39.002 DISPOSAL OF FEDERAL SURPLUS REAL PROPERTY

FEDERAL AGENCY: GENERAL SERVICES ADMINISTRATION AUTHORIZATION: Federal Property and Administrative Services Act of 1949, as amended; Public Law 81-152; 63 Stat. 385; 40 U.S.C. 484. Surplus Property Act of 1944, as amended; 50 U.S.C. app. 1622 (g) and (h); Public Law 80-537; 16 U.S.C. 677 b-d; Public Law 91-152; 83 Stat. 400 as amended by Public Law 91-609; 84 Stat. 1770; Public Law 91-485; 84 Stat. 1084; Section 218; Public Law 91-646; 84 Stat. 1894.

OBJECTIVES: To dispose of surplus real property for public purposes. TYPES OF ASSISTANCE: Sale, Exchange or Donation of Property and Goods.

USES AND USE RESTRICTIONS: Surplus real property may be conveyed for: public park or recreation use and public health or educational purposes at discounts up to 100 percent; public airport purposes, wildlife conservation, replacement housing and for historic monument purposes without monetary considerations; and for general public purposes without restrictions at a price equal to the estimated fair market value of the property. Surplus real property may also be transferred to the Secretary of Housing and Urban Development at his request for sale or lease by him at its fair value for use in the provision of housing for families of individuals of low or moderate income and for related public facilities and for related commercial and industrial facilities approved by the Secretary.

Restrictions: Surplus real property conveyed for public park or recreation use, historic monument, public airport use, and wildlife conservation use must be used for the purposes so conveyed in perpetuity and property conveyed for public health or educational purposes must be used for those purposes for a period of 30 years. Property conveyed to other than a public body for low or moderate income housing and related facilities must be used for this purpose for a period of not less than 40 years. Surplus real property which is not donated to public bodies is offered for sale

to the public on a competitive bid basis. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: States and local government agencies are eligible to apply for surplus real property for park, recreation, historic monument, public airport, health, educational, replacement housing, and general public purposes. Eligibility for property for wildlife conservation use is limited to the States. Tax-supported and nonprofit medical and educational institutions which have been held exempt from taxation unde: 501(c) (3) of the Internal Revenue Code are also eligible to apply for property for health and educational use. Public bodies of private individuals are eligible to apply for property for use in the provision of housing for families or individuals of low or moderate income, and for related public, commercial, and industrial facilities. Beneficiary Eligibility: The general public and persons admitted to the health and educational institutions. Credentials/Documentation: The applicant must submit a proposed program of use of the property and evidence of its ability to finance the program.

APPLICATION AND AWARD PROCESS: Preapplication Coordination: Applicants for property coordinate with other Federal agencies as follows: Health or education use Department of Health, Education, and Welfare; Public airport purposes Federal Aviation Administration; Park or recreational and historic monument use - Bureau of Outdoor Recreation, Department of the Interior; Wildlife conservation - Fish and Wildlife Service; Department of the Interior. Low and moderate income housing - Department of Housing and Urban Development. Application Procedure: Applications for health or educational use are submitted to HEW which requests assignment of the property from GSA; applications for park and recreation use are submitted to the Bureau of Outdoor Recreation which re-requests assignment of the property from GSA. Interest in acquiring surplus property 631

for housing and related facilities should be expressed with the Director, Office of New Communities Development, Department of Housing and Urban Development. Applications for other uses are submitted to GSA which then obtains the recommendation of the Federal agency which sponsors the use program. Award Procedure: When possible awards are made through the participating agency. Other awards are made to local or State units of Government by the Administrator of GSA. Deadlines: Advice of interest must be submitted within 20 days from date notice of availability of the property was released. Reasonable time thereafter is allowed for the filing of applications. Range of Approval/Disapproval Time: From 3 to 6 months. Appeals: None.

39.003 DONATION OF FEDERAL SURPLUS PERSONAL PROPERTY (Donation Program)

FEDERAL AGENCY: GENERAL SERVICES ADMINISTRATION AUTHORIZATION: The Federal Property and Administrative Services Act of 1949, as amended; Public Law 81-152; 63 Stat. 385; 40 U.S.C. 484.

OBJECTIVES: To provide surplus personal property for educational, public health, civil defense, and public airport purposes.

TYPES OF ASSISTANCE: Sale, Exchange, or Donation of Property and Goods.

