based upon the average impairment in earning capacity such

disability would cause in civilian occupations. TYPES OF ASSISTANCE: Direct Payments with Unrestricted Use. USES AND USE RESTRICTIONS: No restrictions. ELIGIBILITY REQUIREMENTS: Applicant Eligibility: Persons who have suffered disabilities due to

service in the Armed Forces of the United States. Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: Military discharge certificate showing

the separation from service was under other than dishonorable conditions. The disability must be shown to have been incurred in

or aggravated by service in the line of duty during service. APPLICATION AND AWARD PROCESS:

Preapplication Coordination: None.
Application Procedure: An application (VA Form 21-526) may be

obtained from any VA office or regional office (see appendix) and

submitted to the regional office. Award Procedure: Awards are authorized at the regional office. Deadlines: None, but it must be filed within 1 year after separation

from service order for benefits to be paid from the day following discharge; otherwise, benefits are payable only from the

date of receipt of the claim. Range of Approval/Disapproval Time: 50 percent in 75 days or less. Appeals: Available through special board; 85.8 percent in 75 days or

less (reworking time). In the event of a denial, claimants are

advised of appeal rights and procedures at the time of notification. Renewals: Not applicable. ASSISTANCE CONSIDERATIONS:

64.110 VETERANS DEPENDENCY AND INDEMNITY COMPENSATION FOR SERVICE-CONNECTED DEATH

(DIC)

VETERANS ADMINISTRATION AUTHORIZATION: 38 U.S.C. 410. OBJECTIVES: To compensate surviving widows, children and parents

for the death of any veteran who died on or after January 1, 1957

because of a service-connected disability. TYPES OF ASSISTANCE: Direct Payments with Unrestricted Use. USES AND USE RESTRICTIONS: No restrictions. ELIGIBILITY REQUIREMENTS: Applicant Eligibility: A surviving unremarried widow, a child or

children and parent or parents of the deceased veteran who died on or after January 1, 1957 because of a service-connected disability. No amount is payable to a parent if his income is more than $2,300 annually, or if living with his spouse or remarried,

their combined annual income is more than $3,500. Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: Death certificate, marriage certificate,

birth certificate(s), and military discharge certificate. APPLICATION AND AWARD PROCESS:

Preapplication Coordination: None.
Application Procedure: An application (VA Form 21-534 for widows

and children; 21-535 for parents) may be obtained from any VA
office or regional office (see appendix) and submitted to the

regional office. Award Procedure: Awards are authorized at the regional office. Deadlines: None, but benefits are payable from the first day of the

month in which the veteran's death occurred if the claim is

received within 1 year after the date of death; otherwise, benefits

are payable from the date of receipt of the claim. Range of Approval/Disapproval Time: 56 percent in 30 days or less. Appeals: Available through special board; 85.8 percent in 75 days or

less (reworking time). In the event of a denial, claimants are

Parents must report changes in income and every year they are sent an income questionnaire unless they are both age or over and have been in receipt of DIC for 2 consecutive years. They still must report an

64.111 VETERANS EDUCATIONAL ASSISTANCE

(GI Bill)

FEDERAL AGENCY: DEPARTMENT OF VETERANS BENEFITS,

VETERANS ADMINISTRATION AUTHORIZATION: 38 U.S.C. 1651. OBJECTIVES: To make service in the Armed Forces more attractive by

extending benefits of a higher education to qualified young persons who might not otherwise be able to afford such an education; restore lost educational opportunities to those whose

education was interrupted by active duty after January 31, 1955. TYPES OF ASSISTANCE: Direct Payments for Specified Uses. USES AND USE RESTRICTIONS: The veteran may select a program

of education to assist him in attaining an education, professional, or vocational objective at any approved educational institution he chooses which will accept him as a student or trainee. The Administrator will not approve enrollment in certain courses, basically those he finds avocational or recreational in character. A veteran who must complete high school training to qualify for higher education may receive educational assistance without

charge to his basic entitlement. ELIGIBILITY REQUIREMENTS: Applicant Eligibility: The veteran must have served honorably on

active duty for more than 180 days, part of which occurred after January 31, 1955 or who was discharged after such date because of a service-connected disability. A serviceman who has served on active duty for more than 180 days and who continues on active duty is also eligible. Upon completion of 18 months of active duty, the maximum of 36 months of educational assistance will be granted, otherwise assistance will be provided for at the rate of

1-1/2 months for each month of service. Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: Military discharge certificate,

certification of enrollment by the educational institution in approved courses leading to an educational, professional or vocational objective. The Administrator will not approve enrollment in certain courses; basically those he finds avocational

date of the veteran's last release from active duty after January 31,

guaranteed or insured loans. TYPES OF ASSISTANCE: Direct Loans. USES AND USE RESTRICTIONS: VA may make loans generally up to

$ 21,000 ($ 25,000 in Alaska) to eligible applicants for any of the following purposes: (a) purchase or construction of a dwelling to be owned and occupied by the veteran as his home; (b) construction on land owned by the veteran of a farm residence to be occupied as his home; (c) repair, alteration or improvement of a farm residence or other dwelling owned by the veteran and occupied as his home. Restrictions are that: (a) the home must be located in a housing credit shortage area designated by the Administrator of Veterans Affairs; (b) loans for construction of a home or purchase of homes completed less than 1 year must meet VA minimum construction standards for housing credit shortage areas; (c) the nature and condition of other housing must be suitable for dwelling; (d) the loan may not exceed the VA determined reasonable value of the property; (e) the veteran must be unable to obtain financing from private lenders or the Secretary of Agriculture under the Bankhead-Jones Farm Tenant Act or the

64,114 VETERANS HOUSING - GUARANTEED AND INSURED LOANS

FEDERAL AGENCY: DEPARTMENT OF VETERANS BENEFITS,

VETERANS ADMINISTRATION AUTHORIZATION: 38 U.S.C. 1810 and 1814. OBJECTIVES: To assist veterans of World War II, the Korean and

post-Korean conflict periods, certain servicemen and unremarried widows of veterans, in obtaining credit for the purchase,

construction or improvement of homes. TYPES OF ASSISTANCE: Guaranteed/Insured Loans. USES AND USE RESTRICTIONS: VA may guarantee or insure home

loans made to eligible veterans for any of the following purposes: (a) purchase or construction of a dwelling to be owned and occupied by the veteran as his home; (b) construction on land owned by the veteran of a farm residence to be occupied as his home; (c) repair, alteration or improvement of a farm residence or other dwelling owned by the veteran and occupied as his home; (d) purchase of a housing unit in an approved condominium; (e) refinance a mortgage on a home owned and occupied by the veteran. The lender may be guaranteed against loss up to 60 percent of a loan, or a maximum of $12,500, for any eligible veteran. Insurance is available only on loans made to veterans with World War II or Korean conflict entitlement. In eligible cases the lender is reimbursed for losses up to 15 percent of the aggegate of all insured GI loans the lender has made or purchased. Restrictions on guaranty or insurance of home loans are that: (a) loans for construction of homes or purchase of homes completed less than 1 year are ineligible unless the property meets or exceeds VA minimum planning, construction and general acceptability requirements; (b) the nature and condition of other housing must be suitable for dwelling; (c) the veteran must certify that he intends to occupy the property as his home; (d) the loan may not

exceed the VA determined reasonable value of property. ELIGIBILITY REQUIREMENTS: Applicant Eligibility: (a) Veterans of World War II or the Korean
