12.100 AQUATIC PLANT CONTROL

FEDERAL AGENCY: DEPARTMENT OF THE ARMY, OFFICE OF

THE CHIEF OF ENGINEERS, DEPARTMENT OF DEFENSE AUTHORIZATION: Public Law 89-298, section 302; Public Law 85-500, section 104; 33 U.S.C. 610.

OBJECTIVES: Provides for the Army Corps of Engineers to cooperate with other Federal, state, and local government agencies to control obnoxious aquatic plants in rivers, harbors, and allied waters. TYPES OF ASSISTANCE: Provision of Specialized Services; Dissemination of Technical Information.

USES AND USE RESTRICTIONS: To supply Federal assistance for the control and eradication of obnoxious aquatic plants in rivers, harbors and allied waters. Non-Federal interests must agree to hold the Government of the United States free from damages and to finance 30 percent of the costs of control operations. The program is designed to deal primarily with weed infestations of major economic significance including such weeds as waterhyacinth, alligatorweed, elodea, watermilfoil, and others which constitute a known problem of economic importance in the area involved. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: State and local government officials should consult the nearest District Engineer who may make investigations and control operations if the project is feasible and can be funded with appropriated funds.

Beneficiary Eligibility: Same as applicant eligibility.

Credentials/Documentation: Letters of local coordination and

interest.

APPLICATION AND AWARD PROCESS:

Preapplication Coordination: Cooperative action of local, state,
Federal and other interests in support of the project.
Application Procedure: A letter to the nearest District Engineer
requesting a reconnaissance study of the problem.

Award Procedure: Preparation, approval and budget of a General
Design Memorandum.

Deadlines: None.

Range of Approval/Disapproval Time: None.

Appeals: There are no appeals procedures as such. The reasons for refusal will be fully stated. If reconsideration is desired, the

applicant should make the changes as appropriate to the situation. Renewals: Not applicable.

ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements: At least 30 percent of the cost of operations must be obtained from local and state resources. Length and Time Phasing of Assistance: For period requiring control within budget allowances.

POST ASSISTANCE REQUIREMENTS:

Reports: As required for local and administrative control.
Audits: As required within the Corps of Engineers.

PROGRAM ACCOMPLISHMENTS: Progressive control and limited
eradication of waterhyacinths, alligator weeds and other obnoxious
aquatic plants from navigable waters, tributary streams and
connecting channels and other allied waters of North Carolina,
South Carolina, Georgia, Florida, Alabama, Mississippi, Louisiana
and Texas has been accomplished. There remain considerable
lower priority areas that justify being placed in a control status as
a part of the continuing program.

12.101 BEACH EROSION CONTROL PROJECTS
(Small Beach Erosion Control Projects)

FEDERAL AGENCY: DEPARTMENT OF ARMY, OFFICE OF THE
CHIEF OF ENGINEERS, DEPARTMENT OF DEFENSE
AUTHORIZATION: Section 103 of the 1962 River and Harbor Act, as
amended; 33 U.S.C. 426g, as amended by 84 Stat. 1821.
OBJECTIVES: Control of beach and shore erosion to public shores
through projects not specifically authorized by Congress.

TYPES OF ASSISTANCE: Provision of Specialized Services.
USES AND USE RESTRICTIONS: Corps of Engineers designs and
constructs the project. Each project selected must be engineeringly
feasible, complete within itself, and economically justified. The
non-Federal sponsoring agency must agree to (1) assume full
responsibility for all project costs in excess of the Federal cost
limit of $1,000,000; (2) provide all necessary lands, easements,
rights-of-way; (3) hold and save the United States free from
damages; (4) assure that water pollution that would affect the
health of bathers will not be permitted; (5) assure continued
public ownership or public use of the beach, and its administration
for public use; (6) provide project maintenance; (7) provide and
maintain necessary access roads, parking areas and other public use
facilities open and available to all on equal terms.
ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: States, political subdivisions of states or other
responsible local agencies established under state law with full
authority and ability to undertake necessary legal and financial
responsibilities.

