19.200 CLAIMS AGAINST FOREIGN GOVERNMENTS

(International Claims)

FEDERAL AGENCY: OFFICE OF THE LEGAL ADVISER,

DEPARTMENT OF STATE AUTHORIZATION: Authority to act is based upon the powers and

duties delegated to the President under section 3 of Article II of the Constitution of the United States and therefrom to the

Secretary of State. There is no statute. OBJECTIVES: To obtain settlements of all legally valid claims of

nationals of the United States against foreign governments. A claim may result from any one of a number of situations in which a national of the United States may be injured by a foreign government in violation of international law. It can, for example, be based upon a taking of property without payment of prompt, adequate and effective compensation; other acts or omissions of governmental organs incompatible with international obligations; acts of individuals, insurgents and mobs under circumstances establishing a lack of due diligence on the part of government

officials, etc. TYPES OF ASSISTANCE: Provision of Specialized Services. USES AND USE RESTRICTIONS: The Government of the United

States, at the discretion of the Secretary of State, will act on behalf of U.S. nationals in attempting to settle claims against foreign governments. Assistance is not available: (1) to non-nationals, (2) in cases where there has not been an exhaustion of all local administrative or judicial remedies with a resulting denial of justice, or (3) where the respondent government is not responsible under international law. If the claim is found to be valid by the State Department and the Secretary of State chooses to back the claim, the claimant will be informed as to how the claim should be prepared and documented. The State Department, using the documentation prepared by the claimant, would then act on behalf of the claimant in pressing for settlement. Settlements (compensation or restitution) result either from direct negotiation through diplomatic channels or from arbitration, which lead to

payment by the foreign government. ELIGIBILITY REQUIREMENTS: Applicant Eligibility: United States nationality at the time the claim

arose and international responsibility of the respondent

establishing his United States nationality, the principle or principles of international law giving rise to an obligation on the part of the foreign government, and the facts and circumstances of

the case which appertain thereto. APPLICATION AND AWARD PROCESS: Preapplication Coordination: Potential applicants are invited to

discuss possible claims prior to submitting documentation. Application Procedure: Initial inquiries relating to claims based upon

loss of or damage to property should include the following information: (a) date and manner in which claimant became a citizen of the United States; (b) full description of the property in question and its exact location when loss occurred; (c) date and manner of acquisition of claimant's ownership of the property or other interest therein; (d) the action taken against the property

which is considered as giving rise to a claim against a foreign government; (e) identification of laws, decrees, governmental agencies and officials taking the property, and the date the action was taken; (f) the nature and amount of damage.

Initial inquiries relating to claims based upon personal injury or loss of life should include a statement of facts relating to: (a) American citizenship of the claimant. If the claim is based upon loss of life the American citizenship of both the claimant and the deceased must be established; (b) the relationship of the claimant to the deceased in death cases; (c) time, place, and circumstances under which the injury or death occurred, including the identity of persons, officials, or agencies causing the injury or death; (d)

nature and extent of damages sustained. Award Procedure: The Secretary of State will make the final

determination on acting in behalf of the claimant. If the Secretary of State chooses to represent the claimant, the claimant will be informed of how to prepare the case. Actual payments of claims are the responsibility of the respondent government, not the State

Department. Deadlines: Unlimited, providing there are no provisions in

international law setting limits on the time allowed for filing that

type of claim (laches). Range of Approval/Disapproval Time: Requests for assistance are

OBJECTIVES: To improve safe operations and uses of water craft.

USES AND USE RESTRICTIONS: The Coast Guard Auxiliary presents

to the public 4 boating courses of varying lengths. The essentials
of safe motorboat operation are presented in each. In calendar
year 1970, 209,521 people attended the courses offered.

Courtesy motorboat examinations are free equipment checks of
boats made only at the owner's request. In calendar year 1970,
221,678 were performed. It covers Federal equipment
requirements for pleasure boats and additional safety equipment
recommended by the Auxiliary. If deficiencies are found no report
is made to any law enforcement agency.

Members of the Auxiliary (30,221 as of December 31, 1970) in their own boats assist the Coast Guard in performing its mission on the waters of the United States, Patrols of maritime regattas and parades and assists to fellow boatmen in distress are some of the tasks performed. Since members are civilian volunteers, the thrusts of their effort coincide with the busiest boating periods. Publications in boating safety and accident reporting are also
