"FINDINGS; DECLARATIONS OF POLICY

"SEC. 1102. The Congress hereby finds and declares the 3 following:

"(1) Heroin addiction is a major aspect of an acute national drug abuse and drug dependent problem and heroin addiction itself is a national problem of unparalleled gravity and growing proportions which afflicts not only inner city residents but all urban, suburban, and rural areas of this Nation;

"(2) Heroin addiction significantly contributes to an increase in crime against persons and property;

"(3) Methadone maintenance with appropriate rehabilitative services is a recognized effective interim means for treating substantial numbers of heroin addicts who voluntarily submit to such treatment for their addiction;

"(4) Heroin addiction can seriously impair health and can inflict pain and suffering on individuals, families, and communities; and

"(5) The increasing rate of heroin addiction and

abuse constitutes a threat to national health and welfare and an emergency requiring an immediate and effective national commitment to increased health, education, and

rehabilitation efforts for narcotic addicts, including but

not limited to, the establishment of substantial numbers

"DEFINITIONS

"SEC. 1103. As used in this title, the term—

"(1) heroin addict' means any individual who habitually uses heroin (as that specific chemical designation is applied by title II of the Comprehensive Drug

Abuse Prevention and Control Act of 1970) and who is in a state of psychic or physical dependence, or both, arising from administration of that substance on a continuing basis. The heroin addict is characterized by behavioral and other responses which include a strong compulsion to take the substance on a continuous basis in order to experience its psychic effects, or to avoid the discomfort caused by its absence; except that the Secretary may modify this definition by regulations; and

"(2) 'rehabilitation' or 'rehabilitative services' includes such services as professional counseling, educa

tional and vocational guidance, education, training and

job referral and placement and such other intensive, 21 skilled services applied on an in-patient or out-patient

basis, over such protracted period of time as may be

necessary to assist the individual to achieve maximum

utilization of his potential and to return, as soon as

practicable, to his or her family and community as a

productive, self-respecting, and self-sustaining member

of society; and

"(3) 'State' means each of the several States of the United States, the District of Columbia, the Virgin

Islands, Guam, American Samoa, Trust Territory of the
Pacific Islands, and the Commonwealth of Puerto Rico.

"ESTABLISHMENT OF PROGRAM

"SEC. 1104. (a) For the purpose of enabling the Sec9 retary of Health, Education, and Welfare (referred to in 10 this title as the 'Secretary') to make grants to States to 11 enable any such State to establish and carry out a program 12 to provide medical and other assistance to heroin addicts 13 and pursuant to which methadone (or any other drug 14 designated by the Secretary by regulation to be an effective 15 heroin antagonist) may be administered to any individual 16 determined to be a heroin addict, there are authorized to 17 be appropriated for the fiscal year ending June 30, 1972, 18 the sum of $ ; for the fiscal year ending June

19 30, 1973, the sum of $

and for the fiscal year

20 ending June 30, 1974, the sum of $

"(b) Within sixty days following the date of the enact22 ment of this title, the Secretary shall promulgate such 23 regulations as he determines necessary, to enable him to

carry out the provisions of this title. Such regulations shall 25 include

"(1) the method or methods to be employed and the manner and conditions under which the physician in charge of any treatment facility established under

any program pursuant to this title shall determine an

individual to be a heroin addict;

"(2) the method or methods and the manner and conditions under which methadone may be administered in any treatment facility established under any such program and for what period of time, but in no event shall any methadone be administered under any

program pursuant to this title in any manner other than orally;

“(3) the criteria for administering heroin antagonist drugs other than nethadone in such treatment facilities

and the conditions under which such drugs may be ad

ministered to heroin addicts.

"ALLOCATION OF FUNDS

"SEC. 1105. (a) For each fiscal year referred to in sec

19 tion 1104, the Secretary shall, in accordance with regula20 tions, allot the sums appropriated for such year pursuant to 21 such section among the States on the basis of the relative

population, financial need, and need for more effective prevention, treatment, and rehabilitation programs for heroin addicts; except that no such allotment to any State (other 25 than the Virgin Islands, American Samoa, Guam, and

1 the Trust Territory of the Pacific Islands, for any fiscal

2 year shall be less than $200,000.

"(b) Any amount so allotted to a State during any such 4 fiscal year (other than the Virgin Islands, American Samoa, 5 Guam, the Trust Territory of the Pacific Islands, and the 6 Commonwealth of Puerto Rico) and remaining unobligated 7 at the end of such year shall remain available to such State, 8 for the purposes for which made, for the next fiscal year 9 (and for such year only) and any such amount shall be in 10 addition to the amounts allotted to such State for such purpose for such next fiscal year; except that any such amount 12 remaining unobligated at the end of the sixth month follow13 ing the end of such year for which it was allotted which 14 the Secretary determines will remain unobligated by the 15 close of such next fiscal year may be reallotted by the Secre16 tary, to be available for the purposes for which made until 17 the close of such next fiscal year, to other States which have 18 need therefor, on such basis as the Secretary deems equitable 19 and consistent with the purposes of this title, and any amount 20 so reallotted to a State shall be in addition to the amounts 21 allotted and available to the States for the same period. Any 22 amount allotted under subsection (a) of this section to the 23 Virgin Islands, American Samoa, Guam, the Trust Terri24 tory of the Pacific Islands, or the Commonwealth of Puerto 25 Rico for a fiscal year and remaining unobligated at the end
