TRANSITIONAL PROVISIONS

SEC. 9. (a) The President may authorize any per

son who immediately prior to the date of enactment of 11 this Act held a position in the executive branch of the Gov

ernment to act as the Director of the Special Action Office

for Drug Abuse Prevention until the office of Director is 14 for the first time filled pursuant to the provisions of this Act

or by recess appointment, as the case may be.

(b) The President may similarly authorize any such

person to act as Deputy Director.

(c) The President may authorize any person who serves in an acting capacity under the foregoing provisions 20 of this section to receive the compensation attached to the 21 office in respect of which he so serves. Such compensation, 22 if authorized, shall be in lieu of, but not in addition to, other 23 compensation from the United States to which such person may be entitled.

TRANSFER OF FUNDS

SEC. 10. The Director of the Office of Management and 3 Budget is authorized to provide for the transfer to the Office 4 of such unexpended balances of appropriations, and of other 5 funds, available or hereafter made available for Federal drug 6 abuse training, education, rehabilitation, research, preven7 tion, treatment programs, and activities, as he may deem to 8 be appropriate to carry out the provisions of this Act.

APPROPRIATIONS AUTHORIZED

SEC. 11. There are hereby authorized to be appropri11 ated to the President such sums as may be necessary to carry 12 out the purposes of this Act. Any of those sums may be 13 appropriated without regard to fiscal year limitations.

JOINT FUNDING

SEC. 12. Notwithstanding any other provision of law, 16 where funds are made available by more than one Federal 17 agency to be used by an agency, organization, institution, or individual to carry out a Federal drug abuse training, 19 education, rehabilitation, research, prevention, or treatment 20 program or activity, any one of the Federal agencies pro21 viding funds may be designated by the Director to act for 22 all in administering the funds advanced. In such cases, a 23 single non-Federal share requirement may be established 24 according to the proportion of funds advanced by each Fed25 eral agency, and any such agency may waive any technical

1 grant or contract requirement (as defined in such regula2 tions) which is inconsistent with the similar requirement of

3 the administering agency or which the administering agency 4 does not impose.

6 SEC. 13. The Director is authorized to accept and em7 ploy in furtherance of the purpose of the Act or any Federal 8 drug abuse training, education, rehabilitation, research, pre9 vention, or treatment program or activity, voluntary and 10 uncompensated services notwithstanding the provisions of 11 section 3679 (b) of the Revised Statute (31 U.S.C. 12 665 (b)).

EFFECTIVE AND TERMINATION DATE

14 SEC. 14. (a) The provisions of this Act shall take effect 15 thirty days after the Director or Acting Director first takes 16 office or on such earlier date as the President may prescribe 17 and publish in the Federal Register, except that any of the 18 officers provided for in section 4 of this Act may be nomi19 nated and appointed and any of the interim officers provided 20 for by section 9 may be authorized to serve, at any time 21 after the date of enactment of this Act.

(b) This Act shall terminate on June 30, 1974, unless 23 extended by the President, in which case it shall expire on 24 June 30, 1976, or such earlier date after June 30, 1974, 25 as the President may prescribe and publish in the Federal

A BILL

To require community mental health centers and hospitals and other medical facilities of the Public Health Service to provide needed treatment and rehabilitation programs for drug addicts and other persons with drug abuse and other drug dependence problems, and for other purposes.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) section 221 of the Community Mental Health 4 Centers Act (42 U.S.C. 2688a) is amended by adding at 5 the end thereof the following new subsection:

6 "(c) No grant may be made under this part with re

spect to any community mental health center for any fiscal

8 year beginning after June 30, 1972, unless the application

1 for a grant for such center contains assurances satisfactory to

2 the Secretary that—

"(1) the center will provide in such fiscal year a treatment and rehabilitation program for drug addicts

and other persons with drug abuse and other drug

dependence problems who are in the area served by the center or the need for such a program in the area served by the center is not of such magnitude to warrant the provision of such a program by the center; and

"(2) the center will enter into agreements with departments and agencies of the Government under which agreements the center may be used (to the maxi

mum extent practicable) in treatment and rehabilitation programs (if any) provided by such departments and agencies for drug addicts and other persons with drug abuse and other drug dependence problems who are in the area served by the center."

(b) Section 224 (a) of such Act (42 U.S.C. 2688d (a)) 19 is amended by striking out "$60,000,000" and inserting in 20 lieu thereof "$220,000,000”.

SEC. 2. (a) Section 341 (a) of the Public Health Serv22 ice Act (42 U.S.C. 257 (a) (relating to care and treat23 ment of narcotic addicts and other drug abusers) is amended 24 by adding at the end thereof the following new sentence: "In 25 carrying out this subsection, the Secretary shall establish in
