from their homes or regular places of business they may be allowed travel expenses, including per diem in lieu of subsistence, in the same manner as the expenses authorized by section 5703 (b) of title

5, United States Code, for persons in Government service employed 80 Stat. 499. intermittently.

SEC. 6. The Secretary of Commerce shall make available to the Advisory Committee such staff, information, personnel and adminisother agencies, trative services and assistance as it may reasonably require to carry out its activities. The Advisory Committee is authorized to request from any department, agency, or independent instrumentality of the Federal Government any information and assistance it deems necessary to carry out its functions under this Act; and each such department, agency, and instrumentality is authorized to cooperate with the Advisory Committee and, to the extent permitted by law, to furnish such information and assistance to the Advisory Committee upon request made by its Chairman, without reimbursement for such services and assistance.

Appropriation.

SEC. 7. There is hereby authorized to be appropriated to the Secretary of Commerce $200,000 for the fiscal year ending June 30, 1972, and each succeeding fiscal year to carry out the purposes of this Act. Approved August 16, 1971.

An Act

To amend the Fish and Wildlife Act of 1956 to provide a criminal penalty for shooting at certain birds, fish, and other animals from an aircraft.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Fish and Airborne hunting. Wildlife Act of 1956 is amended by adding at the end thereof the Prohibition. following new section:

"SEC. 13. (a) Any person who

"(1) while airborne in an aircraft shoots or attempts to shoot Penalty. for the purpose of capturing or killing any bird, fish, or other

animal; or

or

"(2) uses an aircraft to harass any bird, fish, or other animal;

“(3) knowingly participates in using an aircraft for any purpose referred to in paragraph (1) or (2);

shall be fined not more than $5,000 or imprisoned not more than one year, or both.

"(b) (1) This section shall not apply to any person if such person Exception. is employed by, or is an authorized agent of or is operating under a 85 STAT. 480 license or permit of, any State or the United States to administer or 85 STAT. 481 protect or aid in the administration or protection of land, water, wildlife, livestock, domesticated animals, human life, or crops, and each such person so operating under a license or permit shall report to the applicable issuing authority each calendar quarter the number and type of animals so taken.

"(2) In any case in which a State, or any agency thereof, issues a Report. permit referred to in paragraph (1) of this subsection, it shall file with the Secretary of the Interior an annual report containing such information as the Secretary shall prescribe, including but not limited to

"(A) the name and address of each person to whom a permit was issued;

"(B) a description of the animals authorized to be taken thereunder, the number of animals authorized to be taken, and a description of the area from which the animals are authorized to be taken;

"(C) the number and type of animals taken by such person to whom a permit was issued; and

"(D) the reason for issuing the permit.

(c) As used in this section, the term 'aircraft' means any contriv- "Aircraft." ance used for flight in the air.".

SEC. 2. (a) Section 609 of the Federal Aviation Act of 1958 (49 Airman sertifi❤ U.S.C. 1429) is amended by inserting "(a)" immediately after "SEC. oate, suspension. 609." and by adding at the end thereof the following new subsection: 72 Stat. 779.

"VIOLATION OF CERTAIN LAWS

"(b) The Administrator, in his discretion, may issue an order amending, modifying, suspending, or revoking any airman certificate upon conviction of the holder of such certificate of any violation of subeection (a) of section 13 of the Fish and Wildlife Act of 1956, regarding Supra. the use or operation of an aircraft.".
