No loans can be made for any phase of a shore operation, non maritime liens, repair or purchase of vessel or gear not offered as collateral, a new business venture whose control is by persons who are not engaged in commercial fishing. For purchase or construction of a vessel, a determination that operation of vessel will not cause economic hardship to efficient vessel operators already in that fishery must be made by the Secretary. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: Must be a U.S. citizen residing or conducting business in the United States and (1) owns or operates commercial fishing vessel of U.S. registry; (2) owns or operates any type fishing gear used directly in catching fish or shellfish; (3) can demonstrate to the Secretary that he has the ability, experience, resources, and other qualifications for successful operation of vessel or gear to be operated; (4) is a fishery marketing cooperative engaged in marketing all catches of fish or shellfish by its members pursuant to contractual or other enforceable arrangement which empower the cooperative to exercise control over sale of catches and disburse proceeds from such sales.
