11.404 WEATHER FORECASTS AND WARNINGS (National Weather Service)

OBJECTIVES: To warn the general public of impending severe weather and to issue routinely weather forecasts up to 48 hours in advance, and various weather information summaries. TYPES OF ASSISTANCE: Dissemination of Technical Information. USES AND USE RESTRICTIONS: Data is useful to all segments of the economy and the general public. Agriculture, aviation, transportation, marine commerce, boating and fishing interests recreation, forest management, fire prevention, and air pollution control are some of the areas benefiting from the use of the special data provided by this program. There are no restrictions on the potential users of the data regarding qualifications to obtain it. Services and products include: State, zone, and local weather forecasts for up to 48 hours are made every 6 hours, 5 day outlooks, national weather summaries, temperature and precipitation bulletins are issued daily. Dissemination is by NOAA Weather Wire, Press wire, newspapers, radio and TV. Warnings are issued as needed on hurricanes, tornadoes, severe local storms, cold waves, heavy snows, storm tides, Seiches (Great Lakes), etc., and disseminated on an emergency basis.

Farm weather summaries and forecasts, fruit-frost forecasts, and special bulletins for agriculturalists, and fire-weather forecasts for foresters are issued daily or as needed seasonally. Air stagnation potential advisories for air pollution control agencies issued daily. Aviation weather forecasts for all areas of the country and for 427 airports are issued 6-hourly and amended as needed. In-flight advisories on potentially hazardous weather are issued as needed. Boating forecasts for coastal and inland waters issued 4 times daily, augmented by small craft warnings as needed.

Climatic data and summaries are published in various forms convenient for application to local, state, national, and hemispheric problems.

11.405 ANADROMOUS AND GREAT LAKES FISHERIES CONSERVATION

FEDERAL AGENCY: NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION, DEPARTMENT OF COMMERCE AUTHORIZATION: Anadromous Fish Act of 1965; Public Law 89-304 as amended; 16 U.S.C. 757a.f.; Reorganization Plan No. 4, 1970. OBJECTIVES: To cooperate with the States and other non-Federal interests in the conservation, development, and enhancement of the Nation's anadromous fish and those in the Great Lakes that ascend streams to spawn.

TYPES OF ASSISTANCE: Project Grants.

USES AND USE RESTRICTIONS: Funds can be used for spawning area improvement, installment of fish ways, construction of fish protection devices and hatcheries, and for research to improve management and increase anadromous fish resources.

Funds cannot be used for law enforcement, public relations, or construction of facilities and vessels, the primary purpose of which is to commercially harvest, handle, and process fishery products. In addition, funds cannot be used for projects in the Columbia River Basin.

ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: Any interested person or organization may propose a cooperative undertaking. However, all proposals must be approved by the State Fishery agency having responsibility for the resource to be affected by the proposal. Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: None.

APPLICATION AND AWARD PROCESS:

Preapplication Coordination: Applications must be coordinated with State fishery agency having responsibility for the resource affected by the proposal.

Application Procedure: Submission of a project program Form 2-238 to the appropriate regional or area office of the National Marine Fisheries Service listed in the appendix. Submissions must have approval of State fishery agency.

Award Procedure: Funds are made available on a reimbursable basis to cooperator through regional offices. Notification of grant awards are made to the State Central Information Reception Agency on SF 240.

Deadlines: Project proposals should be submitted 30 days in advance of desired effective date, and 30 days prior to June 30 of the fiscal year in which funds will revert.

Range of Approval/Disapproval Time: 16 to 18 working days. Appeals: No formal appeal procedure. If application is unacceptable, the reasons are fully stated to the applicant. If the applicant desires to resubmit application, project must be revised in accordance with recommended changes.

Renewals: No renewal. However, an approved on-going project can be extended by submission of an amendment document. ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements: The Federal share of a project

cost shall not exceed 50 percent. Real and personal property owned or controlled by a cooperator may be used in lieu of matching funds. Such real and personal property must be directly related to the work involved and must be an appropriate cost item of the project. Property may be used as matching funds until the total appraised value is exhausted.

Length and Time Phasing of Assistance: The life of the Act. Federal funds remain available for obligation until June 30 of the fiscal year in which apportioned.

POST ASSISTANCE REQUIREMENTS:

Reports: Progress or segment reports, which are usually annual, or others as requested by Region or Area Offices of the National Marine Fisheries Service. Progress reports may be the form of a manuscript. A completion report is submitted upon completion of work described in approved project proposal. Format for reports is determined by recipient.

Funds cannot be used as grants to charter fishing vessels.

ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: The agency of a State government authorized under its laws to regulate commercial fisheries. Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: The Governor of each State shall notify the Secretary of Commerce which State agency is authorized to regulate commercial fisheries. An official of the State agency shall certify as to the official(s) authorized in accordance with State law to commit the State to participation under the Act, to sign project documents, and to receive payments. 11.409 FISHERIES LOAN FUND

FEDERAL AGENCY: NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION, DEPARTMENT OF COMMERCE AUTHORIZATION: Section 4, Public Law 81-1024, Fish and Wildlife Act, as amended; 16 U.S.C. 742c; Public Law 89-85; Act of July 24, 1965, as amended by Public Law 91-387; Reorganization Plan No. 4, 1970.

OBJECTIVES: To provide financial assistance which will aid the commercial fishing industry to bring about a general upgrading of fishing vessels and gear thereby contributing to more efficient and profitable fishing operations.

TYPES OF ASSISTANCE: Direct Loans.

USES AND USE RESTRICTIONS: Loans are made to finance and refinance the cost of purchasing, constructing, equipping, maintaining, repairing, or operating new or used commercial fishing vessels or gear. There must be evidence that the credit applied for is not otherwise available on reasonable terms. No loans can be made for any phase of a shore operation, non maritime liens, repair or purchase of vessel or gear not offered as collateral, a new business venture whose control is by persons who are not engaged in commercial fishing. For purchase or construction of a vessel, a determination that operation of vessel will not cause economic hardship to efficient vessel operators already in that fishery must be made by the Secretary. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: Must be a U.S. citizen residing or conducting business in the United States and (1) owns or operates commercial fishing vessel of U.S. registry; (2) owns or operates any type fishing gear used directly in catching fish or shellfish; (3) can demonstrate to the Secretary that he has the ability, experience, resources, and other qualifications for successful operation of vessel or gear to be operated; (4) is a fishery marketing cooperative engaged in marketing all catches of fish or shellfish by its members pursuant to contractual or other enforceable arrangement which empower the cooperative to exercise control over sale of catches and disburse proceeds from such sales. Beneficiary Eligibility: Same as applicant eligibility.

Credentials/Documentation: Applicant must furnish proof of: citizenship, vessel ownership or fishing experience, and inability to obtain credit on reasonable terms. APPLICATION AND AWARD PROCESS: Preapplication Coordination: None.

nearest office of financial assistance listed in the appendix.
Award Procedure: Loan is approved by the Director or Regional

Appeals: An applicant, who believes he has new information which
may overcome reason for refusal of loan, may request
reconsideration of his case by forwarding the new information to
the Director or Regional Director, National Marine Fisheries

Renewals: It will not be necessary for an applicant to file a new application if such reconsideration is requested within a period of 6 months of the date of declination of withdrawal of the application by the applicant.