Beneficiary Eligibility: Same as applicant eligibility.
Credentials/Documentation: Applicant must furnish evidence of legal
authorization, financial capability, and willingness to provide all

necessary local participation and required cooperation. APPLICATION AND AWARD PROCESS: Preapplication Coordination: State or local government officials should consult the nearest District Engineer regarding specific problems and the possibility of remedial action under this program. Intent to file must be coordinated with OMB Circular No. A-95.

Application Procedure: Formal letter to District Engineer from a prospective sponsoring agency indicating clear intent to provide all required local participation.

Award Procedure: The Chief of Engineers approves an individual project upon the basis of a comprehensive investigation and report by the District Engineer.

Deadlines: None.

ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements: Local cost participation
requirements and procedures for determining the local share of
project cost are similar to those for beach erosion control projects
specifically authorized by Congress under regular authorization
procedures. The determination of local cost is based on the public
use and ownership of the beach protected. The Federal
participation can not exceed $1,000,000.

12.102 FLOOD CONTROL WORKS AND FEDERALLY AUTHORIZED COASTAL
PROTECTION WORKS, REHABILITATION
(Public Law 99 Program)

FEDERAL AGENCY: DEPARTMENT OF THE ARMY, OFFICE OF THE CHIEF OF ENGINEERS, DEPARTMENT OF DEFENSE AUTHORIZATION: Public Law 84-99, as amended by Public Law 87-874; 33 U.S.C. 701n.

OBJECTIVES: Assist eligible applicants to repair and restore flood control works damaged by flood; or federally authorized hurricane-flood and shore protection works damaged by extraordinary wind, wave, or water action.

TYPES OF ASSISTANCE: Provision of Specialized Services. USES AND USE RESTRICTIONS: Authorized rehabilitation assistance includes Corps of Engineers accomplishment of emergency work on, with necessary minor modification of, any flood control works or federally authorized coastal protection structures as may be necessary for their adequate functioning for intended purposes. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: Owners of damaged protective works, or State and local officials of public entities responsible for their maintenance, repair and operation.

Beneficiary Eligibility: All persons living in areas protected by eligible flood control or coastal protection works are potential beneficiaries of the program.

Credentials/Documentation: For public entities, copy of resolution or other proceeding constituting official request for assistance. APPLICATION AND AWARD PROCESS: Preapplication Coordination: None.

Application Procedure: Written application by letter or by form request if such form is locally used by the District Engineer of the Corps of Engineers.

Award Procedure: Formal notice of approval and/or disapproval will be furnished applicant by the District Engineer of the Corps of Engineers.

ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements: Local interests are normally required to (a) provide without cost to the United States all lands, easements, and rights-of-way necessary for the authorized work; (b) hold and save the United States free from damages due to the authorized work; (c) maintain and operate, in a manner satisfactory to the Chief of Engineers, all the protective works after completion of repairs. Additionally, work constituting deferred regular maintenance and desired major modifications, may be included at local cost.

POST ASSISTANCE REQUIREMENTS:

12.103 FLOOD FIGHTING AND RESCUE OPERATIONS, AND EMERGENCY PROTECTION OF COASTAL PROTECTIVE WORKS FEDERALLY AUTHORIZED

OBJECTIVES: To provide emergency assistance as required to supplement local efforts and capabilities in time of flood or coastal storm.

USES AND USE RESTRICTIONS: Emergency assistance in all phases of flood fighting and rescue operations is provided to supplement local efforts. No specific restrictions are placed upon such assistance.

ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: State or local public agencies. Beneficiary Eligibility: All persons living in areas subject to floods, and in eligible areas, are potential beneficiaries.

FEDERAL AGENCY: DEPARTMENT OF THE ARMY, OFFICE OF THE CHIEF OF ENGINEERS, DEPARTMENT OF DEFENSE AUTHORIZATION: Flood Control Act, 1960, Section 206, as amended (74 Stat. 500); 33 U.S.C. 709a.