USES AND USE RESTRICTION: Surplus items are used to improve and expand educational, public health, and civil defense equipment and facilities, and for the development, operation, or maintenance of public airports. Restrictions are imposed by agencies determining eligibility (shown under applicant eligibility, below). The following items are representative of those donated: office machines and supplies, furniture, hardware, textiles, special purpose motor vehicles, boats, airplanes, and construction equipment. Items not donated are made available for sale. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: (a) Tax-supported or tax-exempt schools, school systems (tax-supported only), colleges, universities, public libraries (tax-supported only), schools for the mentally retarded or physically handicapped, educational radio or TV stations, medical institutions, hospitals, health centers, and clinics. Eligibility determined by the Department of Health, Education, and Welfare through the State agency for surplus property. (b) Civil defense organizations eligibility is determined by the State civil defense director and the Department of the Army, Office of Civil Defense. (c) Service educational activities, including American Red Cross, Boy Scouts of America, Boys' Clubs of America, Camp Fire Girls, Girl Scouts of the U.S.A., Naval Sea Cadet Corps, United Service Organizations, and schools with military-connected programs eligibility is determined by the Assistant Secretary of Defense (Manpower and Reserve Affairs). (d) Public airports eligibility is determined by the Federal Aviation Administration (e) Non-eligible institutions and organizations include welfare organizations; charitable and purely domiciliary institutions such as old peoples' homes or orphanages; summer camps or clubs or playgrounds not part of a school; Sunday Schools; veterans' organizations; and municipal, county, or State activities, where these are other than eligible educational, public health, civil defense, or airport activities.

39.004 NATIONAL ARCHIVES REFERENCE SERVICES

OBJECTIVES: To provide reference services to the general public and the Federal Government on records of the Federal Government and on historical materials in Presidential libraries. TYPES OF ASSISTANCE: Use of Property, Facilities and Equipment; Advisory Services and Counseling; Dissemination of Technical Information.

USES AND USE RESTRICTIONS: Information is furnished by the National Archives, six Presidential libraries, and 14 Federal records centers. Inquiries about records are answered by mail, but information in the records is furnished by making the records

available in research rooms or by the sale of reproductions.

Restriction statements are provided when there are restrictions on the use of records. The use of historical materials in Presidential libraries is subject to restrictions prescribed by the donors.

39.006 NATIONAL HISTORICAL PUBLICATIONS GRANTS

OBJECTIVES: Collecting, reproducing, and publishing source material significant to the history of the United States.

TYPES OF ASSISTANCE: Project Grants.

USES AND USE RESTRICTIONS: Collecting, reproducing, and publishing source material significant to the history of the United States.

ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: State and local agencies, educational and other nonprofit organizations. Individuals are not eligible. Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: None. APPLICATION AND AWARD PROCESS: Preapplication Coordination: None.

Application Procedure: The applicant institution sends a letter outlining the type of publication, i.e., letterpress or microfilm, the individual or organization whose papers are to be published, the approximate volume of papers involved, the amount of funds available from other sources, the amount of funds requested, and any other information deemed appropriate in describing the scope of the proposed project. Any additional information needed is specifically requested in the reply to the initial letter and instructions are provided for preparation of a formal project proposal.

Award Procedure: Applications are considered periodically at meetings of the Commission. Applications approved by the Commission are formally awarded by the Administrator of GSA to the applicant institution by letter.

Deadlines: None.

Records: The grantee institution maintains records which fully disclose the amount and disposition of granted funds, the total cost of the undertaking, the portion of the cost supplied by other sources, and such other records as will facilitate an effective audit. 39.007 SALE OF FEDERAL SURPLUS PERSONAL PROPERTY (Sales Program)

FEDERAL AGENCY: GENERAL SERVICES ADMINISTRATION AUTHORIZATION: Federal Property and Administrative Services Act of 1949, as amended; Public Law 80-152; 63 Stat. 385; 40 U.S.C. 484. OBJECTIVES: To sell property no longer needed by the Government in an economical and efficient manner and obtain the maximum net return from sales. General Services Administration conducts the sale of personal property for most of the civil agencies; the Department of Defense handles the sale of its own surplus property.

TYPES OF ASSISTANCE: Sale, Exchange, or Donation of Property and Goods.

USES AND USE RESTRICTIONS: This program provides individuals,

business concerns, and other organizations with the opportunity to enter competitive bids for purchase of a wide variety of personal property whenever it is determined surplus to the needs of the Federal Government and available for sale. Included are automotive and other vehicles, aircraft, hardware, plumbing and heating equipment, paper products, office supplies and equipment, and many other items. The Government also generates a substantial quantity of scrap which is made available for public sale. Normally, there are no use restrictions on property purchased from the Government. States and local governments may purchase property by negotiation before it is advertised for competitive bid sale.

ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: Competitive bid sales are open to the general public. The sale of surplus property by negotiation is authorized where the disposal will be to States, territories, possessions, political subdivisions thereof, or tax-supported agencies therein, subject to obtaining the estimated fair market value of the

property and other satisfactory terms of disposal. Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: None.

Application Procedure: Interested individuals may have their names placed on mailing lists maintained by the GSA regional offices to be notified when the types of property desired become available for sale. States and local governments desiring to purchase property by negotiation should contact the General Services Administration regional office serving their area.

Award Procedure: Property is awarded to that responsible bidder whose bid, conforming to the invitation, is most advantageous to the Government, price and other factors considered.

Deadlines: None. (However, bids must be submitted by the time and date indicated in the sales offering.)
