1 2 58 Education regarding the improvement of the coordina tion and development of Federal education programs. 3 (b)(1) In preparing and developing the report required 4 by subsection (a), the Secretary shall, to the maximum extent 5 practicable, consult with members of the public, including 6 representatives of parents, students, educators, Indian tribes, 7 State and local governments, and other organizations and in8 dividuals. Within ninety days after the transmission of such 9 report to the Congress, the Secretary shall hold public hear10 ings in the District of Columbia and in such other locations 11 as the Secretary deems appropriate to maximize public 12 participation. 13 (2) The Secretary may reimburse any person for ex14 penses reasonably incurred in the course of consultation or 15 hearings under paragraph (1) if such person— 16 17 18 19 20 (A) has made or is likely to make a material contribution to the work of the Department; and (B) could not otherwise participate fully and effectively in such consultation. (3) For purposes of this section, the term "person" shall 21 have the same meaning as in section 551(2) of title 5, United 22 States Code. 59 1 STUDY OF THE ADMINISTRATION OF FEDERAL INDIAN 2 EDUCATION PROGRAMS 3 SEC. 428. (a) The Secretary of Health and Human 4 Services, the Secretary of the Interior, and the Director of 5 the Office of Management and Budget shall jointly conduct a 6 comprehensive study on the administration of Indian educa7 tion programs by the Federal Government. In conducting the 8 study, the Secretaries and the Director of the Office of Man9 agement and Budget shall consult with Indians, Alaskan 10 Natives, Aleuts, affected Indian tribes, and Indian 11 organizations. 12 23 13 14 15 16 17 18 19 21 2220 222 223 (b) The study required by this section shall contain- (1) an analysis of the problems in the Federal administration of Indian education programs; (2) recommendations for administrative and programmatic improvements in such programs; and (3) recommendations concerning the proper organizational structure for Indian education programs within the Federal Government, including an analysis concerning the consolidation of Indian education programs and the transfer of such programs to the Department of Education. (c) The study required by this section shall be transmit 24 ted to the Congress and the President not later than six 25 months after the date of enactment of this Act. 60 1 RELATIONSHIP TO GENERAL EDUCATION PROVISIONS ACT 2 SEC. 429. Except where inconsistent with the provi 3 sions of this Act, the General Education Provisions Act shall 4 apply to functions transferred by this Act to the extent appli 5 cable immediately prior to the effective date of this Act. 6 7 AUTHORIZATION OF APPROPRIATIONS SEC. 430. Subject to any limitation on appropriations 8 applicable with respect to any function transferred to the 9 Secretary, there are authorized to be appropriated such sums 10 as may be necessary to carry out the provisions of this Act 11 and to enable the Secretary to administer and manage the 12 Department. Funds appropriated in accordance with this sec13 tion shall remain available until expended. 14 15 16 17 18 TITLE V-TRANSITIONAL, SAVINGS, AND CONFORMING PROVISIONS TRANSFER AND ALLOCATIONS OF APPROPRIATIONS AND PERSONNEL SEC. 501. (a) Except as otherwise provided in this Act, 19 the personnel employed in connection with, and the assets, 20 liabilities, contracts, property, records, and unexpended bal21 ances of appropriations, authorizations, allocations, and other 22 funds employed, held, used, arising from, available to or to be 23 made available in connection with the functions transferred 24 by this Act, subject to section 202 of the Budget and Ac25 counting Procedures Act of 1950, are transferred to the Sec 61 1 retary for appropriate allocation. Unexpended funds trans2 ferred pursuant to this subsection shall be used only for the 3 purposes for which the funds were originally authorized and 4 appropriated. 5 (b) Positions expressly specified by statute or reorgani6 zation plan to carry out functions transferred by this Act, 7 personnel occupying those positions on the effective date of 8 this Act, and personnel authorized to receive compensation in 9 such positions at the rate prescribed for offices and positions 10 at level I, II, III, IV, or V of the Executive Schedule con11 tained in sections 5312 through 5316 of title 5, United States 12 Code, on the effective date of this Act, shall be subject to the 13 provisions of section 503. 14 15 EFFECT ON PERSONNEL SEC. 502. (a) Except as otherwise provided in this Act, 16 the transfer pursuant to this title of full-time personnel 17 (except special Government employees) and part-time per18 sonnel holding permanent positions shall not cause any such 19 employee to be separated or reduced in grade or compensa20 tion for one year after such transfer or after the effective date 21 of this Act, whichever is later. 22 (b) Any person who, on the day before the effective date 23 of this Act, held a position compensated in accordance with 24 the Executive Schedule prescribed in chapter 53 of title 5, 25 United States Code, and who, without a break in service, is 62 1 appointed in the Department to a position having duties com2 parable to the duties performed immediately preceding such 3 appointment shall continue to be compensated in such new 4 position at not less than the rate provided for such previous 5 position for the duration of the service of such person in such 6 new position. 7 8 AGENCY TERMINATIONS SEC. 503. Except as otherwise provided in this Act, 9 whenever all of the functions of any agency, commission, or 10 other body, or any component thereof, have been terminated 11 or transferred by this Act from that agency, commission, or 12 other body, or component thereof, such agency, commission, 13 or other body, or component, shall terminate. If an agency, 14 commission, or other body, or any component thereof, termi15 nates pursuant to the provisions of the preceding sentence, 16 each position and office therein which was expressly author17 ized by law, or the incumbent of which was authorized to 18 receive compensation at the rates prescribed for an office or 19 position at level II, III, IV, or V of the Executive Schedule 20 contained in sections 5313 through 5316 of title 5, United 21 States Code, shall terminate. 22 23 INCIDENTAL TRANSFERS SEC. 504. The Director of the Office of Management 24 and Budget, at such time or times as such Director shall 25 provide, is authorized and directed to make such determina |