OBJECTIVES: To promote appropriate recognition of flood hazards in land and water use planning and development and to provide needed information, technical services and guidance.

TYPES OF ASSISTANCE: Dissemination of Technical Information; Advisory Services and Counseling.

USES AND USE RESTRICTIONS: The information and assistance provided under this program is available to all levels of government in connection with any flood plain planning and development project or program. Information is also available to individuals. These services are geared primarily to emphasize planning for actions to modify the actual or potential susceptibility to flood damage through land use regulations, other governmental policies, and flood proofing rather than to modify flooding.

There are no restrictions on program services within annual capabilities except that services to individuals are limited to available information.

Information will be publicized and utilized in planning. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: States, political subdivisions of States, other public organizations, and individuals as indicated under "Restrictions."

Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: If request is for information on an individual location, there are no special requirements. If request requires coverage of a sizeable area and is to be handled as a Flood Plain Information Report, then the request must come from an official of a public agency.

APPLICATION AND AWARD PROCESS:

Preapplication Coordination: Although not required, discussion of problem and needs with district engineer's Flood Plain Management Service representative would facilitate request. Application Procedure: Requests are made in the form of a letter to the district engineer documenting the need for assistance. The formal flood plain information report is coordinated through a designated State agency and requires some assurances. Award Procedure: After approval by division engineer, request takes its place among others and is responded to as capability permits, however, response time and approval time may be the same for information readily available. Services and information are provided directly to the applicant except for flood plain information reports which are coordinated through the designated State agency.

Deadlines: None.

Range of Approval/Disapproval Time: 3 to 30 days from receipt of request. Approval does not assure an immediate start. Each request takes its place among others and is responded to as capability permits.

PROGRAM ACCOMPLISHMENTS: Through fiscal year 1970, 442 Flood Plain Information reports had been completed on hazards in over 1,300 places throughout the nation and another 164 underway. In fiscal year 1971, 155 completions and 112 initiations are planned. Regulatory measures have been adopted or strengthened in 285 places, 495 have regulatory studies underway and a total of 721 have used reports in planning. Responses to other requests for information and services numbered about 3,000 during fiscal year 1970; a response rate approaching 4,000 is anticipated for fiscal year 1971.

feasible, complete within itself and economically justified.
Non-Federal interests are responsible for all project costs in excess
of the Federal limit of $50,000. Non-Federal sponsor must
provide lands, easements, rights-of-way; utility relocations; hold
and save the United States free from damages; and, maintain the
project at local cost after completion.

specifically authorized by Congress.

TYPES OF ASSISTANCE: Provision of Specialized Services.
USES AND USE RESTRICTIONS: Corps of Engineers designs and
constructs the project. Each project selected must be engineeringly
feasible, complete within itself, and economically justified.
Non-Federal sponsoring agency must be responsible for all lands
and damages and project costs in excess of the Federal cost limit
of $1,000,000; provide a cash contribution for land enhancement
benefits and for project costs assigned to project features other
than flood control; prevent future encroachment which might
interfere with proper functioning of the project for flood control;
and, maintain the project after completion.

Each project selected must be engineeringly feasible, complete within itself, and economically justified. The non-Federal sponsoring agency must agree to assume full responsibility for all project costs in excess of the Federal cost limit of $1,000,000; contribute toward project costs for construction and maintenance in view of recreational benefits, land enhancement benefits or other special local benefits; provide all necessary lands, easements, rights-of-way; hold and save the United States free from damages; and, provide adequate public landing or wharf, piers, access roads, parking areas and other needed public facilities open and available to all on equal terms. ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: States, political subdivisions of States or other responsible local agencies established under State law with full authority and ability to undertake necessary legal and financial responsibilities.

ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: States, political subdivisions of States or other responsible local agencies established under State law with full authority and ability to undertake necessary legal and financial responsibilities.

Beneficiary Eligibility: Same as applicant eligibility. Credentials/Documentation: Applicant must furnish evidence of legal authorization, financial capability and willingness to provide all necessary local participation and required cooperation.
